Bush, developer of the property on the north side of Toyon Lane, has requested that a Sewer Repayment District be formed in order to recover a portion of his cost of installing an 8-inch sewer main in Toyon Lane. It is my RECOMMENDATION: That the Council approve resolution to form the subject Sewer Repayment District for Toyon Lane. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: At its meeting on September 10, 1975, the Planning Commission granted a Zoning Variance to Joseph Bush so that he could develop his land on the north side of Toyon Lane. He was required to provide a public sewer to serve the proposed parcels. On November 16, 1976, the City Council approved the subdivision agreement by Resolution No. 8417. The public improvements were installed by Mr. Bush and accepted by the City on January 17, 1978. In February of 1980, Dwight Gove of 30 Toyon Lane (south side of street) applied to this department to be connected to the City sewer in Toyon Lane. In accordance with Ordinance 997, Mr. Gove was assessed our standard amount of $16.00 per front foot of his lot totalling $1,280.00 Within the same month, Mr. Bush came to this department to claim the money owed to him by virtue of the recent connection. He was under the impression that a repayment district had been formed at the time he was developing his property. A thorough search was made of our records and revealed no indication that a district had been requested. Upon learning that the district had not been formed, he submitted verification of his costs of installing the sewer and requested reimbursement for Mr. Gove's connection. According to Section 13.16.170 of the Municipal Code, there is no time limit for application to form a repayment district. Section 13.16.170 permits the City Council, upon recommendation of the City Engineer, to approve and levy special sewer assessments upon properties which benefit from the construction of a sewer and which have not contributed to the cost of installation. A repayment diagram has been prepared and is shown on the attached exhibit. All the properties benefitting from the sewer are zoned R-l and are occupied by single-family dwellings. The total number of units that can be served by gravity flow is six. Dividing the total cost by this number yields an assessment of $937.83 per dwelling unit, plus 7% interest per annum. The two properties on the north side (25 and 31 Toyon Lane) have contributed to the cost of construction. I recommend that Council authorize the assessment of $937.83 to the four remaining sewerable properties (namely, 21, 30, 38 and 48 Toyon Lane) and reimburse this amount to Mr. Bush at the time of connection by the owners. I also recommend that Council authorize payment to Mr. Bush in the amount of $1,118.37 from the assessment fee charged to Mr. Gove, 30 Toyon Lane, at the time he connected and a refund of the excessive charge be sent to Mr. Gove ($1,280.00 less $937.83, plus $180.53 interest, equalling $161.64). Those lots outside the proposed repayment district (which would have to use force-laterals by pumping) connecting to the sewer main shall pay the standard frontage assessment as called out in Subsection A of Section 13.16.170.
