HomeMy WebLinkAboutReso 1980-10273 Revised 9/19/80 RESOLUTION NO. 10273 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DETERMING THE AMOUNT OF MONEY WHICH SHOULD BE ASSESSED AGAINST CERTAIN PARCELS OF PROPERTY PRIOR TO MAKING SEWER CONNECTION AS A BENEFIT RECEIVED BY SAID PARCELS BY THE CONSTRUCTION OF A SEWER INSTALLA- TION ALONG THE SOUTH SIDE OF TOYON LANE AND APPROVING REPAYMENT DISTRICT FOR JOSEPH V. BUSH The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Joseph V. Bush has constructed or caused to be constructed a certain sewer installation on Toyon Lane, and WHEREAS, the total cost of designing and constructing said 306 lineal feet of 8-inch sewer main was $5,627.00, and WHEREAS, the City Council did accept said construction on January 17, 1978 as having meet the specifications and require- ments of the City of Chula Vista, and WHEREAS, the City Engineer has prepared a repayment diagram marked as Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full, whereby properties benefitted from the construction of the sewer and who did not participate in the construction of the sewer will reimburse the City at the time they connect to the City sewer system, which diagram has been prepared in accordance with the provisions of Section 13.16.170 of the Chula Vista Municipal Code. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve the sewer repayment district for the con- struction of a sewer on Toyon Lane and authorize the payment of $937.83 from the four properties at 21, 30, 38 and 48 Toyon Lane and reimburse said amount to Joseph V. Bush at the time of connection by the owners. BE IT FURTHER RESOLVED that the City Council authorizes payment to Mr. Bush in the amount of $1,118.37 from the assessment fee charged to the property at 30 Toyon Lane and that a refund of the excessive charge be returned to the property owner at 30 Toyon Lane in the amount of $161.64. DATED ( seal) City Clerk CC-660 107- 7 3 RECOMMENDATION OF THE CITY ENGINEER REGARDING THE METHOD OF REPAYMENT FOR THE COST OF SEWER FACILITIES IN TOYON LANE EXHIBiT A I, John P. Lippitt, City Engineer of the City of Chula Vista, hereby present my recommendation to the City Council regarding payment of construction costs for an 8-inch sewer main installed in Toyon Lane. Section 13.16.170 of the Chula Vista Municipal Code provides that the City Engineer shall determine a proper ~ewer charge against those properties benefiting but not contributing to the construction costs of the ~ewer facilities installed. The City Council may, by resolution, adopt the recommendations of the City Engineer. Reimbursement by properties \-Jhich have not contributed to construction costs: $3,751.33 f 4 = $937.83 (plus 7~ interest per annum) to developer (Account No. 220-4022) 7. Interest Charges: To the above connection charges, there is to be added simple interest of 7% per annum for a pericd of 10 years to be added at the time of payment of the connection charges and prior to being servEd by the subject sewer. The interest is to be calculated on a quarterly basis and shall include the total number of full quarters from April 1, 1977, up to but not including the quarter in which payment of such charges are paid. 8.
