Resolution /O~?d Vacating sewer easement across Lot 168 of Rancho Robinhood IJI SUBrUTTED BY: Ci ty Eng ineer 1)11'/ (4/5ths Vote: Yes_No~) As a result of an application for an encroachment permit on a sewer easement over property at 380 Surrey Drive it was found that a sewer easement had been established at an incorrect location when the Final Map for Rancho Robinhood 11-1 was recorded. The error is proposed to be corrected by acceptance of a new easement at the correct location and the summary vacation of the original, unused easement. It is my RECOMMENDATION: That Council: a. Accept the proffered sewer easement over the southwesterly 10.00 feet of Lot 169, Map No. 8604. b. Council summarily vacate 10 . 00 fee t 0 f Lo t l-6-9- 0 f /b?/ BOARD/COMMISSION RECOMMENDATION: a sewer easement over the westerly Map No. 8604. Not applicable. DISCUSSION: The Final Map for Rancho Robinhood III showed a sewer easement over the westerly 10.00 feet of Lot No. 168. The improvement plans showed the sewer itself to be constructed along the more westerly line of the adjacent lot, No. 169. The sewer was built in accordance with the improvement plans. The City consequently has a sewer easement which has never been used. No future need of this easement can be foreseen. We also have a public sewer for which no easement for access exists. This conflict was discovered when the owners of Lot 168 requested an encroachment permit for construction of a block wall, fence and concrete slab within the existing easement. Ponderosa Homes, the owners of Lot 169, have executed a document granting a replacement easement to the City and it is recommended that thi s easement be accepted. The existing easement over Lot 168 is of no value to the City. Since no use has been made of it, and it is being relocated or replaced, it is appropriate that this easement be summarily vacated.
