HomeMy WebLinkAboutAgenda Statement 1980/09/16 Item 10 COUNCIL AGENDA STATEMENT Item . 10 Meeting Date 9-16-80 ITEM TITLE: Resolution/t)~S'S- Approving agreement with Kampground Enterprises, Inc. for connection to sewer SUBMITTED BY: Ci ty Eng ineer F (4/5ths Vote: Yes_ No-X-) Plans to develop an addition to the KOA campgrounds in Sweetwater Valley have resulted in an agreement between the Developer and the City which specified that "If annexation is not completed, Kampground Enterprises must contract with the City for sewer services prior to final inspection of applicable building permits". That contract (agreement) is herewith submitted for Council consideration. RECOMMENDATION: That Council by resolution approve the subject agreement. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: In December 1978, the City entered into agreement with Kampground Enterprises, Inc. (Developer) for construction of a public sewer through the Developer's property adjacent to the KOA site. Such property was and is situated in unincorporated territory. The agreement described the sewer work to be done and how costs were to be paid. It further made provisions for a contractual relationship in the event that the annexation could not be consumated. One unique requirement related to serving unincorporated property is that the permission of the City of San Diego must first be obtained in writing. Such permission was received on April 11, 1980. In accordance with the requirements of the 12-78 agreement, Engineering staff has prepared the attached agreement to provide sewer service pending annexation of the property to the City. The agreement covers such items as: 1. permission to connnect to sewer. 2. Developer to pay fees and obtain permits. 3. Developer to pay sewer service charges. 4. Sewage to conform to City standards. 5. Work to conform to City standards. 6. Disconnection from public sewer. 7. Developer liability for certain costs. FISCAL IMPACT: No direct fiscal impact is anticipated. A small income for the City will result from payment of connection charges and sewer serv ice cha rg es.
