RESOLUTION NO. 9827
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA AMENDING POLICIES SECTION OF PARKS AND RECREATION
ELEMENT OF THE GENERAL PLAN
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, it is now desired to amend the Parks and Recre-
ation Element of the General Plan to conform with the previously
adopted Council policy pertaining to the acquisition and develop-
ment of municipal park sites with in lieu fees collected under
Section 17.10 of the Chula Vista Municipal Code, which reads as
follows:
"Because citywide and regional parks benefit all
areas of the city, funds collected under Section
17.10 of the Municipal Code need not be used solely
for the purchase of neighborhood and community
parks, but may be used for the acquisition and
development of citywide or regional parks for the
benefit of residents of the subdivision from which
they are collected."
NOIv, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby amend the General Plan of the
City of Chula Vista in accordance with the terms and conditions
of Resolution No. GPA-80-3 of the Chula Vista Planning Commission
and does hereby amend Section II C.ll of the Parks and Recreation
Element of the General Plan to read as follows:
SECTION II - PARK AND RECREATION POLICY
C. Policies
11. a. Lands dedicated and/or fees collected pursuant to
Section 17.10 (Park land dedication) of the Chula
Vista Municipal Code will be used to reduce the
amount of general fund monies necessary to provide
parks in developing areas.
b. As a general rule, the in-lieu park acquisition
artd development fees collected under the provisions
of Section 17.10 of the Chula Vista Municipal Code
will be devoted to the acquisition, development,
or expansion of park sites which are within the
Community Park Districts where the subdivider's
project is sited.
c. The City of Chula Vista, notwithstanding the general
rule expressed in the above paragraph, may utilize
in-lieu fees for the acquisition and development of
citywide or urban parks which serve the park and
recreation needs of the general public as well as
those of the residents of the involved subdivision.
d. This policy does not authorize the use of in-lieu
fees for the acquisition and development of neighbor-
hood parks outside the Park Administration District
within which the new subdivision is located, except

where it can be shown that, by virtue of access
and distance, an external neighborhood park would
better serve the residents of the subdivision than
a neighborhood park located within the Park Admini-
stration District for the said subdivision.
e. For the purposes of this element, a citywide or
urban park is defined as a mUlti-community park
which serves the major park and recreational needs
of the residents of one or more Park Administration
Districts. In smaller cities, the subject type
of park is traditionally called a "city" or "central"
park, From the standpoint of recreational operations,
a citywide or urban park is a "mini-regional park",
and requires a site of approximately 50 acres.
BE IT FURTHER RESOLVED that the City Council does hereby
certify the Negative Declaration adopted by the Planning Commission
based upon IS-79-40.

RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE
CITY COUNCIL AN AMENDMENT TO THE PARKS AND RECREATION ELEMENT OF
THE GENERAL PLAN RELATING TO POLICIES GOVERNING THE USE OF IN-LIEU
PARK ACQUISITION AND DEVELOPMENT FEES
WHEREAS, the City of Chula Vista adopted a Parks and Recreation Element
to the General Plan on March 12, 1974 by Resolution 7223, and
WHEREAS, said element provides that funds collected in 1 i eu of park land
dedication shall be used to provide parks within the neighborhood park district
where developr.lent occurred., and
WHEREAS, a pol icy was subsequentl y adopted that "funds collected under
Section 17.10 of the Municipal Code need not be used solely for the purchase of
neighborhood and community parks, but may be used for the acquisition and develop-
ment of citywide or regional parks for the benefit of residents of the subdivision

WHEREAS, the City Planning Commission set the time and place for a public
hearing to consider an amendment to the Parks and Recreation Element to incor-
porate therein the policy for the use of in-lieu funds, and
WHEREAS, a hearing was held at said ti~e and place, namely 7:00 p.m.,
October 17, 1979 in the Council Chambers before the Planning Commission and said
hearing was thereafter closed, and
WHEREAS, the Commission found that in accordance with the Negative Declar-
ation on IS-79-40 the proposed amendment to the Parks and Recreation Element will
have no significant environmental impact, and adopted the tJegative Declaration.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends that
the City Council amend Section II C 11 of the Parks and Recreation Element of the
General Plan to read as follows:

City Council adopt the attached "Plan Diagram of Park Administration and Community
Park Districts" as an addendum to the Parks and Recreation General Plan Element.

DATE: February 7, 1979
A. Background
The City Counci~, meeting in regular session on February 3, 1976,
adopted the following statement of comprehensive policy pertaining
to the acquisition and development of municipal park sites with in
lieu fees collected under Section 17.10 of the Chula Vista Municipal
Code:
"Because City-wide and regional parks benefit all areas of the
City, funds collected under Section 17.10 of the Municipal
Code need not be used solely for the purchase of neighborhood
and community parks, but may be used for the acquisition and
development of City-wide or regional parks for the benefit
of residents of the subdivision from which they are collected."
The said statement of policy by Council order, becomes operational
when its provisions are included within the text of the Parks and
Recreation Element of the General Plan.
The proposed amendment to the Parks and Recreational Element would
incorporate the policy adopted on February 3, 1976, and thereby
make the said policy operational. The amendment would also create
a planning-administrative mechanism--the Park Administration District--
which would facilitate the execution of the Council's policy for the
expenditure of Seciton 17.10 funds.
B. Project Description
The following amendments are p::-cposed:

Municipal Code will be used to reduce the amount of public
expenditure necessary to provide parks in developing areas.

b. As a general rule, the in lieu park acquisition and
development fees collected under the provisions of Section 17.10
of the Chula Vista Municipal Code will be aevoted to the
acquisition, development, or expansion of park sites which are
within the park service districts where the subdivider's
project is sited.

c. The City of Chula Vista, notwithstanding the general
rule expressed in the above paragraph, may utilize in lieu
fees for the acquisition and development of district-wide or
urban parks which serve the park and recreation needs of the
general public as well as those of the residents of the
involved subdivision.
d. This policy does not authorize the expenditure of in
lieu fees for par~ and recreational facilities which are
located outside of the involved subdivision's Park Administration
District, as demarcated on this element's "Plan Diagram of
Park Administration Districts."
e. This policy does not, furthermore, authoiize the use
of in lieu fees for the acquisition and development of
neighborhood parks outside of the service district within
which the new subdivision is located, except where it can be
shown that, by virtue of access and distance, an external
neighborhood park would better serve the residents of the
subdivision than the neighborhood park located within the
designated park service district for the said subdivision.
f. For the purposes of this element, a district-wide or
urban park is defined as a multi-community park which serves
the major park and recreational needs of the residents of an
entire Park Administration District. In smaller cities, the
subject type of park is traditionally called a "city" or
"central" park. From the standpoint of recreational operations,
a district-wide or urban park is a "mini-regional park," and
requires a site of approximately 50 acres or more.
C. Compatibility with zoning and plans
The proposed amendments are consistent with the intent of the
General Plan and associated elements.
D. Findings of insic~ificant impact
1. The project is not site specific and will not involve
any vegetation or wildlife.
2. Proposed amendments are consistent with the intent of the
General Plan and associated elements and are not anticipated
to achieve short term to the disadvantage of long term environ-
mental goals.
3. No impacts are anticipated to occur, due to project
implementation, which could interact to create a cumulative
adverse effect on the environment.
4. The project will not cause an increase in vehicle traffic
nor will an increase in related emissions or noise resuJt.
