CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA
August 28, 1974
The regular meeting of the City Planning Commission of Chula Vista, California
was held on the above date beginning at 7:00 p.m. with the following members
present: Chandler, Rudolph, Wilson, Floto, Starr and Pressutti. Absent, with
previous notification, Commissioner Rice. Also present: Director of Planning
Peterson, Assistant Director of Public Works Robens, Assistant City Attorney
Beam and Secretary Mapes
The pledge of allegiance to the flag was led by Chairman Chandler followed by a
moment of silent prayer.
APPROVAL OF MINUTES
MSUC (Rudolph-Wilson) The minutes of the meetings of July 24, 1974 and August 14,
1974 be approved as mailed.
There were no oral communications.
CONSENT CALENDAR
1. Consideration of adoption of EIR-74-8 on Princess Park Estates
The final EIR was prepared in accordance with Commission direction following the
public hearing held on August 14, 1974.
MSUC (Wilson-Rudolph) The item on the consent calendar be approved.
REGULAR CALENDAR
2. PUBLIC HEARING (Cont.): Consideration of Safety Element of General Plan
Chairman Chandler noted the need to continue this hearing pending presentation
of the Safety Element to the City Council. Director of Planning Peterson recommended
September 25th as the most suitable meeting for the continued hearing.
MSUC (Wilson-Rudolph) The public hearing to consider the Safety Element of the
General Plan be continued to the meeting of September 25, 1974.
3. Consideration of request for vacation of Third Avenue from C Street to
Seavale, South Bay Pioneers
Assistant City Attorney Beam advised that following a review of this request it
is his determination that this vacation cannot be handled as a summary proceeding,
but must be done as a regular vacation. He recommended that it be referred back
to the staff to be set for public hearing.
MSUC (Starr-Floto) The request for street vacation be referred to the staff to
set for regular proceeding.

4. Consideration of amendment to Zoning Ordinance to permit communes in R-1 zone
Director of Planning Peterson reported that the First Baptist Church of Chula
Vista has sponsored several such communes in the community and since both their
pastor and chief administrative officer are out of town at the present time,
they have asked that the consideration be deferred in order that they may make
a presentation concerning these facilities. Mr. Peterson suggested that the
matter be continued to September 25th.
MSUC (Wilson-Rudolph) Consideration of permitting communes in the R-1 zone be
continued to the meeting of September 25, 1974.
5. PUBLIC HEARING: Consideration of amendment to the Zoning Ordinance to
permit R-3 Residential Use in the C-N and C-C zones b~
conditional use permit
Director of Planning Peterson advised that this hearing was initiated at the
direction of the City Council. He noted that at the present time the Zoning
Ordinance provides for R-3 uses in the C-B and C-O zones by conditional use
permit. This provision has never been utilized, although various types of
residential units presently exist in many of the commercial districts as non-
conforming uses which existed prior to adoption of the zone.
Mr. Peterson reported that staff review led to the conclusion that residential
use would be suitable in the C-C and C-N zones, although not appropriate for
all properties in those zones. With the requirement of a conditional use permit
each case can be considered to determine the suitability of a combination of
uses. He indicated that one reason for supporting this proposal is that the
community is overzoned for commercial use, particularly in the C-C zone. He
felt that some locations lend themselves quite well to multiple family purposes,
or a combination of multiple family and commercial use. He cited, as example,
the 12-acre property at the southwest corner of Bonita Road and Otay Lakes Road,
18-acre property on the north side of Telegraph Canyon Road between Crest and
Halecrest Drives, and the Ranch Mart site at Third Avenue and H Street.
Mr. Peterson pointed out the staff recommendation to allow residential use at
the R-3-G density (17 units per acre) in the C-N zone and at the R-3 density
(32 units per acre) in the C-C zone. He felt that under the conditional use
permit procedure there is enough flexibility that the density could be increased
or decreased if conditions warranted it.
In response to a question from Commissioner Wilson, Mr. Peterson advised that
this amendment would permit a mixture of uses in the same building, or in
separate buildings on the same site.
Commissioner Floto asked if the existing residential uses in the downtown area
are nonconforming.
Mr. Peterson advised they are presently nonconforming uses which could become
conforming by an application for conditional use permit.
This being the time and place as advertised, the public hearing was opened. As
no one wished to speak, the public hearing was closed.

Commissioner Rudolph expressed support for this amendment, noting that allowing
residential use in the C-N zone brings it a little closer to what she felt a C-N
zone should be as a service in a residential area. She suggested that it might
be looked at even further to permit C-N zoning on smaller parcels.
Commissioner Wilson pointed out that noise levels in the downtown areas are
considerably higher than in normal R-3 areas. He questioned if there might not
be a conflict in encouraging residential living in such areas.
Mr. Peterson acknowledged this is a possibility, but pointed out that new
construction standards to become effective in February or March will require
insulation to alleviate noise in areas where it may be a problem.
Assistant City Attorney Beam pointed out that since the proposed amendment would
require a conditional use permit for the residential use, the Commission would
have the opportunity to comment on the noise problems or any other conflicts
which might be apparent when an application is made.
Commissioner Pressutti questioned the rationale for allowing the R-3-G density
in the C-N zone and a much higher density in the C-C zone.
Mr. Peterson pointed out that since the C-N zone is usually in close proximity to
single family homes, it is felt the lower density would be more compatible.
Commissioner Starr pointed out there is a trend throughout other cities to allowing
this type of combined use.
Chairman Chandler indicated that with the requirement for a conditional use permit
he could support the amendment although he would not do so without that restriction.
Commissioner Wilson asked how parking needs would be met.
Mr. Peterson advised that each development site would have to provide offstreet
parking as normally required for residential use as well as for the business on
the site.
MSUC (Rudolph-Starr) Recommend to the City Council the adoption of an amendment
to the Zoning Ordinance, Section 33.508 C, adding a new paragraph: 5. R-3-G
residential uses, as regulated in the R-3-G zoning district, with a conditional
use permit.
MSUC (Starr-Wilson) Recommend to the City Council the adoption of an amendment
to the Zoning Ordinance, Section 33.509 C, adding a new paragraph: 12. R-3
residential uses, as regulated in the R-3 zoning district subject to a conditional
use permit.
DIRECTOR'S REPORT
Director of Planning Peterson reported that one of the items on the agenda for
September 11 will be consideration of Dr. Bloom's proposal for the development of
his 450 acre property east of 1-805, and also the staff's sketch plan for the
development of the remainder of the E1 Rancho del Rey property.
He also called attention to the workshop meeting scheduled for 7:30 p.m. on
September 12 for a briefing by the City'Attorney's office on the disclosure of
assets.

He reminded the Commission of the 76th Annual Conference of the League of
California Cities to be held in Los Angeles, October 20-23, 1974, noting that
one request for reservation has been submitted and if other Commissioners
desire to attend their reservations should be requested.
He also noted the announcement of the September dinner meeting of the League
of California Cities with Chula Vista as the host city. The meeting will be
on September 19th at the Glenn Restaurant. Reservations must be made not later
than September 16th.
COMMISSION COMMENTS
Commissioner Starr commented on the painting of house numbers on curbs and asked
if this is done by the City or approved by the City.
Assistant Director of Public Works Robens advised that it is the City's policy
to grant permission for this activity to nonprofit Chula Vista organizations.
There have been reports of San Diego organizations coming into the City and doing
this work without the necessary certificate to do so.
Chairman Chandler welcomed Mr. Alex Pressutti, newly appointed Commissioner, to
the Planning Commission.
