(4/5ths Vote: Yes_No x) The City Council has recently completed a street beautification project on Third Avenue between "E" Street and "F" Street. This project cost nearly $800,000 and included new decorative street lights, drainage improvements, street furniture, trellises, landscaping, and decorative sidewalks ~nd crosswalks. The City was agreeable to maintain the normal street improvements, i.e. pavement, normal lighting expenses, street sweeping, and tree trimming just as is the policy citywide. However, the Council directed staff to create a District so that the people in the area would pay for the maintenance of the additional items: landscaping, special street furniture and additional street lighting energy costs. It is my RECOvMENDATION: That Counci 1: 1. conduct ~ublic hearing; 2. take appropriate action on protests; 3. adopt budget for the District; 4. direct staff to prepare a Redevelopment Agency resolution appropriating $6000 as a loan to the District; 5. approve resolution forming the District and levying assessments; 6. approve resolution awarding contract for Landscape Maintenance, Third Avenue "E" to "F" Street. BOARD/COMMISSION RECOMMENDATION: The Town Centre #1 Project Area Committee has recommended an assessment district levied against property owners to be used to finance the maintenance. ! The purpose of the hearing is to hear written and oral protests to tbe District. Any interested party may speak but the only protests that are legally significant are from property owners. The party should state the parcel that he owns and his particular protest. Formation of the District as well as individual assessments or particular items in the budget are appropriate items to protest. At the conclusion of public testimony, a tabulation should be made of the protests by property owners. If a majority protest exists the proceedings shall be abandoned unless by a 4/5 vote of the Council, the protests are overruled. A majority protest exists if written protests filed and not withdrawn represent property owners owning more than 50 percent of the area of assessable lands within the proposed District. The Council has the authority, without further notice, to modify individual assessments and delete items of expenditure from the District. Special Appropriation: Since funds will not be received until December 1980, it will be necessary for the City or Agency to loan the District $6000 to cover expenses during the first six months. The funds could come from the unappropriated balance of either the Bayfront or Town Centre Bond Fund or the General Fund. I recommend the Bond Fund. If Bond Funds are used the Agency will need to approve the loan at their next meeting. Assessments. The attached plats illustrate the proposed assessments for each parcel. The parcels south of the improvement project are being charged a small amount. This amount is based upon the costs of formation of the District. As that block is improved, in the future, their assessments will increase appropriately. Mr. Rossetti, the City's consultant Assessment Engineer, will be present to answer questions on the method of spreading assessments and specific assessments. On May 28, 1980, bids were opened for maintenance of the landscaping. Bids were as follow~: NA\1E AMJUNT Mazon Landscaping Inc. Cal Scape Casady Construction C. A. Redden A.G.Z. Landscaping Environmental Care 9,540 13,622 16,600 18,844 20,300 20,490 . . . I recomnend that the contract be awarded to Mazon La;'dscaping Inc. in the lli~ount of $9540. With contract contingencies the total contract cost is estimated to be $10,500. Cost for street lighting was estimated to be $3600 per year. The cost of the previous lighting system was $3000 per year. Therefore, the District is being charged the additional cost of the new system, $600. Additional costs have been charged for landscaping as follows: Irrigation materials Planting materials Special plantings Water and electricity (irrigation) $ 300 500 250 200 TOTAL $1250 In addition an amount totaling $3150 is being charged for reimbursement and contingencies. This will be used to pay a portion of costs'for Assessment Engineer; to pay the City for the maintenance period prior to establishment of the District; to pay for miscellaneous extra expenses not anticipated at this time; and to create a reserve so that eventually the District will not need to borrow funds from the City or Agency for part of the year due to late receipt of property tax revenues. In order to establish and operate the District a budget needs to be adopted. The budget is attached and I recomnend that it be approved by minute action.
