RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA AUTHORIZING ROGER KRAUEL, CITY ATTORNEY OF
CORONADO AND PRESIDENT OF THE SAN DIEGO COUNTY CITY
ATTORNEYS' ASSOCIATION, TO ACT FOR AND ON BEHALF OF
THE CITY OF CHULA VISTA IN THE CASE OF DAUTRICH v.
BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES'
RETIREMENT SYSTEM OF THE STATE OF CALIFORNIA, et al
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City of Chula Vista has been a party
respondent in the case of Dautrich v. Board of Administration of
the Public Employees' Retirement System of the State of Cali-
fornia, et aI, a class action filed in 1977, and
WHEREAS, the case essentially seeks certain additional
benefits for females employed as police dispatcher clerks prior to
1972 asking to be treated on the same basis as male dispatchers
who were receiving benefits similar to those of uniform police
officers, and
WHEREAS, the exact extent of the obligations of the City
of Chula Vista in the event of an unfavorable decision to the
cities in this class action has not yet been determined, and
WHEREAS, the City of Chula Vista, along with the
majority of the other 249 cities involved in this lawsuit, has not
undertaken any substantial response to the lawsuit nor responded
to requests for interrogatories, and
WHEREAS, the court has now ordered that interrogatories
be answered and that all parties to the class action must respond
or face the prospect of a default, and
WHEREAS, the San Diego County City Attorneys' Associa-
tion has concluded that it would be most economical and in the
common interest to authorize Roger Krauel, the President of the
Association and City Attorney of Coronado, to make the appropriate
inquiries and contacts to prepare any necessary response for and
on behalf of all of the cities in San Diego County.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby authorize and direct Roger
Krauel to act for and on behalf of the City of Chula Vista in the
above-entitled lawsuit.
BE IT FURTHER RESOLVED that the City Attorney is autho-
rized to pay from his professional services account any amounts
that may be required in this endeavor.
