In accordance with the requirements of TPM 80-14. Letha I. Chisholm has
granted easements for street tree purposes along James Court and along
"J" Street and an easement for street purposes along James Court to the
City. It is my
RECOMMENDATION: That Council accept the easements for street tree
purposes along James Court and along "J" Street and accept the easement
for street purposes along James Court while also dedicating and naming a
portion of One foot Control Lot "A" (which the City owns) as shown on
Map No. 4450 of Cindy Park Unit No.2 Subdivision.
BOARD/COMMISSION RECOMMENDATION: Not applicable.
DISCUSSION:
Three of the conditions for the approval of Tentative Parcel Map 80-14
were for the owner to grant: (1) 19 feet of right-of-way for James
Court, (2) a 10 foot wide easement for street tree purposes along the
proposed northerly right-of-way for James Court and (3) a 7.5 foot wide
easement for street tree purposes along "J" Street.
On June 11, 1980, Letha I. Chisholm granted the necessary street tree
easements and also the right-of-way for street purposes along James
Co ur t .
In conjunction with the acquisition of right-of-way for James Court, it
is also appropriate to dedicate and name, as James Court, that portion
of One-foot Control Lot "A", as shown on Map No. 4450 of Cindy Park Unit
No.2 Subdivision, which is adjacent to the newly acquired right-of-way.
A precise legal description for that portion of Lot "A" to be dedicated
and named is attached to the subject resolution.
Street improvements for James Court have been noted by certificate on
the Final Parcel Map. The improvements will be constructed rior to
issuance of a building permit for the adjacent parcel.
