INTRODUCTORY REMARKS Chairman pro Tem Shipe reviewed the composition of the Planning Commission, its responsibilities and the format of the meeting. APPROVAL OF MINUTES No minutes were mailed out. ORAL CO~UNICATIONS None Item 3 was taken first as it involved a request for continuance. 3. PUBLIC HEARING: CONDITIONAL USE PERMIT PCC-86-22: REQUEST TO BUILD A 72-UNIT SENIOR CITIZEN APARTMENT COMPLEX AT 328-336 PALOMAR STREET IN THE MONTGOMERY ANNEXATION AREA - JOE BORDI Per letter, dated February 7, 1986, the applicant has requested continuance of this item dependent upon possible rehearing by the Montgomery Planning Committee. Staff concurs in the continuance to a date uncertain. Planning Commission -2- February 13, 1986 The public hearing was opened to the matter of continuance; no one wishing to speak, the public hearing was closed. MSUC(Guiles/Green) to continue consideration of PCC-86-22M to a future date to be determined. Item 5 was taken second as it involved a request for continuance. 5. PUBLIC HEARING: PROPOSED AMENDMENTS TO THE CERTIFIED LOCAL COASTAL PROGRAM ON THE BAYFRONT SPECIFIC PLAN Continuance of this item to the meeting of February 26, 1986 was requested by the applicant to resolve certain factors still under consideration. The public hearing was opened to the matter of continuance; no one wishing to speak, the public hearing was closed. MSUC {Carson/Grasser) to continue consideration of the proposed amendments to the certified Local Coastal Program on the Bayfront Specific Plan to the meeting of February 26, 1986. 1. PUBLIC HEARING: CONDITIONAL USE PERMIT PCC-86-19: REQUEST TO OPERATE MOTORCYCLE REPAIR FACILITY AT 459 BROADWAY CYCLE PARTS OF CHULA VISTA Director of Planning Krempl noted that the item involves a request by the applicant to legitimize and thus continue the operation of a facility for the minor repair of motorcycles at 459 Broadway in the C-T zone. The garage operates from the southeast corner of an existing retail commercial building and is surrounded in all directions by C-T zoning. An acoustical analysis to evaluate potential adverse noise impacts was conducted by General Acoustics in La Jolla on the site, adjacent to the site and in close proximity to the residential units. The consensus of opinion was that the noise contribution by this facility was minimal and within the acceptable range permitted by Chula Vista. An additional item of concern involved the alleged road testing of cycles along the alley. Staff recommends approval and has suggested a number of conditions to enhance compatibility with surrounding residences including a 1-year approval of the CUP; monitoring of area; and possible revocation of the CUP in the event of further complaints such as the letter submitted by a nearby homeowner. Harvey E. Reynolds, 8018 Linen Drive, Santee, CA 92071, former owner of Cycle Parts, testified that in the ll years he had owned the property and during the 2-1/2 years the garage had been in operation, no complaints had been received. He had contacted the Fire Department when the garage was opened and was told by the Inspector that a firewall was needed between the adjacent facility and a pedestrian door should be installed. Mr. Reynolds said he had never heard of a conditional use permit and was of the opinion that he had met all the City requirements. His mechanics had been specifically instructed not to test drive the machines down the alley both to avoid a nuisance factor and Planning Commission -3- February 13, 1986 because the alley was only partially paved and unsafe for test driving. Although he had no control over the road exit taken by his customers, he had endeavored to prevent gunning of engines and pointed out that several families in the area own motorcycles and use the alley. Bennet Manning, 459 Broadway, Chula Vista, present owner of Cycle Parts, testified that he had purchased the business in September and expressed concern over the handicap and heavy burden which would be caused by the proposed 1-year time limit for the CUP. He contended that since the business has been in existence 11 years with no known complaint except Mrs. Keller's letter; and proof is lacking that the noise emanated from Cycle Parts, he was requesting the Commission waive the 1-year clause. In reply to Commissioner Guiles, he said he had no conflict with condition "c" as recommended. Gustave Lange, 572 Roosevelt, CV 92010, stated he had been a resident for 24 years; had no objection to the repair facility and was present at the Planning Commission meeting to make his complaint about the half-paved condition of the alley a matter of record. Director Krempl noted the firewall must be a 4-hour wall and he would encourage the applicant to speak with Director of Building and Housing Grady re the requirements contained in the site plan. MSUC(Green/Guiles) to find that this project will have no significant environmental impacts and to adopt the Negative Declaration issued on IS-86-25. MSUC(Green/Guiles) that based on findings contained in Section "E" of the staff report, to approve the request, PCC-86-19, to operate a motorcycle repair facility at 459 Broadway subject to conditions 2a, b, and c and with the deletion of condition 3, the 1-year limitation. 2. PUBLIC HEARING: MINOR USE PERMIT PCC-86-20M: REQUEST TO APPEAL DENIAL BY THE SAN DIEGO COUNTY ZONING ADMINISTRATOR OF A MINOR USE PERMIT FOR A CONVENIENCE CENTER AT 3023 MAIN STREET (MONTGOMERY) - PHILLIPS REYNOLDS ENGINEERING Commissioner Green noted that to overrule the recommendation of the Montgomery Planning Committee five votes were needed and suggested a continuance to a date when more members could be present. Commissioners Shipe and Carson concurred. The public hearing was opened to the matter of continuance. Dick Reynolds, 71 North Fourth, CV 92010 - Phillips-Reynolds Engineering, Inc., representing the applicant, indicated agreement to the continuance. No one else wishing to speak, the public hearing was closed. Planning Commission -4- February 13, 1986 A short discussion ensued to find a date when all members could be present, with Commissioner Shipe indicating absence on February 26th, and Commissioner Carson on March 12. MSUC{Green/Carson) to continue consideration of Minor Use Permit PCC-86-20M to the meeting of February 26, 1986. 4. PUBLIC HEARING PCA-86-5 - CONSIDERATION OF AMENDMENT TO TITLE 19 OF THE MUNICIPAL CODE BY REVISING SECTIONS 19.13.582 AND 19.70 TO EXPAND THE AUTHORITY OF THE DESIGN REVIEW COMMITTEE Director of Planning Krempl stated that staff had no further comments but was ready to answer any questions. Upon being asked if the inclusion of Montgomery would place a heavy burden on the Design Review Committee, he replied that additional staff was hired because of the Montgomery Annexation but not for design review per se. The effect on staff and the Design Review Committee is not really known at this time because of no prior experience. This being the time and the place as advertised, the public hearing was opened. No one wishing to speak, the hearing was closed. MSUC (Guiles/Carson) (5-0) to recommend Council enact an ordinance amending Title 19 of the Municipal Code to require multiple-family residential projects, major use permits, commercial and industrial projects within the 1986 Montgomery Annexation Area to undergo review and approval by the Design Review Committee as shown in Exhibits A and B. DIRECTOR' S REPORT: Director Commission reminded the Commission that the 1986 LCC Planning Commission Institute will be held March 12-14 at the Town and Country; that money has been budgeted for the Commission to attend; and asked that the Secretary be notified prior to the cut-off date for early registration at the end of the month. The dinner workshop meeting on the 19th would include an update on the General Plan and scope of work. The dinner location was left to the discretion of staff.
