Resolution in Opposition to Proposition 23: California Jobs Initiative
Proposition 23, The California Jobs Initiative was placed on November's ballot by opponents of AB 32.
The proposition would suspend enforcement of AB 32 regulations requiring reduced greenhouse gas
emissions that cause global warming, until California unemployment falls below 5.5 percent or less for
four consecutive quarters. Unemployment stands at 12.4 percent as of May. Passage of Prop 23 would
require the State to abandon implementation of comprehensive greenhouse-gas reduction programs that
include increased renewable energy and cleaner fuel requirements, and mandatory emission reporting
and fee requirements for major polluters such as power plants and oil refineries, until suspension is
lifted.
California's state pollution laws, such as the landmark clean energy law, AB 32, are fundamental to the
growth that California is experiencing in clean energy development. AB 32 provides the necessary
planning target for reducing harmful emissions from transportation, our built environments and
electricity generation, as well as reduces energy costs by fostering cost-effective energy efficiency and
new renewable technologies. So far, this target has attracted $9.1 Billion in private investment for clean
energy technology and created 500,000 green jobs. If it were suspended as proposed by Proposition 23,
private investment will significantly decrease and green jobs will leave California for other states and
countries, and we will not be protecting public health by reducing harmful air pollutants.
In keeping with our legislative priorities as spelled out in legislative programs adopted by Council, I we
would like to propose the following resolution in opposition to Proposition 23. I have also attached a
letter sent in May from the Energy Sub Committee to the Attorney General outlining our opposition to
any efforts to undermine AB32. This letter was sent prior to Proposition 23 qualifying and being
placed on the November ballot. Therefore our position needs to be clarified and restated regarding
Proposition 23.

RESOLUTION IN OPPOSITION TO
PROPOSITION 23 - THE CALIFORNIA JOBS INITIATIVE
WHEREAS, the City of Chula Vista employs an economically and environmentally sustainable
approach to establishing a broad range of environmental programs to restore and maintain the
environment, public health and quality of life for all our citizens; and
WHEREAS, the City of Chula Vista was the only City in the world with a population under 1 million to
be a founding member of ICLEI and the Cities or Climate Protection under the UN climate Framework
Convention; and
WHEREAS, through its CO2 Reduction Plan, Chula Vista committed to reducing Municipal and
Community greenhouse gas emissions to 20% below 1990 levels; and
WHEREAS, the City's most recent greenhouse gas inventory demonstrates that despite the City's
dramatic growth, Municipal GHG emissions have reduced 45% below 1990 levels and Community
emissions are "per capita," 27% below 1990 levels; and
WHEREAS, the City of Chula Vista "voluntarily" participates in programs that support AB 32 because
they contribute to the public health, safety and quality of life for Chula Vista residents; and
WHEREAS, there are no unfounded municipal mandates from AB 32 and the repeal of this bill will not
reduce the City of Chula Vista's costs but could change the willingness of environmental companies to
invest in California and Chula Vista to create the sustainable economy of the 21 st century; and
WHEREAS, this proposition would also destroy California's newly emerging clean energy businesses
that have flourished because of California clean energy and clean air laws; and
WHEREAS, since 2005, California green jobs have grown 10 times faster than the statewide average.
California's clean technology sector received $2.1 billion in investment capital in 2009 - more than five
times the investment in our nearest competitor - and is generating tens of thousands of jobs; and
WHEREAS, this proposition would halt the dynamic growth we've seen in clean energy businesses,
resulting in the loss of tens of thousands of jobs and billions of dollars in economic growth; and
WHEREAS, Proposition 23 formally opposes the landmark Global Warming Solutions Act of 2006
(AB32);
NOW, THEREFORE, BE IT RESOLVED that we hereby authorize the listing of the City of Chula
Vista in opposition to Proposition 23, the California Jobs Initiative and instruct staff to fax a copy of
this resolution to Attorney General Brown and other interested parties.

