By Resolution No. 9475, Co ci a thorized the placement of a concrete
driveway within Open Space Lots 140 and 219 to serve two land-locked
parcels owned by Dennis McCann. Since that time, however, the proposed
access has been changed to include two driveways, two retaining walls
and landscaping. It is my

RECOMMENDATION: That City Council approve Encroachment Permit No. 80-22
to allow installation of the subject facilities within the City's open
spa c e .

DISCUSSION:
On January 23, 1979, the City Council authorized access to two parcels
owned by Dennis McCann by installation of a concrete driveway across
Open Space Lot 140 in Bonita Ridge Estates Unit No.3 and Open Space Lot
219 of Bonita Ridge Estates Unit No.4. The approved encroachment was
for an area approximately 24 feet wide and 45 feet long.
In the ensuing months of processing the parcel map several items were
addressed regarding the driveway including:
1. Elevation of the proposed dwellings so as not to block the
view of the existing homes on Greenwood Place; which in turn
affects the grades which must be maneuvered by the City's fire
equi pment.
2. Screening the retaining walls required for construction of the
driveways with landscaping in two 10 foot wide strips.
3. Splitting the common driveway to one serving each parcel
providing a common turnaround adjacent to the garages.
Consequently, the encroachment width has increased to about 76 feet.
The Director of Parks & Recreation has no objection to the increased
width of encroachment. I recommend approval of the encroachment permit
conditioned upon the execution of an agreement between Mr. McCann and
the City to include maintenance by the owners, their heirs and assigns
of the landsaping and concrete driveways. The permit will also include
the requirement that a separate permit shall be obtained from this
department by a property licensed contractor before any work can be done
in the City's right-of-way.

One condition included in Resolution No. 9475 required annexation of the
McCann property prior to validation of the encroachment permit.
Inasmuch as the annexation procedure has been delayed through no fault
of the property owner, I propose that this condition be modified to
provide that the encroachment permit shall be revoked in the event that the
owner wi thdraws his application for annexation to the City.

Dear Sirs:
Two and one-half years ago we made application to the City of Chula Vista
for annexation of the property listed above to the City of Chula Vista from
the County of San Diego. As Our property lies within the city boundaries,
we were assured as to favorable annexation by various officials at that
time.
To our best knowledge we have complied in every way possible with the re-
quirements to do this at considerable expense and time spent.
We have recently been informed that annexation is being held up on our
parcel because there is a disagreement between the City of Chula Vista and
the County of San Diego on the reapportionment of taxes, and that in fact,
this condition has existed for over one year as our application to LAFCO,
which is the final step pending annexation was received on September 19, 1979.
We now find ourselves in the precarious position of losing Our contractor,
our engineer on the project and our tentative loan committments due to this
inordinately long delay. If this should happen, we do not know whether we
shall be able to afford to build this home that we have dreamed about for
so long. In addition, we have a tentative buyer for one of these parcels
who also would like to build his home in the City of Chula Vista.
In view of the fact that annexation was almost complete until this disagreement
between two governing bodies, and that as professionals we would like to again
relocate our business in your city and our home, we ask that you favor us by
reconsidering your share necessary for the taxes and renegotiate with the
County.
We wish to thank you for your consideration in this matter and should you
wish to contact us regarding anything we personally may do to expedite Our
