CITY PLANNING COMMISSION OF
CHULA VISTA, CALIFORNIA
March 12, 1975
A regular meeting of the City Planning Commission of Chula Vista, California
was held on the above date beginning at 7:00 p.m. with the following members
present: Chandler, Rudolph, Rice, Starr, Floto, Pressutti and Smith. Also
present: Director of Planning Peterson, Current Planning Supervisor Lee,
Assistant City Attorney Beam and Secretary Mapes.
The pledge of allegiance to the flag was led by Chairman Chandler followed by
a moment of silent prayer.
APPROVAL OF MINUTES
MSUC (Rudolph-Starr) The minutes of the meeting of February 26, 1975 be
approved as written.
1. PUBLIC HEARING (Cont.): Conditional Use Permit PCC-75-2 to construct
Insurance Office and Visitor's Information Center in Flood
Plain, northwest quadrant of Bonita Road and I-805,
Creaser-Price Insurance Agency, Inc.
2. Consideration of Precise Plan for development of property in C-V-P-F zone
at northwest quadrant of Bonita Road and I-805, Creaser-
Price Insurance Agency, Inc.
Director of Planning Peterson reported that since there are still a number of
questions to be resolved in connection with this project, it is recommended that
the public hearing and consideration of precise plan be continued to the meeting
of March 26.
MSUC (Rice-Floto) The public hearing on PCC-75-2 and consideration of precise
plan be continued to the meeting of March 26, 1975.
3. Consideration of request for Lozano Annexation of one lot on north side of
Via de Laurencio at Claire Avenue
Director of Planning Peterson advised this is a routine annexation which would
extend the city limits by one lot. All City departments indicated there would
be no problem in providing services to this property. It is recommended that
the Planning Commission approve the boundaries and direct the staff to file the
annexation petition with LAFCO.
Commissioner Smith raised a question regarding the propriety of annexing one
lot at a time. He noted there are a dozen lots in that vicinity that could be
annexed one at a time. He asked if there is any policy on minimum size of an
annexation.

Mr. Peterson advised that it apparently has been the City's policy to process
each annexation petition as received. He confirmed there are fees which must
be paid by an applicant.
MSUC (Smith-Rudolph) The boundaries of the Lozano annexation be approved and
the staff directed to file the annexation request with LAFCO.
4. PUBLIC HEARING (Cont.): Rezonin.g PCZ-74-M - Approximately 40 acres on north
side of Telegraph Canyon Road from R-1 and R-3-T (conditional)
to R-1-5-PUD
Director of Planning Peterson noted that this hearing has been continued numerous
times since the rezoning was initiated. He pointed out that a number of years
ago the City Council indicated a willingness to rezone a portion of the property
to R-3-T upon approval of a precise plan. For the past year the owner has ex-
plored various PUD plans but has now indicated a desire to develop the entire
property with detached single family homes. It is therefore recommended that
the R-3-T zone designation be eliminated and that the Council adopt an ordinance
clarifying the zoning of the entire 40 acres as R-1.
Commissioner Rudolph questioned if the Environmental Impact Report adopted last
year on proposed development of the property is effective for this rezoning so
that the BCA/HUD memorandum of understanding which was included in the report
is still effective.
Assistant City Attorney Beam advised that an EIR is an informal document to
provide information and it does not bind anybody contractually one way or
another; if there is a withdrawal from the HUD program by the developers of
the property, that would not have any effect on the EIR, per se.
The Chairman declared the public hearing open but as no one wished to speak, the
public hearing was closed.
MSUC (Floto-Pressutti) Recommend to the City Council the rezoning of the 29
acres of property located north of Telegraph Canyon Road, west of Nacion, from
R-3-T (conditional) to R-l.
5. PUBLIC HEARING: Variance PCV-75-3 - Request to use temporary buildin9 as
bank facility at 826-832 Third Avenue in C-C zone, San Diego
Federal Savings and Loan Assn.
Current Planning Supervisor Lee indicated the location of the property on the
west side of Third Avenue and noted the adjacent commercial zoning and use on
three sides with R-3 zoning and apartments to the west of this site. He pointed
out that the variance is required in order to locate a temporary commercial
coach on the front portion of the property, about 15 feet from Third Avenue,
to be used as a bank facility during construction of the permanent building
just west of the parking provided for the temporary building. He noted the
exterior treatment proposed for the coach which will insure architectural
compatibility wi th adjacent structures.
This being the time and place as advertised, the public hearing was opened. As
no one wished to speak the public hearing was closed.

