HomeMy WebLinkAboutPlanning Comm min 1977/01/26 MINUTES OF A REGULAR MEETING OF THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA January 26, 1977 A regular meeting of the City Planning Commission of Chula Vista, California, was held on the above date beginning at 7:00 p.m. with the following members present: Chandler, Smith, Starr, Pressutti, R. Johnson, G. Johnson and Renneisen. Also present: Director of Planning Peterson, Current Planning Supervisor Lee, Assistant Director of Public Works Lippitt, Assistant Fire Chief Longerbone, City Attorney Lindberg, and Secretary Mapes. The pledge of allegiance to the flag was led by Chairman Chandler, followed by a moment of silent prayer. APPROVAL OF MINUTES MSUC (R. Johnson-Pressutti) The minutes of the meeting of January 12, 1977 be approved as written, copies having been mailed to the Commissioners. Commissioner Renneisen abstained from voting due to his absence at that meeting. ORAL COMMUNICATIONS The Chairman called for oral communications but none were presented. 1. Consideration of request for extension of time for Tentative Map of Chula Vista Tract 75-2 (PCS-75-2)(formerly Palomar Garden Estates) Palomar Street and Second Avenue Director of Planning Peterson advised that this 2.5 acre tract was approved a year and a half ago, and the owner has requested an extension of time on the tentative map to complete his financing arrangements. In evaluating the circumstances of the area it was determined that only one condition has changed and that concerns the sewer capacity downstream from this location. The City Public Works Department and the County are working to increase the sewer capacity to meet the needs. It is recommended that the extension of time be approved with an additional condition to provide that no connection to the sewer system can be made until the downstream sewer lines have been improved to accommodate additional flow. MSUC (R. Johnson-Pressutti) A one year extension of time for Chula Vista Tract 75-2 is approved with the added stipulation that no connection can be made to the sewer system until the capacity is adequate. 2. PUBLIC HEARING: PCZ-77-A - Applying "P" Modifying District to approximately 16.6 acres located southwest of 30th Street and Edgemere Avenue zoned C-C, C-C-F and I-L-F - City Initiated Current Planning Supervisor Lee reported that the proposed application of the "P" Modifying District is the result of a request from the National City Planning Director. The letter from National City noted that specific guidelines imposed on the adjacent Town and Country Shopping Center have resulted in a very attractive development, and that guidelines should be established on adjacent properties. -2- January 26, 1977 He pointed out the area, noting that 5.72 acres with frontage on 30th Street is zoned C-C with the F District attached to the portion lying below the flood plain boundary line; 10.89 acres to the south, between the commercial zone and the free- way and flood control channel right of way, is zoned I-L-F; this includes a narrow strip of land extending to Highland Avenue on the west. Mr. Lee showed numerous slides showing the topographical difference between the property under consideration and the development along 30th Street, as well as views of the new shopping center. Mr. Lee reported that the subject area is under the control of four owners; one of whom sent a letter indicating favorable reaction to the proposed change of zone. The staff recommends certification of the Negative Declaration and adoption of the "P" Modifying District for the 16.6 acres, with five guidelines for development relating to internal circulation, ingress and egress points, overall development plan, coordinated sign program and an architectural theme. This being the time and place as advertised, the public hearing was opened. M. S. Briggs, 2030 E Avenue, National City, owner of a parcel in the flood plain area, zoned I-L-F, spoke at some length on problems of flooding on his property which he contended resulted from no maintenance of a drainage channel which bisects his property and to the fact that water from Paradise Creek comes under 30th Street and on to this property. He reported that he has contacted National City regarding this problem but they declined to take any action since his property is in Chula Vista. Vincent Delucia, 1930 Granger Avenue, National City, owner of property at the corner of 30th Street and Edgemere Avenue, reported that he had fought the problem of drainage in the courts for over a year. He felt that the Planning Commission should look into this and protect the property from what National City is trying to do in taking water from another watershed and dumping it into this area. He complained of increased taxes on the property and of problems in obtaining approval for development. He contended that adding the "P" Modifying District would be adding more restrictions which would make it even more difficult to develop. As no one else wished to speak, the public hearing was closed. Commissioner Smith expressed the opinion that the "P" Modifying District gives sufficient control without the five conditions recommended in the report. He took particular exception to the condition which provided that if the owners did not submit a joint plan, the City may undertake a specific plan program for the property. Mr. Lee pointed out that such action would be taken only at the direction of the City Council. Commissioner Pressutti pointed out that the conditions did not relate to a specific plan for development but were stated simply as precautions which a developer should be aware of before undertaking development plans. Mr. Lee affirmed that this rezoning action is not an attempt to restrict land uses, as the underlying zone sets the basic land use, and the "P" District merely provides for control of circulation, signing and architectural factors relating to compatibility with the area and adjacent uses. -3- January 26, 1977 Commissioner Smith reiterated that the "P" District is sufficient without added conditions. MSUC (G. Johnson-Pressutti) The Commission finds that in accordance with the Negative Declaration on IS-76-112 and the findings therein, this rezoning will have no significant adverse environmental impacts, and certifies that the Negative Declaration was prepared in accordance with CEQA, J970 as amended. MS (G. Johnson-Chandler) The Commission recommends that the City Council apply the "P" Modifying District to 16.61 acres located south of 30th Street, west of Edgemere Avenue and include the five conditions listed in the staff report. MS (Smith-Renneisen) The motion be amended to eliminate inclusion of the five conditions. The motion for amendment carried by the following vote: AYES: Commissioners Smith, Renneisen, Starr, Pressutti and R. Johnson NOES: Commissioners G. Johnson and Chandler ABSENT: None The motion as amended carried unanimously. Commissioner Renneisen requested that in view of the problems discussed the staff look into the drainage situation and report to the Commission. 5. Consideration of request for modification of conditional use permit PCC-76-3 for Pizza Hut Restaurant at 271 Orange Avenue in the C-N zone. Director of Planning Peterson advised that this conditional use permit was issued last spring to authorize the sale of beer and wine in connection with a restaurant located in the C-N zone at Orange and Melrose. In the C-N zone businesses are required to close at 11:00 p.m. unless authorization is given by the Planning Commission for extended hours. Such authorization is being requested by Pizza Hut to extend their hours to midnight on week nights and 1:00 a.m. on week ends. Mr. Peterson pointed out that the staff report included arguments both for approval and for denial of the request, with a reco~endation that the request be denied. He also noted that another restaurant across the street from this site, which was granted permission by the City to remain open later on week ends, was required by the Alcoholic Beverage Control Board to close at 11:00 p.m. In response to a question from Commissioner Smith as to what prompted this request, Mr. Peterson advised that the restaurant had been staying open beyond ll:O0 p.m. and a complaint was received with a request that they close at ll:O0 p.m. The restaurant therefore requested authorization to remain open later. MS (Pressutti-Starr) The request for extended hours of operation by the Pizza Hut be denied. The motion carried by the following vote: AYES: Commissioners Pressutti, Starr, Smith, R. Johnson, G. Johnson, and Chandler NOES: Commissioner Renneisen ABSENT: None -4- January 26, 1977 DIRECTOR'S REPORT Director of Planning Peterson called attention to the proposed budget for the Planning Commission for next fiscal year. He pointed out it is similar to this year's budget with an additional allowance for increased attendance at League of California dinner meetings, which are held monthly at various locations in the County. The Commission offered no suggestions for additional budget requestsa~d directed that the budget as prepared be forwarded to the City Council for consideration.
