RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CHULA VISTA APPROVING AN AGREEMENT WITH
THE CALIFORNIA HOUSING FINANCE AGENCY FOR
THE HOME OWNERSHIP AND HOME H1PROVEMENT
LOAN PROGRAM
The City Council of the City of Chula Vista does hereby
resolve as follows:
~HEREAS, the City on Auqust 7 , 1979, approved an
agreement with the California Housing Finance Agency (CHFA) for the
Home Ownership and Horne Improvement Loan Program (HOHI); and,
WHEREAS, CHFA has authorized a renewal of the HOHI
program and is offering the City of Chula Vi sta a new allocation of
$700,000; and,
WHEREAS, the HOHI program offers low-interest loans to
low and moderate-income persons for the purchase and/or rehabilitation
of residential property; and,
"\"lliEREAS, the A9Teement entitled California Housing Finance
Agency Horne Ownership and Horne Improvement Loan Program (HOIn) Local
Government Agreement is attached hereto as though fully set for-th
herein.
NOW, THEREFORE, BE IT RESOLVED that the Agreement with
CHFA is hereby approved and the Mayor is authorized and directed to
execute said Agreement for and on behalf of the City of Chula Vista.

HOME OWNERSHIP AND HOME IMPROVEMENT LOAN PROGRAM (HOHI)
LOCAL GOVERNMENT AGREEMENT
This LOCAL GOVERNMENT AGREEMENT (the "Agreement") is entered
into by and between
(hereinafter "LOCALITY") and
Agency (hereinafter "CHFA").

RECITALS
)
A. CHFA and LOCALITY wish to institute a program of finan-
cial assistance and provide related service~ to assist persons of
low and moderate income to obtain decent, safe and sani tary
housing through the Home Ownership and Home Improvement Program
in Neighborhood Preservation Area(s) ("HOHI Program").
B. CHFA has received and reviewed an application submitted
by LOCALITY for designation of (an) area(s) within the LOCALITY
described in Exhibit G as (a) participating Neighborhood Preser-
vation Area(s), and CHFA has agreed to designate such area(s)
("Commi tment Area (s)").
Now, therefore, LOCALITY and CHFA agree as follows:
ARTICLE I - AUTHORIZATION
This Agreement is entered into pursuant to applicable provi-
sions of the Zenovich-Moscone-Chacon Housing and Home Finance
Act, constituting Division 31 (commencing with Section 50000) of
the Health and Safety Code of the 3tate of California (the
"Act"); and the regulations promulgated wi th respect to the
operation of the HOHI Program in those areas designated by
resolution of the CHFA pursuant to Chapter Six, Part 3 of the Act
as "Neighbo..:hood Preservation Areas", all agreements, contracts,
commi tment s, manual s, i nst ruct i on let ter s and other documents
pertaining to the HOHI Program (collectively the "Rules and
Regulatiors.")
ARTICLE II - APPLICABILITY

This Agreement shall apply to all types of Neighborhood
Preservation Areas. For LOCALITIES with designated Concentrated
Rehabilitation Area(s) ("CRA's"), Part II covering additional
obligations become part of this Agreement. In LOCALITIES which
have agreed to assist CHFA in providing a Rental Housing Program,
Part III shall become part of this Agreement. The programs to be
included by LOCALITY are checked below and the appropriate Parts
incorporated herein by this reference.

ARTICLE III - DEFINITIONS
Defini tions. Unless a different meaning clearly appears
from the context, all terms in this Agreement shall have the same
meaning as prescr ibed by the Act and Rules and Regulat ions.
Additionally,
A. "Home Improvement Loan" means an advance of money )
evidenced by a note to finance rehabilitation or general repairs
and improvements to eligible residential structures.
B. "HOHI Program" means CHFA' s Home Ownership and Home
Improvemenr-Loan Program in Neighborhood Preservation Area(s), as
governed by the Act, Rules and Regulations, and all agreements,
contracts, commitments, manuals, instruction letters, and other
documents pertaining to the HOHI Program.
C. "Loan" means a Mortgage Loan, a Home Improvement Loan,
or other advance of money.
ARTICLE IV - CERTIFICATIONS
LOCALITY'S acceptance and performance of the following obI i-
gat ions and responsi bi 1 i ties shall be condi t ions precedent to
CHFA'S obligation to provide the financing assistance under the
HOHI Program and as described in Exhibit A (Borrowers and
Developers Eligibility Charts). Localities shall certify as to
the items in A, Band C on Exhibit E which shall become a part of
this Agreement.
A. Citizen Participation. LOCALITY shall certify that it
has implemented and will continue to implement a program of
Citizen Participation which will satisfy the requirements of
CHFA.

B. California Environmental Quality Act (CEQA). LOCA:.!T':'

C. Affirmative Action. LOCALITY shall

subcontractors involved in the rehabilitation or

Action Certificate or Deve1oper's/Rehabi1itator's Equal
Opportunity/Affirmative Action Certificate), which is
executed by the borrower and contractor on each

D. Relocation. LOCALITY shall be responsible for certi-
fying for CHFA Loans in Mortgage Assistance Areas (Certificate
#002b, attached hereto) that with respect to each Loan for each
uni t in a rental property not occupied by the borrower that
either:
1. Renters will not be displaced as a result of the Loan;
or
LOCALITY will bear full responsibility

ARTICLE V - FAIR SHARE ALLOCATION

A. Fair Share Allocation. LOCALITIES participating
HOHI Program perIodIcally may be allocated a "fair share"
Program funds based on proportional need as identified
Statewide Housing Plan and subject to fund availability.
B. Allocation Assignment to Lender. LOCALITY is hereby

Lenders" upon receipt of an application or applications from such

financing assIstance programs shall cease, or be suspended for
such time during the term of this Agreement as may be determined
by CHFA, if: (1) LOCALITY has failed to comply with any of the
conditions set forth in this Agreement; (2) CHFA determines that
obligation of the LOCALITY are not being implemented in a timely
or reasonable manner; or (3) bonds are not issued in an amount
sufficient, in the sole opinion of CHFA, to purchase loans in the
amount of the commi tment and at an interest rate w-h-i-ch CHFA
believes will allow it to make Loans'at an interest rate suffi-
ciently low so as to make the HOHI Program feasible.

