OF THE CITY PLANNING COMMISSION OF
CHULA VISTA, CALIFORNIA
January 25, 1978
A regular meeting of the City Planning Commission of Chula Vista, California was
held on the above date beginning at 7:00 p.m. with the following members present:
Chandler, Smith, G. Johnson, R. Johnson, Renneisen and O'Neill. Absent (with
previous notification) Commissioner Pressutti. Also present: Director of Planning
Peterson, Assistant Director of Planning Williams, Current Planning Supervisor Lee,
Acting Fire Chief Longerbone, Assistant Director of Public Works Lippitt, Assistant
City Attorney Harron, and Secretary Mapes.
The pledge of allegiance to the flag was led by Chairman Chandler, followed by a
moment of silent prayer.
APPROVAL OF MINUTES
MSUC (R. Johnson-Renneisen) The minutes of the meeting of January 11, 1978 be
approved as mailed.
ORAL COMMUNICATIONS
Chairman Chandler called for oral communications and none were presented.
1. PUBLIC HEARING: Conditional Use Permit PCC-78-20 - Request to construct medical
clinic consisting of four buildings in the Sweetwater Valley
flood plain at the northwest quadrant of Bonita and Willow Roads
in the C-C-D-F zone - Kaiser Permanente Medical Care Program
Director of Planning Peterson advised that this conditional use permit is not
required for consideration of the compatibility of the use, since a medical clinic
is permitted as a principal use in the C-C zone. However, the property is within
the flood plain modifying district and the conditional use permit is to assure that
adequate precautions are taken in the development of the site to prevent flood damage.
A similar application for a smaller clinic at this site was approved a few years ago
but that permit has expired. This proposal will utilize a larger site, including the
area formerly approved for other commercial uses, which did not materialize.
Mr. Peterson pointed out that this site has been filled to one foot above the lO0
year flood level and, therefore, no possibility of flood damage should result from
the construction of buildings on the site. It is recommended that the Negative
Declaration of environmental impact be certified and the conditional use permit be
approved.
This being the time and place as advertised, the public hearing was opened. As no
one wished to speak, the public hearing was declared closed.
MSUC (R. Johnson-Smith) The Commission finds that in accordance with the Negative
Declaration on IS-76-103 and the findings stated therein, this project will have
no significant adverse environmental impact, and certifies the Negative Declaration.
MSUC (R. Johnson-Smith) Based on the findings as stated in the staff report,
conditional use permit PCC-7~-20 for construction of a medical clinic within the
Sweetwater Valley flood plain district is approved.

2. PUBLIC HEARING: Conditional Use Permit PCC-78-22 - Request to locate storage
yard in flood plain area, west of North Fifth Avenue, north
of "C" Street, in the I-L-F zone - Dixieline Lumber Co.
Current Planning Supervisor Lee reported that the proposed storage yard would be
located just west of the Dixieline Lumber Co. yard in the flood plain area in National
City. The company is proposing the construction of a new building on the National
City site, necessitating the expansion into Chula Vista for storage area. The
National City Planning Department advised today that they have received corres-
pondence from the Army Corps of Engineers which raised some question about the
construction and also the storage of material in that area. An environmental impact
report on the expansion program will be considered by the National City Planning
Commission on February 13. Mr. Lee advised that he had therefore suggested to a
representative of Dixieline Lumber Co. that this hearing be continued to the meeting
of February 22, so that the E.I.R. as well as comments from the Corps of Engineers,
may be taken into consideration. Dixieline Lumber Co. requested that this hearing
be continued to the February 8 meeting and they will attemp~to clear the matter with
National City prior to that date. It is therefore recommended that the hearing be
continued to February 8 with the possibility of a further continuance to February 22.
Commissioner Smith noted that one of the conditions recommended in the report
requires an agreement by the applicant to save the City harmless from any and all
liability arising as a result of implementation of this project. He asked how binding
such an agreement would be.
Assistant City Attorney Harron advised that this is a fail-safe type of provision
since the City has statutory immunity from liability in such a case.
MSUC (SmirCh-O'Neill) The public hearing on consideration of conditional Use Permit
PCC-87-22 be continued to February 8, 1978.
3. PUBLIC HEARING: Consideration of Precise Plan PCM-78-12 to divide two parcels
into three residential lots to be developed with single family
dwellings at 81-83-85 Quintard Street in the R-1-5-P zone -
H. S. Ala~ata
Director of Planning Peterson advised that the two lots under consideration were
created as a result of a variance approved some years ago to allow development of
property without street frontage and served by a 20 foot wide easement from Quintard
Street. The westerly lot is developed with an existing single family home and it
is proposed to divide the easterly lot into two lots, each containing 5,719 square
feet with a 40 foot wide area at the south end of the newly created parcels to be
used for access and guest parking. The precise plan modifying district was applied
to the property last year when the zoning was changed to R-l-5.
Mr. Peterson called attention to the list of conditions recommended with approval of
the plan.
This being the time and place as advertised, the public hearing was opened.
Mr. Alagata, 85 Quintard Street, expressed his agreement with the proposed conditions
with the exception of item 5 which would require the installation of a five foot high
solid fence at the north property line. He advised that seven years ago he planted
a hedge of oleanders along the property line and since that hedge has grown to a
height of about 7 feet he felt it would serve the same purpose as a fence. He
therefore asked that condition 5 be deleted.

