Resolution No. 6437, recorded May 23, 1972, Document No.. 129764 of
official records, authorized the deferral of the requirement .to install
public improvements along the east side of Second Avenue for a distance
of 620 feet south of Palomar Street. A lien agreement in the amount
of $4,750 was executed and approved to guarantee the.construction of
the improvements. The deferred improvements have been constructed
as part of the subdivision process. It is my
RECOMMENDATION: That Council approve resolution releasing the lien
and authorizing the City Clerk to record the resolution in the Office
of the County Recorder.

DISCUSSION:
In accordance with the procedures of the 1911 Improvement Act, Saburo
and Haruko Muraoka were required to install public improvements along
their property on the east side of Second Avenue from Palomar Street
to 620 feet south. An agreement dated May 15, 1972 was approved by
Resolution No. 6437 which allowed the deferral of curbs, gutters,
driveways and shoulder paving and established a lien against their
property in the amount of $4,750.00. The deferred improvements have been
constructed under a Subdivision Improvement Agreement as a condition of
approving the final map for Palomar Palace Estates Subdivision. The
improvements were guaranteed by a $18,500.00 surety bond. It is appropriate
at this time to release the $4,750.00 lien against the property so that
escrow may be closed on sales in the subdivision.
