Creek for architectural services for the Glenn Restaurant and appropriating funds therefor SUBMITTED BY: Assistant City Manager ~ (4/5ths Vote: Yes X No_) The City Council accepted design phase 3 at their meeting of May 27, 1980. The archi- tect is now ready to move into. the design development and construction document phase. It is my RECOMMENDATION: That Council adopt the resolution approving this agreement. BOARD/COMMISSION RECOMMENDATION: N.A. DISCUSSION With Council's acceptance of schematic design 3, the architect is now ready to proceed with the second and third phases for remodeling of the Glenn Restaurant. The contract provides fora maximum of 60 days from the date of execution of the contract to have the subject project ready for bid. The architect is confident that he can complete plans and specifications in advance of the 60 day time limit. Total compensation for the services provided will not exceed $20,000. The architect and one subcontractor, Herries' Mechanical and Electrical Engineers, will be working against a $17,000 budget, with payment up to this amount based upon the time spent on the project. Construction Engineers, Burkett and Wong, will be working against a flat maximum fee of $3,000. The $20,000 total maximum fee includes all work con- templated under the design development construction document and construction inspection phases. Compensation provided in the agreement requires the architect and his sub- contractors to make a minimum of two on-site inspections during the course of re- modeling. It is anticipated that the City will take primary responsibility for in- spection and administration of the construction contract. FISCAL IMPACT No funds have been appropriated to pay for either architectural or renovation costs of this project. A special appropriation as a loan from the General Fund to the Golf Course fund in the amount of $20,000 will be required as a part of contract approval. $3,500 had heretofor been appropriated and expended .f or the schematic design archi- tectural contract. Professional Engineer (Structural) $35/hr. All of the foregoing hourly rates shall be prorated to the neartest tenth of an hour for billi ng pur poses. B. The total amount of compensation and reimbursable expense during the term of this agreement shall not exceed in any event the sum of $20,000. C. Payment to Architect for professional services 'and other expense incurred shall be made monthly after receipt of an itemized billing prepared by Architect setting forth the services rendered together with the professional that rendered said services. All reimbursable expenses shall be set forth in the itemized billing. D. Architect's records of the time spent in fulfilling the provisions of this agreement by his personnel or consultants employed by Architect to fulfill the provisions of this agreement, as well as items of reimbursable expenses, shall be made available for examination by City personnel within a reasonable time follaviny a request to examine said records. E. It is understood and agreed that the maximum com- pensation and reimbursable expense during the term of this agreement for Architect shall not exceed NINE THOUSAND DOLLARS ($9,000), and the maximum compensation for services of Herries & Associates, Mechanical and Electrical Engineers, shall not exceed EIGHT THOUSAND DOLLARS ($8,000). It is further understood and agreed that for the services of Burkett & Wong, Structural Engineers, a flat fee of THREE THOUSAND DOLLARS ($3,000) will fully compensate said structural engineers for services provided, subject to the conditions contained herein. It is further understood and agreed that Architect's fee provided herein is for services for the renovation of the interior and exterior of the building including relocation of rest rooms, new partitions, etc., but shall not include responsi- bility for fixturizing the facility. lUiz3 F. Architect's subcontractor, Herries & Associates, for the maximum fee provided herein, shall make a minimum of two on-site inspections accompanied by designated City personnel. 3. Architect shall submit to the Assistant City Manager for approval drawings that clearly show the final pro- posed floor play layout and exterior alterations prior to proceeding with final construction drawings and specifications. 4. All original drawings and specifications shall become the property of the City and may be used by the City without payment of further compensation. 5. Architect shall indemnify and hold the City harmless of and from all claims; demands, losses and liability including legal fees to the extent the same are the result of error, omission or negligent act of Architect or any person employed by Architect. Architect further stipulates that he is and shall remain during the course and scope of this contract an independent contractor for all purposes including, but not limited to, tort liability arising through injuries to the person or property of a third person, withholding of Federal and State income taxes, etc. 6. Term of Contract - Architect shall complete all the work required on or before the sixtieth day from which date of our City Council approves this contract. 7. Special Conditions - City and Architect agree that the following conditions shall apply: A. The fees provided for in this agreement are payable for the services described but are not contingent upon any actual construction. B. Architect shall supply one copy of final reproducible plans and final specifications. City will provide necessary copies for checking and required copies for the bidding process. C. No plan check fees, if any, are included in Architect's proposal. D. All services provided herein shall be regarded as 1000 complete when final plans and specifications have been approved by the City's Building Department provided, however, the Architect and his subcontractors are responsible for the work provided for during the construction supervision phase. /~ i ~3 E. The fees specified are for the work contemplated, developed and approved during the schematic design phase and any changes which affect the scope of the work are considered outside this agreement.
