RESOLUTION NO. 10237
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA URGING THE SAN DIEGO COUNTY BOARD OF SUPERVISORS
TO PRESERVE THE SAME RATIO THAT THE CITIES AND COUNTY
CURRENTLY RECEIVE IN PROPERTY TAX WITHIN THEIR
RESPECTIVE JURISDICTIONS WITHIN NEWLY ANNEXED AREAS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Section 98 and 99 of the Revenue and Taxation
Code regulates the distribution of property taxes within an
annexed area, and
WHEREAS, said regulation leaves it up to the Board of
Supervisors to determine the share of property taxes to be
allocated to the annexing city, and
WHEREAS, Board Policy I-55 supports and encourages
annexation to cities, and
WHEREAS, there are currently many areas in the county
waiting to start annexation proceedings and there is a backlog of
26 annexations which are in process which cannot be completed
because of the inability of the cities and county to establish an
acceptable policy of sharing property taxes collected by the
county with the annexing cities, and
WHEREAS, the current situation in effect translates into
a no growth policy, and
WHEREAS, the variation in property tax revenues between
cities makes it unfair to adopt a single county-wide percentage to
be applied in all annexations, and
WHEREAS, it is recognized that the current regulation is
unfair to the county as well as to the cities because the state
legislature has chosen to allow the schools to avoid providing a
fair share of property taxes to annexing cities, and
WHEREAS, the ultimate solution to this problem must be
provided by the State Legislature.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that:
1. The Board of Supervisors be and is hereby urged to
establish a policy that the county will share property tax revenue
attributable to growth within an annexed area, on the same pro
rata basis as currently exists in the annexing city.
2. Said policy be considered as an interim solution
pending corrective state legislation.
3. The county include in its legislative program a
proposal to join with the cities to seek an equitable solution to
this problem at the next legislative session.
