The attached authorization for encroachment has been submitted pursuant to the Owner
Participation agreement executed on November 2, 1978 between the Chula Vista Redevelopment
Agency and Bay Boulevard Corporation. In accordance with this agreement the "Agency
agrees to request (that the) City under terms of the Redevelopment Plan to permit Developer
(Bay Boulevard Corporation) to encroach upon Bay Boulevard from "E" Street north to the
terminus of said street." Public utility easements are to remain and no permanent structure
is allowed to be built within the Right-of-Way. The Developer, under the same agreement,
will maintain the property and will allow maintenance vehicles to service public utilities.
The proposed encroachment is in accord with the adopted Bayfront Redevelopment Plan.
Therefore, it is my
RECOMMENDATION: That the Council
Boulevard Corporation to encroach
in accordance with conditions set
approve subject encroachment permit permitting the Bay
upon that portion of Bay ,Boulevard therein described
forth within this report.

Under provisions of the Bayfront Redevelopment Plan adopted in 1974 the subject portion
of Bay Boulevard was to be abandoned and sold to the adjoining property owner. The
intention was to avoid the development of an excessively long cul-de-sac. However,
there are two properties involved, each under different ownership. In the absence of
common ownership it is impossible to vacate the entire street right-of-way without
eliminating access to the northernmost parcel.
In 1978 the Bay Boulevard Corporation, owners of the property located at the northeast
corner of Bay Boulevard and "E" Street, proposed to lease the adjacent acreage to the
north and develop both parcels with a Ramada Inn complex. The plan also proposed the
utilization of the abutting Bay Boulevard right-of-way. Since the right-of-way would
provi de access to both parcels under the proposed plan, it was the Agency's wi sh to
permit encroachment for the duration of the 67 year lease. The street will revert back
to a public way upon termination of the lease agreement.
I recommend that Council approve the subject encroachment permit conditioned upon the
foll owi ng:
1. The encroachment permit shall expire 67 years after date of issuance.
2. Subject portion of Bay Boulevard shall be restored by Permittee to a public street
upon ex pi rati on of the permit.
3. Existing overhead uti~ities on the west side of Bay Boulevard shall be converted to
underground as agreed upon by the Redevelopment Agency of the City of Chula Vista
and Permi ttee.'

4. Existing storm drain facilities within the subject portion of Bay Boulevard, or as
modified by construction of new improvements, shall be maintained by Permittee.
5. Access by the City to any pub 1 i c sewer withi n the encroachment area sha 11 be provi ded
throughout the life of this permit.
6. An improvement plan showing all construction (surface and underground) shall be
submitted to the Engineering Department on its standard plan/profile mylar sheet(s).
This plan shall be prepared by a registered civil engineer.
7. Insurance requirements as noted in Section 12.28.090 of the Chula Vista Municipal Code
shall be met by Permittee.
A transparency is available for Council viewing.
