INTRODUCTORY REMARKS Chairman Cannon reviewed the composition of the Planning Commission, its responsibilities and the format of the meeting. APPROVAL OF MINUTES MSC (Guiles/Shipe) Tugenberg & Cannon abstained-to approve the minutes of the meeting of February 13, 1986 as mailed with a correction on page 4 showing Commissioner Grasser instead of Carson; and in the leading of the pledge of allegiance, Chairman Pro Tem Shipe instead of Cannon. ORAL CO~MUNICATIONS - None. 1. PUBLIC HEARING: CONDITIONAL USE PERMIT PCC-86-25 REQUEST TO MODIFY AN EXISTING CONDITIONAL USE PERMIT, C-66-7, BY THE CONSTRUCTION OF CHURCH OFFICES/CLASSROOM SPACE AT 345 FIFTH AVENUE - GRACE BAPTIST TEMPLE Principal Planner Lee explained the item involved a request by Grace Baptist Temple to modify their existing conditional use permit by the construction of a two-story 4,000 square foot office/classroom structure attached to and Planning Commission -2- March 12, 1986 directly west of the sanctuary - the present location of the temporary office structure. The offices would be provided at the ground floor level with classroom facilities for adults on the second floor. The parking area would be resurfaced and restriped to accommodate 79 parking spaces plus additional landscaping. Mr. Lee noted that the church was originally approved in 1962, expanded in 1966 (classrooms) and in 1971 {nursery). The primary issue to be resolved is the potential for an adverse noise impact on adjacent properties because of the proposed location of the structure within 8 feet of the southerly and lO feet of the westerly property line. Since the modification is limited to office use and occasional adult classes and the closest residential structure is 22 feet to the west it was staff's conclusion that there will be no adverse impact. For that reason, staff recommends approval subject to the three conditions listed in the staff report. This being the time and the place as advertised, the public hearing was opened. Mr. Gorman, 366 Hedgeway, CV, stated he had been a resident since 1941 as were most of the single-family homeowners nearby. He expressed concern over past non-cooperation regarding noise, lack of hedge trimming on the part of the church; and a possible aggravation of parking problems; noted that the noise emanates mostly from the church, and the children who appear to be unsupervised. Reverend Doug Caul ey, ll30 Paseo Marguerita, CV, 92010, testified that he had been pastor of the church for 18 months and understands that in 1979 there were some problems. He stated that they do not have a school and have no intention of building one and are endeavoring to consolidate their office space into one area plus classrooms for young adults upstairs and Senior Citizens below. He further indicated that they are not requesting any increase in the sanctuary seating. However, the parking lot would be expanded to 79 spaces. He maintained the children were well supervised and had no knowledge of any request to have church-owned hedges trimmed and expressed cooperative intent. Gail Rosell, 334 Brightwood, Chula Vista, expressed concern over the height of the proposed structure which would impinge on his privacy. It was pointed out to Mr. Rosell that no windows are shown on the east elevation which would be the closest to his property and that those on the north elevation are closer to the west end of the project. Jim Johnston, 344 Emerson, Chula Vista, testified that he had been a head trustee since the late '7Os; had never received a complaint from neighbors that they did not honor; and that as a result of a complaint about the noise of singing, windows had been installed. Mr. Gomnan returned to the podium to say he was not trying to cause trouble; the attitude of the new pastor might be different; however, the City had forced the church to add the windows; and now there were huge noisy air vents that might encroach on the 5-foot limitation. Planning Commission -3- March 12, 1986 No one else wishing to speak, the public hearing was closed. MSUC (Tugenberg/Carson) (6-0) to find this project will have no significant environmental impacts and adopt the Negative Declaration issued on IS-86-33. MSUC (Tugenberg/Shipe) (6-0) that based on findings contained in Section "E" of the staff report, to approve the request, PCC-86-25, to construct a two-story 4,000 square foot structure containing church offices and adult classrooms at 345 Fifth Avenue subject to the conditions contained in the staff report and if these conditions were not complied with the item would return to the Commission for possible revocation. At 7:25 the Commission recessed and reconvened at 7:30 p.m. 2. PUBLIC HEARING: PCA-86-3 CONSIDERATION OF AMENDMENTS TO THE "GUEST HOUSE" PROVISIONS OF THE ZONING ORDINANCE Principal Planner Lee noted that on July 23, 1985, the Council adopted an emergency ordinance (2124) prohibiting the construction of guest houses until a study was conducted and reported back to Council. On January 21, 1986, the Council accepted the report and referred the matter to the Planning Commission for consideration of several amendments to the zoning ordinance. These amendments would prohibit guest house construction in R-1 and R-2 zones and would require the issuance of a CUP for the R-3 zone; plus limiting the occupancy of the guest house for any one guest to no more than 60 days per year. Mr. Lee said that presently guesthouses are detached living quarters which can easily be used as separate dwelling units either with or without cooking facilities. It is hoped the stipulation that guest quarters must be attached to the main dwelling and utilize the same entrance will provide a solution although the enforceability of a specified time limit for occupancy will remain difficult. In response to Commissioner Cannon's question as to the number of problems on record and the reason for the emergency ordinance; he was informed that a particular case had been brought to the Council's attention; they wanted to stop other instances and that no other problems had been raised in this regard. This being the time and the place as advertised, the public hearing was opened. No one wishing to speak, the public hearing was closed. Commissioner Tugenberg spoke in support of the ordinance. Commissioner Cannon contended that if there had been only one problem in 75 years, such an ordinance change was unnecessary. Commissioner Green agreed with Mr. Cannon. MS (Shipe/Tugenberg) to recommend City Council enact an ordinance amending Title 19 of the Municipal Code as shown in Exhibit A. Planning Commission -4- March 12, 1986 The motion failed by the following vote: AYES: Commissioners Shipe, Tugenberg, Carson NOES: Commissioners Cannon, Green, Guiles ABSENT: Commissioner Grasser DIRECTOR'S REPORT: As there is only one item for the meeting of 3/26/86, it is suggested that the meeting be canceled and the item held over to April 9th. The Commission concurred. - The Study Session scheduled for 3/19/86 will provide a slide show depicting the Second Harbor Entrance COMMISSION COMMENTS: The Commissioners expressed disappointment with the appearance of the City business cards issued to Commission members noting that the absence of individually printed names created a very poor impression of Chula Vista, the Commission, and would be embarrassing to use. MSUC (Shipe/Tugenberg) to submit to the City Council that individual cards with individual names thereon would be more suitable and more reflective of the quality and prestige of the City and the Commission.