Mr. Peterson advised that he had viewed the site on a field trip taken today and
concurred that the shrubs would be disrupted by the construction of a fence at that
property line. He agreed that the heavy growth would serve the same purpose as a
fence and consented to the deletion of condition 5.
As no one else wished to speak, the public hearing was closed.
MSUC (G. Johnson-Renneisen) Based upon the findings as stated in the staff report,
the Planning Commission recommends that the City Council approve the precise
plan to divide two parcels into three lots at 81-83-85 Quintard Street, subject to
five conditions enumerated in the staff report, and with the deletion of condition
No. 5.
4. PUBLIC HEARING: Consideration of Precise Plan PCM-78-11 for heavy equipment
storage yard north of Otay Valley Road in I-P zone -
W. F. Maxwell, Inc.
Director of Planning Peterson advised that the applicant is a bridge contractor
with heavy equipment. He proposes to use the southerly portion of the subject
property for storage of equipment with the possibility of expanding the use to the
entire site if warranted. This use is allowed in the industrial zone and the plan
is before the Commission due to the attachment of the "P" Modifying District.
He pointed out that the adjacent property is also zoned for industrial use and is
vacant on three sides, with an automobile wrecking yard located to the south of this
site. Access to the property is from a road which leads to the San Diego County
-- Sanitary Land Fill site. This is not a dedicated road and the applicant would
have to gain permission from the County to use that road.
Mr. Peterson called attention to the Negative Declaration of environmental impact
and to the list of six conditions recommended with approval of the precise plan.
This being the time and place as advertised, the public hearing was opened. As no
one wished to speak, the public hearing was declared closed.
MSUC (Renneisen-R. Johnson) The Commission finds that in accordance with the
Negative Declaration on IS-78-42 and the findings stated therein, this project will
have no significant adverse environmental impact, and certifies the Negative Declaration.
MSUC (Renneisen-R. Johnson) Based upon the findings stated in the staff report,
the Commission recommends that the City Council approve the precise plan for
a heavy equipment storage yard on the east side of an unnamed road to the San Diego
County Sanitary fill site, subject to the six conditions enumerated in the staff report.
5. PUBLIC HEARING: Consideration of EIR-78-5 on Casa del Rey Subdivision
Assistant Director of Planning Williams reported that this EIR relates to proposed
development on property within the E1 Rancho del Rey P-C zone but not owned by the
Otay Land Company. A moratorium against development within that area was recently
lifted by the City Council for development of single family dwellings. No written
comment on the EIR has been received from other public agencies and both the
Environmental Control Commission and Safety Commission have concluded that the
report meets the requirements of CEQA.
Mr. Williams called attention to an error in the staff report under the discussion

