RESOLUTION NO. 9806
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THE TENTATIVE SUBDIVISION MAP FOR
CHULA VISTA TRACT 80-3, LEA CONDOMINIUMS
follows:
The City Council of the City of Chula Vista finds as
That in accordance with the attached Negative Declara-
tion, IS-79-37 , and the findings therein, the proposed tentative
map will not have a significant impact upon the environment, and
the City Council hereby certifies that the Negative Declaration
was prepared in accordance with the California Environmental Quality
Act of 1970, as amended.
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula
Vista has heretofore approved that certain tentative map of a
subdivision to be known as C~ula Vista Tract 80-3, Lea Condominiums
and has recommended that the City Council approve said tentative
map subject to the conditions contained in Planning Commission
Resolution No. PCS-80-3 , adopted on the 26th day of September
1979, a copy of which is attached hereto and by this reference made
a part hereof the same as though fully set forth herein.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Chula Vista does hereby approve said tentative sub-
division map in accordance with Planning Commission Resolution No.
PCS-80-3

A. Project Setti~g
The project site involves about 15,400 sq. ft. of property located at 183-185
Brightwood Avenue. The site is currently developed with one single family
dwelling, a studio apartment and a three unit multiple family building.
Adjacent uses consist of mixed residential uses and church parking lot.
There is a general lack of natural resources on the site. Vegetation present
involves decorative landscaping. There is no significant geologic hazard known
to exist in the vicinity, although expansive soi.1s may be present.
B. Project Description
The applicant proposes to remove an existing garage and studio apartment and to
construct six additional units. Three of the new dwellings will be above the
existing apartments and three units will be constructed over vehicle parking.
Associated landscaping and parking will also be provided.
C. Compatibility with Zoning and Plans
The proposed project will result in a net density of 28.3 units per acre which
is consistent with the current R-3 zoning and high density residential land use
designation of the General Plan.
D. Identification of Environmental Impacts
Soils
City Engineering Department has indicated that a soils report, prepared for a
neighboring project in June of 1977, determined that expansive soils are present
in the general area. To ensure stable construction, a soil.s report will be re-
quired and any adverse soil conditions encountered should be addressed.
Schools

E. Mitigation Necessary to Avoid Significant Effect
1. Require a soils report and subsequent recommendations.
2. Written assurance of adequate educational facilities from the appropriate
school districts will be required.
F. Findings of Insignificant Impact
1. The site is void of any significant natural or man-made resources.
Expansive soils may be present. however. proposed mitigation will ensure
stableconstruction.
2. The residential proposal is consistent with the General Plan and associ-
ated elements and is not anticipated to achieve short-term to the disadvantages
of long-term environmental goals.
3. No impacts are anticipated to occur which could interact to create a
substantial cumulative effect on the environment.
4. The project will result in limited additional vehicle traffic and no
significant increase in related emissions or noise will occur.

RESOLUTION OF THE CITY PLANNING Cm~MISSImJ RECOMr-1ENDING TO THE
CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION ~1AP FOR
CHULA VISTA TRACT 80-3, LEA CONDOMINIUMS
WHEREAS, a tentative subdivision map for Chu1a Vista Tract 80-3, Lea
Condominiums, was filed by George and Cindy Parsons on August 3, 1979 for the
construction of an 8 unit townhouse condominium at 183 Brightwood in the R-3
zone, and
WHEREAS, Section 66473.5 of the State Map Act pr~vides that approval of a
subdivision map shall be based upon findings of consistency between the subdivision
map and the adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place for a public hearing
to consider said tentative map, and notice of said hearing, with its purpose, was
given by the publication in a newspaper of general circulation in the city at
least 10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
September 26, 1979 in the City Council Chambers before the Planning Commission
and said hearing was thereafter closed, and
WHEREAS~ the Planning Commission found that this project will have no signif-
icant environmental impact and adopted the Negative Declaration on IS-79-37.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Planning Commission concerning the develop-
ment and site at 183 Brightwood, the Commission finds as follows:
a. The site is physically suitable for residential development since the
site plan conforms to all standards established by the City for
residential development and the site contains adequate access to
public streets.
b. The design of the subdivision will not affect the existing improve-
ments: streets, sewers, etc., which have been designed to avoid any
serious health problems.
c. The subdivision is consistent with the General Plan as demonstrated
by the following commentary:
1) Land Use Element - The General Plan designates this site for
High Density Residential development (13-26 dwelling units per
gross acre). The proposed project density of 22 dwelling units

per acre is consistent with this designation.
2) Circulation Element - The adjoining street is developed at its
full width.
3) Housing Element - Inasmuch as the subdivision contains fewer than
50 units, it is exempt from the requirement to address the need
to provide 10% of the units for low and moderate inco~e families.
4) Conservation, Open Space, and Parks and Recreation Elements -
None of the areas proposed for conservation or open space on the
various plan diagrams of the General Plan are affected by the
subject proposal. The developer will be assessed fees in lieu
of park land dedication.
5) Noise Element - The lots will not be subject to objectionable
noise levels.
6) Seismic Safety and Safety Elements - The development is not
adjacent to any known fault systems.
7) Scenic Highways Element - The site does not abut a Scenic Highway
or gateway.
8) Bicycle Routes - No bicycle routes are proposed on or adjacent
to this site.
9) Public Buildings Element - Public buildings are neither proposed
nor required on the site.
2. The Planning Commission recommends to the City Council that the tentative
map for Chula Vista Tract 80-3, Lea Condominiums, be approved, subject to the
condition that the map be revised by placing a soils certificate on the map.
3. That this resolution be transmitted, along with the tentative map, to
the City Council, and a copy of this resolution be transmitted to the applicant.
