(4/5ths Vote: Yes_ No~J Robert J. Clark, Sr. doing bUSi~ as "Knucklebusters Auto Repair" has signed an agreement for City use of garage space for the construction of a storm drain facility. It is my RECOMMENDATION: That Council adopt resolution approving agreement and authorizing the Mayor to sign for the City. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: The City Council approved in the CIP budget the construction of the Third Avenue drainage facility at Parkway. The project starts in Memorial Park and runs easterly across Third Avenue through an easement granted by Tom Money, and across the City parking lot to the alley drainage way east of Third Avenue. Mr. Money has leased the garage area to Mr. Robert J. Clark, Sr. for an auto repair business. Mr. Clark has subleased a portion of the garage to Jose N. Barragan and Floyd E. Hardesty who operate "Chula Vista Brakes and Drums" which presently occupies the garage space through which the 5'x12' box culvert will be constructed. Engineering personnel have reached an agreement with the leasee, Robert J. Clark, Sr. which was approved by Mr. Money, for the time that construction will disrupt the garage lease space occupied by the "Chula Vista Brake and Drum" business. The construction is scheduled to be done in three phases to minimize traffic problems and minimize the time needed to construct the box culvert through the garage area. We estimate 60 days to complete the work in the garage area and restore the space for use by the tenant. The agreement calls for the payment of $9.00 per day that the tenant does not have use of the garage space for a total estimated cost to the City of $540.00. This money is available through the Community Development Revenue Sharing Funds. Joe Sanseverino, Community Development Coordinator, has reviewed the agreement and concurs with our recommendation. The agreement further stipulates that the City will furnish 6 parking stalls in the public parking lot just east of the garage, during the time of construction. The Parking Place Commisson has been informed that the parking lot will be closed for public use during the construction period. FISCAL IMPACT: The City will pay the leasee $9.00 per each day loss of use of the garage space during construction.
