RESOLUTION OF THE CITY COUNCIL OF ~E CTTY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND BONITA-SUNNYSIDE FIRE PROTECTION DISTRICT FOR JOINT FIRE PROTECTION SERVICES AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agr~ement between THE CITY OF CHULA VISTA, a municipal corporation, and BONITA-SUNNYSIDE FIRE PROTECTION DISTRICT, for joint fire protection services dated the 23rd day of October , 19 79 , a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. DATED , City Cl~rk of the City that the above is a full, , and that the same has City Clerk revised 10/24/79 JOINT FIRE PROTECTION AGREEHENT BETI'7EEN THE CITY OF CHULA VISTA AND THE BONITA-SUNNYSIDE FIRE PROTECTION DISTRICT THIS AGREEMENT, made and entered into this 23rd day of October , 1979, by and between THE CITY OF CHULA VISTA, a municipal corporation, hereinafter referred to as "City", and THE BONITA-SUNNYSIDE FIRE PROTECTION DISTRICT, a fire protection dis- trict organized in accordance with the Fire Protection District Act of 1969, hereinafter referred to as "District"; WIT N E SSE T H : ------ - -- WHEREAS, City and District are empowered by law and are presently providing fire protection services, including fire sup- pression measures, fire prevention measures and emergency medical services, and WHEREAS, in accordance with the Joint Powers Agreements entered into from and after 1963, District has provided such ser- vices in those areas which have been annexed to the City and were previously a part of the territory of the District and in which the City did not then, and does not presently, have adequate equipment or facilities to conveniently provide such services thereto, and WHEREAS, the continued annexation of territory by the City of Chula Vista within the areas served by the Bonita-Sunnyside Fire Protection District and any subsequent removal of said terri- tories from said district area would detrimentally affect both the financial and physical capability of the Bonita-Sunnyside Fire Protection District to furnish fire protection to those territories located in the unincorporated areas of the District, and vlHEREAS, the City of Chula Vista and the Boni ta--Sunnyside Fire Protection District now wish to enter into a new arrangement for the joint and cooperative provision of such services which will not affect the financial operation of the' District; preserve the physical integrity of the District and a continuity of fire pro- tection services throughout those areas which have been annexed to the City and withdrawn from the District; and allow for complete access and response capability to all parts of the District service area; continue to insure recognition and protection of the rights and status of the District personnel; and establish termination provisions consistent with the mutual needs and requirements of District and City based upon increasing urbanization of the Dis- trict area and changing concepts of fire protection in order to insure the highest level of fire protection service for the entire Bonita-Sunnyside area. NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. Purpose. This agreement is made pursuant to the provisions of Article 1, Chapter 5, Division 7, Title 1 of the Government Code of the State of California commencing with Section 6500. City and District each possess the powers referred to in the above ~ecitals. The purpose of this agreement is to provide an augmen- tation and supplementation of the fire protection capabilities ~ q~~ -1- - revised 10/24/79 of District so as to enable District to furnish fire protection to all areas encompassed by the original description of the boundaries of the Bonita-Sunnyside Fire Protection District including any portion or portions of areas of District which are presently annexed to the City of Chula Vista or may hereafter be annexed to the City of Chula Vista and whether or not said annexed terri- tory has been or may be withdrawn from the District territory. 2. Term. This agreement shall become effective as of November 1, 1979 and shall continue in full force and effect for a period of thirty-two (32) months from said date unless appropriately amended by mutual agreement of the parties or terminated as provided herein. 