On February 5, 1980, by Resolu~4~n No. 9944 Council approved the Tentative Map for Parkway
Place Subdivision. On June 3, 1980, Council requested Engineering staff to return with a
lien agreement to cover the cost of drainage improvements which the development is required
to install. The Final Map and lien agreement are before Council for approval. It is my

DISCUSSION:
The Final Map for Chula Vista Tract No. 80-8, Parkway Place Subdivision, has been checked
by the Engineering Department and found to be in conformity with the Tentative Map. At
the time of approval of the Tentative Map, Council indicated a desire to see the improve-
ment plans for the drainage facilities at the time of consideration of the Final Map (all
other improvements adjacent to the site are existing and in good condition). The plans
were forwarded to each of the Council members on March 26, 1980, because the owner was
anxious to begin construction. A permit was issued for this construction on April 3,
1980, and the work has almost been completed. The Final Map includes the granting of an 'I
easement for drainage purposes. I
One of the conditions of approval of the Tentative Map requires the developer to be
responsible for the cost of certain drainage improvements which are to be constructed
in conjunction with a City project. The developer was to post a cash bond deposit with
the City prior to approval of the Final Map to cover the cost of these improvements.
At the June 3, 1980, Council meeting the developer requested that an agreement providing
for the deferral of this deposit be prepared and executed. His desire was that payment
be deferred long enough to allow the payment to be made out of the proceeds of the sale
of one or more homes to be built upon the lots being created. Council agreed to the devel-
oper's request. The lien agreement provides that each of the four lots share equally
in the lien amount of $21,808.00. Consequently there will be a lien against each lot
in the amount of $5,452.00. The agreement also stipulates that interest will be charged
at a rate of 8% per annum. (This rate is the same rate the City presently receives for an
Assessment District~' In addition, the agreement stipulates that no deed for any lot can
be recorded prior to payment to the City of the lien amount against said lot.

Parkway Place Subdivision. The Final Map is now before Council for approval. It is my

RECOMMENDATION: That Council adopt resolution.
BOARD/COMMISSION RECOMMENDATION: Not applicable.

April 3, 1980, and the work has almost been completed. The Final Map includes the
granting of an easement for drainage purposes.
One of the conditions of approval of the Tentative Map requires the developer to be

in conjunction with a City project. The developer was to post a cash bond deposit with
the City prior to approval of the Final Map to cover the cost of these improvements.
Dean T. Bowden, the subdivider, has requested an agreement providing for the deferral
of this deposit be prepared and executed. His desire was that payment be deferred long
enough to allow the payment to be made out of the proceeds of the sale of one or more
homes to be built upon the lots being created. The agreement submitted for approval
provides a 60 day period for the posting of the deposit. The map would not be released
for recordation until the deposit is received. The amount of the deposit is $21,808.00.
The dollar amount is based on actual bid prices for the City project which is currently
under construction.
This resolution requiring the payment of the fees within sixty days will not meet the
needs of the developer but is in conformance with the past actions that Council has taken
in similar cases. The developers of Palo Del Amo Woods requested a similar deferral of
park .fees until sale of his first unit. The Council did not approve that request. The
developer has indicated a desire to address the Council on this matter and will be present
at the meeting.