" ARTICLE VII - STATUS REPORTS

LOCALITY shall prepare and submit to CHFA annually, and more
frequently upon request of CHrA~ progress and status reports on
the HOHI Program.
ARTICLE VIII - COMPLIANCE AND INSPECTION
Representatives of CHFA shall have the right to periodically
meet with LOCALITY to inspect the Commitment Area(s), and to
inspect the records of LOCALITY regarding the HOHI Program.

PART II - CONCENTRATED REHABILITATION AREAS
Services and Improvements
LOCALITY'S adoption and implementation of the following
programs within the designated Concentrated Rehabilitation
Area(s) shall be conditions precedent to CHFA'S obligation to
provide the financing assistance under the HOHI Program.
)
A. Housing Assistance Services. LOCALITY shall operate
programs that assIst low and very low income residents to afford
decent, safe and sanitary housing, including improvements to the
housing necessitated by the code enforcement effort required in
Section B below. These housing assistance programs are described
in Exhibits B-1 through B-4 of this Agreement.
B. Code Enforcement. LOCALITY shall operate a program to
provide concentrated and continuing enforcement of rehabilita-
tion standards in the designated area. LOCALITY'S description of
this code enforcement program is attached as Exhibit C.
C. Marketing. LOCALITY shall operate a program to
encourage partIcIpation by local lenders and to inform the
LOCALITY residents of the existence of financial assistance
available as a part of the HOHI Program. Description of
LOCALITY'S marketing program is attached as Exhibit C.
D. Capital Improvements. LOCALITY shall provide specific
capital improvements. These improvements, the amount budgeted,
. and the timetable for starting and completing the work are shown
in Exhibit D of this Agreement.
E. Relocation. LOCALITY shall operate a program to
ascertain and resolve problems of displacement of tenants in
housing to be financed with CHFA loans. These procedures shall
be sufficient to enable the LOCALITY to certify
(Certificate f#002b, attached hereto) with respect to each loan
for each unit in a rental property not occupied by the borrower
that either:

F. Status Reports. LOCALITY shall submit annually and more
frequently upon request of CHFA, status reports to CHFA including
information additional to that required in Part 1. The report
shall include descriptions of the progress and status of each of
the programs approved and implemented pursuant to this Part,
including the date of adoption and implementation of each, funds
budgeted, and funds expended. The reports should include
LOCALITY's evaluation of CHFA's financing assistance program.

CODE ENFORCEMENT
The City's Code Enforcement Program begins with a letter to each property owner
within the designated rehabilitation neighborhood. This letter introduces the
City's Rehabilitation Housing Inspector, the Housing Rehabilitation Administrator
and explains the Housing Rehabilitation Program. From this letter, appointments
are made to inspect the housing units. 'Those owners who do not respond initially
are sent a second letter approximately 60 days later. If a response is still not
received, the Inspector and Administrator contact owners and tenants on a door-
to-door basis. Since the Code Enforcement Program is mandatory, this procedure
is continued until all units have been inspected.
In the designated rehabilitation neighborhood, compliance is mandatory for all
health and safety code violations. Violations are identified by the Inspector
and a letter is sent notifying the property owner that all violations must be
corrected within 90 days. The letter also informs the owner of the low-interest
loans that are available to bring the property up to code.
The City has adopted the State of California Housing Law and Uniform Housing
Code (1976 Edition) for use in the Code Enforcement Program.
MARKETING
The City's marketing approach is to utilize the citizen participation process,
media publicity and general advertising. In each CRA neighborhood there exists
a citizen organization which disseminates information on the City's rehabilita- .
tion programs. Additionally, the program receives excellent coverage on the
program from the local newspaper.
The City's advertising program was expanded to accommodate the 1979-80 HOHI
program and this will continue in 1980-81. . A publicity campaign will again in-
form the public through the local newspapers and City organizations. The local
Board of Realtors will again be informed by a special bulletin so that home-
buyers will be aware of rehabilitation opportunities.

RENT LIMITATION
The City currently has a rent limitation process in effect for its CDBG housing
rehabilitation program. This would be expanded to accommodate any rental housing
(other than long-term Section 8) which is rehabilitated under the HOHI program.
The City's Housing Rehabilitation Administrator would be responsible for all phases
of Rent Limitation Monitoring Program. This involves the establishing of base
rents, re-inspection and re-certification, priority to Section 8 certificate holders,
and enforcement. However, the San Diego County Housing Authority will be responsible
for the re-i~spection and re-certification of units actually occupied by Section 8
certificate holders.
RELOCATION
The City currently contracts with the firm of Port & Flor, Inc. for relocation
services. This firm would accomplish any relocation required under this program
on an "as needed" basis. Funding for the service and the benefits would be pro-
vided by CDBG.
