HomeMy WebLinkAboutReso 1979-9788 J Fonll No. 342 Rev. 2/76 RESOLUTION NO. 9788 RESOLUTION OF THE CITY COUNCIL OF'-'fim- CITY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE CITY OF NATIONAL CITY FOR THE USE OF CHULA VISTA'S POUND FACILITIES AND SERVICES AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agr~ement between THE CITY OF CHULA VISTA, a municipal corporation, and' THE CITY OF NATIONAL CITY, for the use of Chula Vista's pound facilities and services dated the 2nd day of October , 19 79 , a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. DATED City Clerk AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE CITY OF NATIONAL CITY PROVIDING FOR THE USE OF CHULA VISTA'S POUND FACILITIES AND SERVICES THIS AGREEMENT, made and entered into this 2nd day of October , 1979, by and between THE CITY OF CHULA VISTA, a municipal corporation, hereinafter called "Chula Vista", and THE CITY OF NATIONAL CITY, hereinafter called "National City"; WIT N E SSE T H : ------ WHEREAS, the City of National City desires to use the pound facilities of the City of Chula Vista as a shelter for the impounding and disposing of dogs and small animals, and WHEREAS, the City of Chula Vista has pound facilities adequate to serve the needs of the City of National City in addition to the present use by the City of Chula Vista, and WHEREAS, the City of National City desires to extend the existing agreement with the City of Chula Vista for the use of the pound facilities of the City of Chula Vista as a shelter for the impounding and disposing of dogs and small animals, and WHEREAS, the City of Chula Vista is willing to extend said agreement amended in the manner set forth herein. NOW, THEREFORE, IT IS AGREED by and between Chula Vista and National City that the terms of this agreement shall be as follows: 1. Chula Vista agrees to permit the City of National City to utilize pound facilities owned and operated by the City of Chula Vista as shelters for the impounding and disposal of dogs and small animals subject to the provisions of Ordinance No. 828 of the City of National City, which dogs and small animals may be collected within the following described area of National City, to-wit: All that portion of the incorporated territory of the City of National City. 2. Chula Vista agrees to perform all normal pound services, including among other things, the following: a. Confinement, feeding, destruction and disposal (other than by sale) of dogs and small animals. b. Reservation of not more than fifteen (15) kennels and three (3) quarantine cages, for the use of the City of National City. c. Use of the Nitrogen Gas Cabinet and/or of the temporary storage facility for the disposal of animals. d. Reasonable use of the Animal Shelter office and facilities. 3. Chula Vista agrees to provide pound facilities and services at the Animal Shelter located at 690 Otay Valley Road, during the hours of 8:00 a.m. to 4:00 p.m. seven (7) days a week, excluding holidays, for the purpose of receiving animals from officials of the City of National City and for the redemption by owners, provided that owners pay charges incurred for the care of animals. All incidental fees shall accrue to the City of Chula Vista. R-9788 -1- 0.... ^' ~ t\ 4. Chula Vista agrees to accept dogs or small animals from bona fide residents of National City without charge to such persons. The hours for acceptance of such animals shall be as follows: - a. Dogs: Between the hours of 8:00 a.m. and 4:00 p.m. on the days set forth in Section 3. b. Cats: Between the hours of 8:00 a.m. and 2:00 p.m. on the days set forth in Section 3. 5. National City shall deliver all dogs and small animals to the Chula Vista Pound, and the Chula Vista Pound personnel shall accept said dogs and small animals and perform all pound services normally provided as set forth hereinabove pursuant to Ordinance No. 828 of the City of National City. 6. Commencing July 1, 1979, and extending through June 30, 1980, National City agrees to pay the City of Chula Vista the sum of ONE THOUSAND ONE HUNDRED EIGHTY DOLLARS ($1,180) per month for the aforementioned services and facilities. The above sums shall be due and payable on or before the first day of each month in the applicable period, and payable in advance. 7. Chula Vista shall not be responsible to any resident of National City, or to the City of National City, because of the destruction of any animal delivered to and accepted by the pound facilities pursuant to this agreement, and the City of National City agrees to hold harmless the City of Chula Vista from any claims arising from damage or injury to animals belonging to residents of the City of National City and de- livered to the Chula Vista pound facilities. 8. It is understood and agreed that the City of Chula Vista will hold all dogs delivered in accordance with the provisions herein for a period of three (3) days. At his discretion, the National City Poundmaster may request that dogs be kept for a total of five (5) days. When such a request is made, an additional charge of $1.65 per day will be levied for such dogs. IT IS FURTHER AGREED that this amended agreement shall take effect and be in full force on the first day of July, 1979 and shall terminate on the 30th day of June, 1980; provided, however, that either party may terminate this agreement at any time by giving to the other party written notice of intention to terminate ninety (90) days following said notice. IN WITNESS WHEREOF, this agreement is executed by the City of Chula Vista acting by and through its Mayor pursuant to Resolution No. , and by the City of National City acting by and through its Mayor, the day and year first hereinabove written. This fee is based on the fact that National City is responsible for approximately 38% of the Animal Shelter workload. The costs to operate the Animal Shelter are as follows: 1.
