RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA REMISING, RELEASING AND QUITCLAIMING CERTAIN
REAL PROPERTY IN SAID CITY TO JERRAL B. AND DOROTHY M.
STAPLES, AND AUTHORIZING THE MAYOR TO EXECUTE SAID
QUITCLAIM DEED
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that the City of Chula
of Chula Vista hereby remises, releases and quitclaims that certain
real property more particularly described in the Quitclaim Deed
attached hereto and incorporated herein by reference as if set
forth in full, to JERRAL B. and DOROTHY M. STAPLES.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized to execute said Quit-
claim Deed for and on behalf of the City of Chula Vista.
BE IT FURTHER RESOLVED that the sum of $2,500.00 received
from Mr. and Mrs. Staples as consideration for the execution of said
Quitclaim Deed for said property be, and the same is hereby accepted
and placed in Open Space District No.4 Maintenance Fund Account
554-4098.
BE IT FURTHER RESOLVED that the City Engineer be, and he
is hereby authorized and directed to permit the construction of a
swimming pool on said lot and the utilization of Open Space Lot 74
in accordance with those conditions more particularly described in
Exhibit "A", attached hereto and incorporated herein by reference
as if set forth in full.

A plan shall be prepared by a registered civil engineer on'
Eng~neering Department's fbrmat showing:
a. Excavation of existing ground.
EXHIBiT
A
b. Proposed fill slope with daylight lines.
c. Structural details of pool walls which are not supported
by undisturbed ground.
d. Proposed landscaping and irrigation for new slope within
open space.
The engineer shall also submit calculations to support his
wall design.
2. The owner shall hold the City harmless from any liability
during construction.
3. The existing irrigation system at the top of the existing
slope shall be relocated at the sole expense of the property
owner and work shall be inspected and approved by the
Department of Parks & Recreation.
4. ~vner shall be responsible for restoring laLdscap:ng on the
newly created slope to the satisfaction of the Department of
Parks & Recreation.. The Ci ty Landscape Archi tect should be
contacted to advise on best method to replant slope.
s. A sepaiate permit must be obtained from the Department of
Building & Housing before construction may begin.
6. ~vner shall post a surety bond for faithful performar~e in the
amount equal to the valuation of grading, landscaping and
irrigation~