of the project setting and impact, relating to the location of fire station #2,
which states that the last sentence in Section 2.16.1.1 should be deleted; this
should be changed to Section 3.16.1.1.
This being the time and place as advertised, the public hearing was opened.
William Morehouse, Toups Corporation, 2223 Avenida DeLa Playa, La Jolla, advised
that his firm was retained to prepare the draft report and he would be pleased to
answer any questions concerning the report.
MSUC (Renneisen-G. Johnson) The Commission finds that environmental impact report
EIR-78-5 has been prepared in accordance with CEQA and the Environmental Review
Policy of the City of Chula Vista and that the Planning Commission shall consider
the information therein as it reaches a decision on the project.
6, PUBLIC HEARING: Consideration of Tentative Map PCS-77-9 on Casa del ReS
Subdivision
Current Planning Supervisor Lee indicated the location of the proposed development
which extends from Paseo Ranchero, just west of Buena Vista Drive, to Paseo Ladera
which abuts Windsor Views and E1 Rancho del Rey Unit 5, wi th Telegraph Canyon Road
as the southerly boundary and East "J" Street the northerly boundary. The site
contains 68 acres to be developed with 220 single family lots, 2 open space lots
and 7 lots reserved for future residential use. This development represents a
density of about 3.3 units per acre and in considering the amount of open space
surrounding the development site, and probable future lotting pattern in those adjacent
areas, the development is well within the density of the General Plan.
Mr. Lee pointed out that the revision to the E1 Rancho del Rey General Development
Plan now under consideration calls for a 5 acre park site adjacent to the school site
to be located at the northeast boundary of this development. Such park site could be
located west of the school in the northeast corner of this subdivision, or it could
be to the south of the school site. The Director of Parks and Recreation has indicated
either site would be acceptable. For that reason this subdivider is being asked
to reserve the 5 acresfor possible park use until such time as the final map is
presented for approval.
Mr. Lee noted that the proposed open space areas would be left mainly in a natural
state and would require only the addition of some trees in the canyons. He called
attention to the extensive public improvements which are required to provide the
necessary traffic circulation for this undeveloped area.

Sam Blick, attorney wi th Higgs, Fletcher and Mack of San Diego, representing Ralph
Monsees, owner of the property, discussed the merits of the development and the
benefits which will accrue to the community as a whole through the installation of
public improvements, including 2100 feet of Telegraph Canyon Road. He advised that
Mr. Monsees has agreed to all conditions stipulated in the staff report.
Mr. Blick further pointed out that the City Council recently indicated their
consensus that this is a logical development when they lifted the moratorium for
single family development in the area north of Telegraph Canyon Road. This is borne
out by the fact that all utilities--water, gas, electricity and sewer--are in
up to the boundary of the site.

As no one else wished to speak, the public hearing was closed.
Commissioner O'Neill commented that this looks like a fine land use and that it
will be beneficial to the community to have the improvements that will be provided
by the developer. He nevertheless felt that the development plan may be a little
premature since a revised General Development Plan for the entire area is being
undertaken and has not yet been presented for Planning Commission or Council
consideration. This plan proposes a significant amount of grading which may not be
in conformity with the revised General Plan for the area.
MSUC (Renneisen-R. Johnson) Based on the findings of consistency with the General
Plan as stated in the staff report, the Planning Commission recommends that the
City Council approve the tentative subdivision map for Casa del Rey (PCS-77-9)
subject to the conditions enumerated in the staff report.
DIRECTOR'S REPORT
Director of Planning Peterson reminded the Commission of the special meeting
scheduled for Wednesday, February 1. This meeting was originally scheduled to
consider only the environmental impact report and the proposed revision to the
General Development Plan of E1 Rancho del Rey. However, two additional items have
been placed on the agenda. These include the establishment of the boundary for
Town Centre Redevelopment Project No. 2, and the adoption of a preliminary plan for
that project. It is proposed that the area would include the existing Chula Vista
shopping center and extend to the boundary of the Third Avenue Redevelopment Project.
COMMISSION COMMENTS
Commissioner G. Johnson requested that a future study session include a discussion
of the boundaries and plans for the Sweetwater Regional Park.
ADJOURNMENT
Commissioner Chandler adjourned the meeting at 7:50 p.m.
