(4/5ths Vote: Yes NO-L) As a result of recent State legislation, a developer of low or moderate income housing within a PUD t10difying District may have the potential to realize a "double density bonus" amounting to a 50 percent increase over the density otherwise allowed in the under1yi ng zone. 7/1/80 RE COM MEN DA TI ON: Tha t Co un ci 1 : Adopt a resolution amending the City's Planned Unit Development Policy by adding thereto Subsection 8 (b), to read as follows: "Notwithstanding the provisions of this section, in no case shall the density allowed by a combination of this and other density incentive plans exceed the Maximum Density Allowed under the PUD Modifying District, as indicated in the table above." Assembly Bill 1151 (October 1979), which added Section 65915 to the Government Code, provides that when a developer of five or more dwelling units agrees to construct 25 percent of the units for low and moderate income households, a City shall enter into an agreement with the developer to either grant a density bonus of at least 25 percent over that otherwise allowed by the underlying zone, or provide not less than two other bonus incentives for the project. Inc1 uded under "other bonus incentives" are exemption from park land dedication or in lieu fees, city construction of appurtenant public improvements, 1 and cos t subsi dy, and/or exempti on from other 1 oca 1 ordinances whi ch may cause an indirect increase in the cost of housing. 2. The City's Planned Unit Development Policy also contains a density bonus provision applicable to developments within single family zones c"oVered by the PUD Modi'fying District. This density bonus may be allowed only in cases where the Commission and Council determine that public facilities are adequate to serve the additional units, that the project will be compatible with existing and potential uses within the surrounding area, and that the density bonus will produce a beneficial effect which could not be achieved under standard zoning. The Policy establishes specific maximum allowable densities which are approximately 25 percent above the base density for each of the several single family zones. The amount of density increase granted between the base and maximum allowable densities is in proportion to the number of "density incentive features" incorporated into the project, including additional open space and improvements, dedication of land for public use, provision of a mixture of housing types, imaginative landscaping, and senSitivity in grading and slope treatment. The density bonus available under the PUD development concept is predicated upon the encouragement of imaginative and exceptional site planning and development, while insuring project compatibility with the existing and intended character of the area, and compliance with the basic intent of the underlying zone regulations. With the enactment of AB 1151, a developer of low and moderate income housing within a PUD Modifying District now has the potential to realize a "double density bonus" contrary to the purpose and intent of this policy. CONCLUSION The separate density bonuses potentially available under AB-1151 and the P'Jf) Policy are acceptable as they may apply to separate projects. However, neither the PUD Policy nor AB-1151 contemplated a double density bonus, and such a bonus is not appropriate.