MSUC (Starr-Smith) The Commission finds that in accordance with the Negative
Declaration as submitted, the San Diego Federal Savings and Loan bank facility
at 826-832 Third Avenue will not have any possible significant impact on the
environment, and certifies that the Negative Declaration has been prepared in
accordance with CEQA 1970, as amended.
I! discussing the recommended conditions for approval of the variance, Com-
missioner Smith questioned the last condition which requires that development
plans for the permanent facility be submitted and approved within one year. He
felt the words "and approved" should be deleted from this condition.
Mr. Lee advised that a representative of the applicant had just arrived at the
meeting and could be asked to comment on the conditions.
Bill Krommenhoek, architect representing San Diego Federal, advised that he had
read the recommended conditions and found no problem with them.
MSUC (Starr-Rice) Conditional use permit PCV-75-3 be approved based on the
findings as stated in the staff report, and subject to the following conditions:
a. Prior to the issuance of any permits, a Plat Adjustment Map shall be approved
for the consolidation of the two existing parcels.
b. Prior to the issuance of any permits, a landscaping and irrigation plan shall
be submitted for review and approval.
c. All onsite utilities shall be underground.
d. The commercial coach shall meet the requirements of Chapter 42 of the
Uniform Building Code.
e. Within one year from the effective date of this variance, development plans
for the permanent facility shall be submitted and approved.
Commissioner Smith pointed out that on the proposed plot plan for the permanent
facility, two spaces are indicated as being for paraplegics; he suggested they
be for any kind of handicapped person which is not as specific as paraplegic.
The architect indicated concurrence with this suggestion.
6. PUBLIC HEARING (Cont.): Consideration of amendment to Zoning Ordinance
relating to Precise Plan requirements
Director of Planning Peterson pointed out this amendment accomplishes two things
in that it spells out the desired content of a precise plan in some detail, and
secondly, it eliminates a confusing duplicity in the ordinance by deleting the
definition and requirement for a site plan. Mr. Peterson pointed out that under
the proposed amendment a developer would have the discretion of submitting
complete precise plans with the initial application, or he could submit a pre-
liminary plan at that time in order to get approval of the zoning, and then
submit precise plans in phases when he was ready to proceed with development of
the project.

Commissioner Pressutti commended the staff on the report for this proposed
- amendment and indicated his agreement with the proposed changes except for
the provision that the Planning Commission reviews and forwards a recommenda-
tion to the City Council who will assume authority for approving or denying
the plan. He felt this authority should remain with the Planning Commission
except in the event of appeal from their decision.
Commissioner Starr also expressed the opinion the report was well done and
easily read and understood. He asked if this revision would affect property
which presently has the "P" Modifying District attached.
Mr. Peterson indicated that if such property has not been developed, the revised
procedure would be followed in approving development plans. If the property is
developed, there would be no occasion for further plan approval.
The Chairman declared the public hearing opened, but as no one wished to speak,
the public hearing was closed.
Commissioner Rice expressed opposition to the provision making the Planning Com-
mission a recommending body. He felt that should be deleted from the proposed
amendment recommended to the Council, and if the Council wished to insert that
provision, that is their prerogative.
Commissioner Smith called attention to the 16 requirements for the preparation
of a precise plan, and raised objection to No. 16, which states "Such other data
as may be required by the Director of Planning, the Planning Commission, or
~ City Council." He felt that requirement is too broad and uncertain.
Mr. Peterson felt that section would not often be used, but pointed out it is
difficult to foresee all of the circumstances that might arise which would re-
quire the submission of special data, due to the topography or some physical
aspect of the property.
Assistant City Attorney Beam requested that if the Commission determines to
forward this proposed amendment to the City Council that it be sent to the
City Attorney's office for rewording of the section which provides the findings
that must be made in approving or denying a proposed precise plan. He apologized
that the heavy workload of the Attorney's office in recent weeks had precluded
their study and provision of input in this regard, which he feels is necessary.
Commissioner Rudolph advised she would prefer to know the exact wording of the
amendment to be forwarded to the City Council before acting on a recommendation.
Commissioner Smith reported there are a number of points with which he is not
satisfied and expressed his desire to prepare some written comments for Commission
and staff consideration prior to Commission recommendation on a proposed
amendment.
MSUC (Rice-Rudolph) The public hearing for consideration of an amendment to
the Zoning Ordinance relating to Precise Plans be reopened and continued to the
meeting of April 9, 1975.

ORAL COMMUNICATIONS
Ed D'Lugo, 211 East Millan, advised that he had just arrived at the meeting and
would like to know the Commission action taken on agenda item 4.
Chairman Chandler advised that the Commission adopted a motion to recommend to
the City Council the rezoning of the property to R-1.
DIRECTOR'S REPORT
Mr. Peterson called attention to the notice of the monthly dinner meeting of
the League of California Cities to be held in Oceanside on April 20th.
He confirmed that the study session on March 19th will convene at 5:00 p.m. and
be followed later by dinner. Such meetings are usually held in the Council
Conference room, but the Council has scheduled a conference meeting for 4:30 on
that date, so the Planning Commission will probably utilize the smaller confer-
ence room next to the Planning Department offices.
Assistant City Attorney Beam reported that the City Council, on the previous
night, requested a conference with the Environmental Control Commission and
Environmental Review Committee regarding the environmental review procedure.
The date of the conference has not been set, but he felt the Planning Commis-
sion would also be welcome at that conference so the Commissioners will be
advised when the date is set.
COMMISSION COMMENTS
Commissioner Rudolph asked that final copies of such items as General Plan
Elements and procedural policies be supplied to the Planning Commissioners,
since there may have been some revisions from the recommendation made by the
Commission.
Mr. Peterson advised that notebooks containing all of the General Plan Elements,
map, and Zoning Ordinance are being prepared for each Commissioner and will be
distributed in the near future.
