BACKGROUND ITEM TITLE: No-X.J 1. On May 20, 1980 the City Council approved the tentative subdivision map for Charter Point, Chu1a Vista Tract 80-20, and the Sectional Planning Area plan for the easterly 41 acres of the South College area of the E1 Rancho del Rey Specific Plan, located at the northwest quadrant of Otay Lakes Road and Telegraph Canyon Road in the P-C zone. The pro- posed development consists of 260 condominium units on postage stamp lots. 2. At the time of review, it was discussed that 1.5 acres of available surplus college property located at the southeast corner of the Southwestern Community College may be acquired by the developer and incorporated into the project. The property has since been acquired by the developer who is now requesting approval of a revision to the tentative map and Sectional Planning Area plan to include the 1.5 acres in the proposed development. On August 12, 1980 the property was rezoned from R-1 to P-C in anticipation of the revision and to make the zoning of the properties consistent. 3. On August 7, 1980 the Environmental Review Committee found that the proposed revision to the Charter Point subdivision and South College Sectional Planning Area plan would not have a significant effect on the environment and recommended that the Environmental Impact Report, EIR-80-4, be recertified. B. RECOMMENDATION: Concur with the Planning Commission recommendation except that the resolution should be modified as discussed below to delete any reference to the provision of 3% of the units as "inclusionary units" and to modify the language of the finding regarding conformance with the Housing Element of the General Plan. C. PLANNING COMMISSION RECOMMENDATION: On September 10, 1980 the Planning Commission voted 7-0 to recommend that the City Council: 1) Approve a revision to the South College Sectional P1annin~ Area plan to include the 1.5 acre site in accordance with Resolution PCM-81-2; and 2) approve the revised tentative subdivision map for Charter Point, Chu1a Vista Tract 80-20 in accordance with Resolution PCS-80-20 (Revised). D. DISCUSSION 1. Property acquisition. As indicated earlier, the subject property (1.5 acres) was recently acquired by the developer and has been incorporated into his ownership through the adjustment plan procedure. Proposed development. The applicant proposes to construct an additional 14 units on the property, bringing the total number to 274 units. The units, which are identical in architecture and design as originally proposed, will be contained in four structures as follows: 2 uphill four- plexes, 1 downhill fourplex, and 1 downhill duplex. (The buildings are front to back split level structures.) Each unit will have a two car garage and 16 open guest parking spaces will be provided. Access is provided by a 26 foot wide private road extending from the public street (Apache Drive) serving the Charter Point development. The proposed revision was anticipated in the original design of the subdivision and therefore does not alter that design except for the actual encroachment of the access road serving the additional 14 units. Therefore, the revision represents a logical extension of the original map, together with the findings and conditions of approval. 3. The original resolution approving this tract carried with it the condition requiring the applicant to devote 10% of his units to low or moderate income units. When this 1.5 acre expansion was before the Planning Commission on September 10, staff recom- mended and the Planning Commission approved a modification to the condition reducing the percentage of "inclusionary units" to 3% as was recommended at the Council Conference on August 14. However, Council's action of September 23 to delete the requirement for any inclusionary units on the properties at Telegraph Canyon Road and Nacion and at Bonita Road west of 1-805 clarifies Council's policy in this area. Accordingly, the language in the Planning Commission's resolution after "BE IT FURTHER RESOLVED, II and before condition No.1 should be deleted. Further, the language on page 2 of the Planning Conlnission's resolution under "Housing Element" should be modified to read as follows: "The development of condominiums on the subject property at a density of 10 dwelling units per acre will provide 274 additional housing units which should be available at prices below those of detached single family homes.