3. Termination. This agreement may be terminated by either par~y upon 12 months written notice delivered to the governing board of said parties, with said notice given so that the termination date shall be effective on July 1st of a calendar year. 4. Establishment of Cooperative Station. A. City and District shall henceforth jointly operate a "cooperative station" to be located at District's Fire Station #1. It is understood and agreed that the first-in response unit to any contract or automatic response area within the City of Chula Vista shall be the Chula Vista Fire Department unit main- tained at said cooperative station manned by personnel composed of both a Chula Vista Firefighter employee and a Bonita-Sunnyside District Firefighter employee; provided, however, that said unit and manpower shall be available to both the City and District. B. The City of Chula Vista shall assign on a permanent basis to the cooperative station located at District's Station #1 the following equipment and manpower: (1) One fully equipped mini-pumper (2) One firefighter per shift (qualified driver) C. District shall provide housing for the apparatus and the Chula Vista Firefighter plus one Firefighter of District to be assigned to man the apparatus. Fuel for the apparatus shall be furnished by District and City shall assume full maintenance therefor. Any and all Chula Vista personnel assigned to said cooperative station shall be subject to the rules and regulations of the Chula Vista Fire Department, the Chula Vista Civil Service rules and regulations and any Memorandum of Understanding entered into between City and the International Association of Firefighters. 5. Direction and Supervision of Fire Protection Service. District officers shall be in command of the apparatus and personnel described in Section 4 except when the fire incident is in an area of the City of Chula Vista and other Chula Vista Firefighting units are on the scene, at which time the Chula Vista Battalion Chief/Shift Commander shall be in command. -2- ~ q~~ revised 10/24/79 6. Dispatch Service. The City of Chula Vista agrees to provide dispatch ser- vice for the Bonita-Sunnyside Fire Protection District through the combined dispatch center located in the Chula Vista Police Depart- ment. Said service shall be instituted no later than February 1, 1980. It is understood and agreed that the Bonita-Sunnyside Fire Protection District will pay for all telephone expenses incurred in modifying the system in order to provide such dispatch service for the District. The Chula Vista Firefighting apparatus as pro- vided in section 4 hereof shall retain its assigned County mutual aid numbers for dispatching and radio call purposes. It is further understood and agreed that if during the term of this agreement a combined dispatch service is established for South Bay Zone 5 de- partments, the Bonita-Sunnyside Fire Protection District's share of the cost thereof shall be fully accepted and absorbed by the City of Chula Vista. IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed the day and year first hereinabove set forth. Contracting out for services is a negotiable item subject to the meet and confer process. 2. The non contract area that was once protected by a 21 minimum manning level has already been reduced to a dangerously low of the current 17 man minimum. Cooperative manning would further reduce it to 16 men. 3. Cooperative manning would put both "Jaws of Life" north of "F" Street resulting in delayed response to the southern part of the city. 4. Overtime cost to the city would increase. The fourth man at Station 3 would be sent to Bonita. This man is now used to cover for vacation and sick leave at other stations. From 10-23-78 to 10-23-19, the fourth man at Station 3 was used 281 times to maintain the 11 man minimum level. Since this man is no longer available, it would result in additional overtime totaling $69,000. What has the non contract area of Chula Vista lost? 1. Jaws of Life 2. 3 Firefighters 3. Increased overtime 4. Cost of dispatching Total What does Bonita want? 1. Central Dispatching. Chula Vista is currently putting a $15,000 price tag on this service. We feel the cost is negligible. Central dispatching would provide Bonita with 3 additional firefighters now used as dispatchers and would provide the manning level desired at station one in the contract area. 2. $3,000 per month to protect Chula Vista property with an assesed valuation in excess ot $8,500,000. $75,000 $69,000 $15,000 $159,000 q'6 ') '& .. We feel this is an excellent proposal and a benefit to both Bonita and Chula Vista. 1. Chula Vista will continue to be protected by the 17 man minimum in the non contract area. 2. Bonita will gain 3 firefighters and provide the protection level desired in the contract area. 3. Bonita will be using money as a reserve instead of firefighter jobs. 4. The overall protection level is increased. 5. A reduced cost to the taxpayers of $51,00 instead of $159,000. We urge the Council to consider the total revenue generated in the contract area and accept the Bonita proposal for the tremendous bargain it truly represents. Respectfully submitted, ;I .
