Approving Encroachment Permit No. 80-6 allowing Daniel Vera to place a concrete slab and construct a wooden deck within City's sewdr easement at 1587 San Mateo Point Court SUBMITTED BY: City Engineer~ (4/5ths Vote: Yes No~) Mr. Vera has requested to encroach into the 10-foot sewer easement which lies adjacent to his southerly property line in order to install ground- level concrete decking'and construct a second-story wooden deck which will extend approximately 3 feet into the easement. It is my RECOMMENDATION: That Council approve subject Encroachment Permit. BOARD/COMJ'lISSION RECOMMENDATION: Not applicable. DISCUSSION: Recently, Mr. Vera applied for a Building Permit to construct subject improvements upon his property. As he was processing the permit through the Engineering Department, it was discovered that there is a 10-foot sewer easement along his property line approximately 4 feet from the house. Mr. Vera was advised that an Encroachment Permit would be required to build the improvements as planned. He was informed and fully understands that, in the event of needed repairs to the sewer main in the easement, his improvements will have to be removed at his expense. In accordance with Chapter 12.28 of the Chula Vista Municipal Code, Mr. Vera submitted a letter of request and paid the application fee for the Encroachment Permit. The depth of the 8-inch sewer main wi thin his property averages' 11 to 12 feet, therefore the possibility of damaging the pipe is minimal. There are no manholes within this easement. Access to the sewer is available through a manhole in San Mateo Point Court and a second manhole 75 feet from the easterly property line. The second level wooden deck encroaches only 3 feet into the easement and the supports do not fall directly over the sewer. Based on the findings stated in this report, I recommend ment be granted subject to standard conditions.
