That purchase included all of the lots surrounding Research Court. The plans for development of the property do not require a dedicated street and SDG&E has requested that the City vacate all of Research Court. RECOMMENDATION: The City Council Research Court. BOARDS/COMMISSIONS RECOMMENDATION DISCUSSION: adopt a resolution summarily vacating IJot applicable. In 1984, Sammis Properties subdivided its 40-acre parcel on the west side of Maxwell Road north of Otay Valley Road. The subdivision, known as Otay Valley Industrial Park, contained 19 lots and two dedicated cul de sacs, Design Court and Research Court. After the time the map was recorded and before development work on the site had been completed, San Diego Gas & Electric Company (SUG&E) purchased Lots 11 through 19 of the subdivision. (See Exhibit "A", attached.) SDG&E plans to construct a regional service center on the property. Consequently, it is consolidating the lots by parcel map and has requested that the City vacate all of Research Court. The street improvements proposed for Research Court were not constructed, and the street was never used for public vehicular traffic. Chapter 4, Article 1, Section 8334 of the State of California Streets and Highways Code states: The legislative body of a local agency may summarily vacate any of the following: a. An excess right-of-way of a street or highway not required for street or highway purposes. Page 2, Item Meeting DateT/~78~ b. A portion of a street or highway that lies within property under one ownership and that does not continue through such ownership or end touching property of another. Referring to Exhibit "A", note that Subsection 8334(b) applies in this case, as all the lots are under the ownership of SUG&E. All utility companies have been advised of the proposed vacation and have responded. Otay Water Uistrict has requested that the City reserve the entire portion of Research Court for its facilities currently in place. The remaining utility companies have no objections. The legal description of the proposed vacation includes a reservation of an easement to Otay Water District covering the entire street right-of-way. The Planning Department staff has reviewed the proposed vacation and has no objections. A transparency is available for Council viewing. FISCAL IMPACT: None. JWN/mag PVO11 WPC 2212E LEGAL DESCRIPTION FOR VACATION OF RESEARCH COURT That portion of Research Court, lying within Chula Vista Tract No. 81-6 Otay Valley Industrial Park, in the City of Chula Vista, County of San Diego, State of California, according to Map thereof No. 10974, filed in the office of the County Recorder of said County of San Diego on June 21, 1984, described as follows: Beginning at a point in the southerly boundary of said Research Court, said point also being the northeast corner of Lot 12 of said Map No. 10974; thence along the southerly boundary of said Research Court as follows: N88°57'03"W 358.37 feet to a point of tangency; thence through a curve to the left of radius 92.00 feet and a central angle of 12°23'54" a distance of 19.91 feet along the curve, to a point of tangency; thence 878°39'03"W 50.00 feet to a point of tangency; thence through a curve to the right of radius 48.00 feet and a central angle of 204°47'48" a distance of 171.57 feet along the curve to a point of tangency, said point being on the northerly boundary of said Research Court; thence along said boundary S76°33'09"E 50.00 feet to a point of tangency; thence through a curve to the left of radius 92.00 feet, and a central angle of 12°23'54" a distance of 19.91 feet along the curve to a point of tangency; thence S88°57'03"E 361.11 feet to a point of tangency; thence through a curve to the right of radius 534.00 feet, and a central angle of ° ~ ~~ 23 40 06 a distance of 220.59 feet along the curve to a point on the northwesterly return of Research Court and fdaxwell Road, said point also being a point of reverse curve; thence through a curve to the left of radius 22.00 feet and a central angle of 81 04 10 a distance of 31.13 feet to a point on curve in the westerly boundary of Maxwell Road, from which the radial point bears N56°21'07"W; thence southerly along said curve marking the westerly boundary of Maxwell Road, and having a radius of 434.00 feet, through a central angle of 14°07'04", a distance of 106.94 feet to a point, said point also being a point on the southwesterly return of Research Court and Maxwell Road; thence leaving the westerly boundary of Maxwell Road, northwesterly along the curve on the southwesterly return, having a radius of 22.00 feet and a central angle of 85°17'06" a distance of 32.75 feet to a point on curve, said point also being on the southerly boundary of Research Court; thence westerly along said curve having a radius of 466.00 feet and a central angle of 23°11'46" a distance of 188.66 feet to a point of tangency; thence N88°57'03"W 2.74 feet to the point of beginning. Reserving therefrom the following easement: T0: Otay Water District Reserving and excepting from tP~e vacation and abandonment easements and rights to Otay Water District to construct, maintain, operate, replace, remove, or enlarge water facilities and appurtenant structures together with the right to ingress and egress to protect the property from all hazards in, under and upon the following described lands: ALL THAT PORTION OF RESEARCH COURT AS DESCRIBED ABOVE.
