PLEDGE OF ALLEGIANCE - SILENT PRAYER
The pledge of allegiance to the flag was led by Chairman Cannon and was
followed by a moment of silent prayer.
INTRODUCTORY REMARKS
Chairman Cannon reviewed the composition of the Planning Commission, its responsi-
bilities and the format of the meeting.
APPROVAL OF MINUTES
MSC (Cannon/Grasser) (Shipe abstained) to approve the minutes of the meeting
of July 9, 1986, as mailed.

1. PUBLIC HEARING: CONSIDERATION OF THE REVOCATION OF CONDITIONAL USE PERMIT
PCC-84-23 AUTHORIZING THE ESTABLISHMENT OF THE CABRILLO
SCHOOL OF NURSING - 713 BROADWAY
Principal Planner Lee reported that the conditional use permit for the Cabrillo
School of Nursing was granted by the Zoning Administrator two years ago,
conditioned upon a limit of 30 students at one time with a notation that the
majority of the students would be using public transportation.
Earlier this year it was observed that the school had between 50 and 60 students,
the parking lot appeared full, with excess parking occurring on Broadway and 'J'
Street. Letters sent to the applicant concerning the violation received no
response and this hearing was scheduled to consider revoking the use permit.
Last week the applicant met with the Planning Department and indicated that many
of the issues were resolved. They advised that they would file for a modification
to the use permit, but it has not yet been received. It is recommended that the

public hearing be opened to receive input from adjacent residents or others
concerned, and continue the hearing to August 27 to give the applicant additional
time to proceed with a revised application.
This being the time and place as advertised, the public hearing was opened.
Henry Salas, 5532 E1 Cajon Boulevard, San Diego, advised that he is in the
process of preparing a new application, and that they have had no problems with
parking for the students.
George Merziotis, 9346 Crest Drive, Casa de Oro, owner of the shopping center
in which the nursing school is located, advised that there have been no complaints
concerning parking from other tenants or adjacent residents.
The public hearing was closed.
MSC (Tugenberg/Grasser) (5-0) to continue consideration of the conditional use
permit for Cabrillo School of Nursing to the meeting of August 27, 1986.
2. PUBLIC HEARING: PCA-87-1: CONSIDERATION OF AN AMENDMENT TO TITLE 19 OF THE MUNICIPAL CODE TO REQUIRE ALL LIVING QUARTERS IN THE
R-1 ZONE TO BE ATTACHED
Principal Planner Lee advised that in April the City Council adopted code changes
to prohibit guest houses in the R-1 and R-2 zones. The City Attorney ruled that
the revision would relate to detached quarters for guests but not to quarters
to be occupied by owners of the property. The staff was directed to draft an
ordinance to prohibit the construction of any detached quarters in the R-1 and
R-2 zones.
The ordinance as proposed states: "All portions of the dwelling, factory-built
home or mobile home used for living or sleeping purposes shall be attached."
On the advice of the City Attorney's office, it is recommended that the wording
"by party walls without openings," be added at the end of the proposed statement,
to clarify the intent of the ordinance.
In response to a question from Commissioner Grasser, Mr. Lee affirmed that the
concern over detached living quarters relates to the smaller lots in the R-1 and
R-2 zones, and the use is still permitted in the R-E zone which is applied to
residential lots one-half acre or larger in size.
Commissioner Grasser suggested that this ordinance should exclude lots zoned
R-1 which are one-half acre in size.
Director of Planning Krempl agreed that is a possibility. He stated that the
Council's concern appeared to be over the use of second living quarters for any
purpose in the R-1 zone and that no discussion relating to lot size had occurred
by the Council.
This being the time and place as advertised, the public hearing was opened. No
one wished to speak and the public hearing was closed.

In discussion Commission members expressed their belief that the problems
arising from detached living quarters are too minute to warrant any change in
the zoning ordinance.
MSC (Cannon/Green) (5-0) to recommend to the City Council that the proposed
ordinance not be enacted.

COMMISSION COMMENTS
Commissioner Tugenberg announced that he will not be present at the meeting
of August 13.
Commission Green stated that due to vacation plans he will be absent on August
13 and August 20.
