The owner of Harvey's Bakery nas recently applied for a building permit to remodel the
interior of the lease space in an existing building at 333 Third Avenue. This work is
valued in excess of $20,000.00 and this constitutes a requirement to underground the
existing overhead utility services. The Council, at its meeting on May 7,1980, adopted
Resolution 10082 setting May 27, 1980, at 7:00 p.m. as the date and time for this public
hearing. It is my
RECOMMENDATION: That Council
1. Consider subject request and
2. Approve Mr. Houtkamp's request for subject deferral.
BOARD/COMMISSION RECOMMENDATION: Not applicable.
DISCUSSION:
Presently, Mr. Al Houtkamp, owner of Harvey's Bakery, is being assisted by the Community
Development Department in relocating his business from its existing location at 328 Third
Avenue to another existing building at 333 Third Avenue. In order to conduct his business,
extensive interior modifications are necessary within his lease space.
According to Section 12.24.060 of the Municipal Code, any building permit for construction
valued at more than $20,000.00 constitutes a requirement to place existing overhead
utility services underground. However, Section 15.32.050 provides that the City Council
may vary from or defer these requirements if evidence is shown that the following facts
exist:
1. That extraordinary conditions exist to the extent that enforcement of this requirement
would result in unnecessary hardship to the owner.
2. That such deferral will not, under the circumstances of the particular case, be
detrimental to the health, safety or general welfare of the neighborhood.
Due to the fact that the Redevelopment Agency has purchased the property on which the
bakery is now located and the business must be moved, enforcement of the undergrounding
requirements would place an undue financial burden upon the business owner.
Mr. Houtkamp is leasing one part of the existing building. No other space is being affected
by the remodeling. The other tenants in the building are served by overhead utilities at
the same point as the proposed bakery. The utility pole from which the services are taken
is in the alley behi~d the building and is not readily seen by the general public. There-
fore, undergrounding the one .service to the bakery would.have little visual impact on the
existing conditions. It would be desirable to underground this service as part of the
formaiion of an overall undergrounding district. . ~
