SUBMITTED BY:
On April 1, 1980, the City Council held a public hearing on the Walnut
Avenue 1911 Act Assessment. Because of written protests presented at
this hearing on the assessment, the Council continued the public hearing
until May 6, 1980, and directed staff to investigate and re-evaluate the
matter in which the assessment was determined.
RECOMMENDATION: That Council:
1. Hold the continued public hearing.
2. Pass resolution confirming proceedings and adopting revised
assessment spread.
BOARD/COMMISSION RECOMMENDATION: Not applicable.
DISCUSSION:
The Engineering staff has discussed the spread of assessments with
several consulting assessment engineers who are considered as experts
in their field. Based upon the consultants' suggestions and advice,
Engineering staff has revised the original assessment figures for each
parcel as shown on sheet 3 of 3 of the "1911 Act Assessment District
79-1 for Walnut Avenue Assessment Roll" marked "Revised April 21, 1980".
A copy of this revised sheet is attached.
The assessment method was revised to account for the existence of
odd-shaped lots (non-rectangular) within the district's boundaries.
An adjustment was made to one of the odd-shaped lots to create
a more equitable frontage charge. This had tqe effect of changing the
total assessable frontage in the district, thereby increasing the
unit frontage cost slightly for most of th~ lots:
The method used for the revised spread of assessments was as follows:
For improvements benefiting the, entire district such as street paving,
curb, gutter, sidewalk, street light, and manhole adjustment, cost
spread was done on the basis of 70% net assessable lot frontage and
30% lot area.
Improvements which only benefited the fronting properties such as
driveways, sewer laterals, sewer lateral caps and cleanouts, were
charged directly to the individual benefiting property owner. The
force main purchase price ($2,000) was only spread to the property
owners not previously served and which can now be actually served by

the force main. The spread of this item is based on the percentage of
lot area served. Those lots connected to the force main before it was
purchased and those now provided with a gravity flow lateral were not
included in the force main purchase cost spread. With the exception of
the force main purchase cost, incidental expenses for this project were
. spread on the basis of 70% assessable lot frontage and 30% lot area.
Incidental expenses amounted to $16,726.10 and include water service
relocation/adjustment, engineering, inspection, construction staking,
sale of bonds, publishing, recording and purchase of title reports.

Staff has met with both property owners which had presented written
protests at the meeting on April 1, 1980. Both of these property
owners are in agreement with the new assessment spread.

A letter was sent to each property owner itemizing the original
assessment cost and the proposed revised assessment cost. Property
owners have also been advised that, at this public hearing, Council
may hear written appeals/objections or protests concerning their
revised assessment spread.
The written appeals, objections or protests shall be read aloud and
all persons present given the opportunity to hear and be heard.

Section 5367 of the Streets and Highways Code gives the City Council
the authority to order any work completed in accordance with plans
and specifications, order that the assessment or diagram be modified
or corrected, or revise and correct any of the acts or determinations
made by the City Engineer.

A transparency is available for Council viewing which shows the
district, property identifications, and assessments given to the
various property owners.

A PUBLIC HEARING ON THE ASSESSt1ENT SHALL BE HELD IN THE CHULA
VISTA COUNCIL CHAMBERS ON April 1 , 1980 at 7:00 P.M. All
persons interested in protesting the completeness of the contract,
correctness of the assessment diagram, or the performance of
the work shall submit in writing to the City Clerk no later than
the day prior to the public hearing, any protests. Any objections,
appeal or protest not made at the time and in the manner herein
above provided shall be deemed to be waived voluntarily by any
person who might have made such appeal, protest or objection.
(Section 4366, Streets and Highways Code).