We are sending this letter on behalf of the City of Chu1a Vista to add our voice to the chorus of local jurisdictions
and businesses that oppose the Proposition to roll back implementation of California's landmark environmental
legislation AB 32.
The City of Chula Vista employs an economically and environmentally sustainable approach to establishing a broad
range of environmental programs to restore and maintain the environment, public health and quality of life for all
our citizens. Chula Vista was the only City in the world with a population under 1 million to be a founding member
of ICLEI and the Cities for Climate Protection under the UN Climate Framework Convention and through that
process the City has committed to reducing municipal and community greenhouse gas emissions to 20% below 1990
levels. The City's most recent greenhouse gas inventory (2008) demonstrates that despite the City's dramatic
growth, Municipal GHG emissions have reduced 43% below 1990 levels and Community emissions are "per
capita," 27% below 1990 levels.
Chula Vista understands that opponents are promoting a proposition that will suspend implementation of AB 32 and
kill California clean energy and air pollution control standards by prohibiting them from being enforced unless the
state's unemployment rate drops to a fIxed level that has rarely ever been achieved. The City further understands
that the advertisements have contained inaccurate and misleading information. Chula Vista "voluntarily,"
participates in programs that support AB 32 because they are common sense programs that contribute to the
economic development, public health, safety and quality life for Chula Vista residents. There are currently no un-
funded municipal mandates from AB 32 and the repeal of this bill will not reduce the City of Chula Vista's costs but
could change the willingness of environmental companies to invest in California and Chula Vista to create the
sustainable economy of the 21st century. This proposition would adversely affect California's newly emerging clean
energy businesses that have flourished because of the State's clean energy and clean air regulations that drive
investment in this industry. Since 2005, California green jobs have grown 10 times faster than the statewide
average. California's clean technology sector received $2.1 billion in investment capital in 2009 - more than five
times the investment in our nearest competitor - and is already generating thousands of jobs. Our community
understands that this proposition would halt the dynamic growth we've seen in clean energy businesses, resulting in
the loss of jobs and billions of dollars in economic growth and pursuant to the Chula Vista City Council legislative
agenda, the City formally opposes Attorney General Initiative # 09-0104. Furthermore, the City ofChula Vista
hereby authorizes the listing of the City of Chula Vista in opposition to the proposition currently established as
Attorney General Initiative # 09-0104.

letter today warning against any delay in the implementation of California clean energy policies.
A broad array of the nation's leading economists, including Nobel laureate Kenneth Arrow, a former
professor at Stanford University, disagree with those who support suspending implementation of emission
reduction policies. "Delaying action now," the letter states, "will be more costly than initiating action now."
"Postponing the implementation of California's 2006 law, the Global Warming Solutions Act, will make it
more expensive in the end for California to clean up our air pollution," said Michael Hanemann, Professor of
agricultural and resource economics and co-director of UC Berkeley's Climate and Energy Policy Institute.
"The Air Resources Board is pursuing a balanced and prudent approach that emphasizes increasing
our energy efficiency and reducing our dependence on imported fossil fuels that jeopardize our energy
security. Any delay in implementing the law would benefit some special interests while imposing a greater
burden on local governments."
The 118 economists who signed the letter, organized by the Union of Concerned Scientists, support AB 32
and the clean energy policies it requires, stating that these policies can "stimulate innovation and
efficiency," "help the state become a technological leader in the global marketplace," "improve our energy
security, create new business opportunities and more jobs," and "provide immediate benefits to the health
and welfare of residents by reducing local pollutants."

cleaning up pollution at the same time."
Signed into law in 2006, AB 32 requires the California Air Resources Board to implement clean energy
policies that require more energy efficient homes, buildings and vehicles; cleaner transportation fuels;
increased reliance on renewable energy; and reductions in carbon pollution. UCS supports the adoption of
effective standards to implement AB 32.

City Council support AB 1998 (Brownley - Single-Use Carryout Bags)
REQUESTED ACTION:
Respectfully request City Council support of AB 1998 (Brownley - Single-Use Carryout
Bags) and that our support be communicated to appropriate State officials.
BACKGROUND INFORMATION:
Each year, Californians use approximately 19 billion single-use plastic carryout bags.
These disposable bags cost up to 17 cents per bag for disposal. According to Don't
Trash California, state and local governments spend approximately $375 million every
year to clean up and landfill discarded plastic bags.
We can no longer recycle our way out of this problem. In the United States, less than 5
percent of plastic bags are recycled. The rest end up in our landfills or as litter, clogging
storm drain systems and making their way to our waterways and ocean. Countless
marine animals, including whales, turtles, birds and other wildlife are killed or injured
through ingestion of and entanglement in marine debris, which include an increasing
number of plastic bags.
Additionally, with over 380 billion bags being discarded every year, Americans waste
millions of barrels of oil and other fossil fuels used in the production of single-use bags.
SUPPORT FOR AB 1998 (BROWNLEY)
AB 1998 represents the latest legislative effort to encourage consumers to shift to
reusable bags from single-use bags. AB 1998 enjoys the support of the California
Grocers Association and the California Retailers Association in addition to several local

government entities and environmental organizations and has been praised by our
governor.
According to Assemblymember Brownley, AB 1998 will prohibit grocery stores and
convenience stores from providing single-use carryout bag to customers after 2012 and
2013 respectively. In lieu of single-use bags stores must make reusable bags and 40%
post consumer paper bags available for purchase by the customer.
CONCLUSION
AB 1998 may represent our best effort to reach a statewide approach to single-use
bags, especially considering Governor Schwarzenegger's recent press release
applauding this legislation. I respectfully request that we send our support for AB 1998
to the appropriate State officials. Thank you.

RESOLUTION 2010-
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA AUTHORIZING THE CITY COUNCIL TO SEND A LETTER OF
SUPPORT FOR ASSEMBLY BILL 1998 (BROWNLEY)
WHEREAS, the California Legislature finds that prohibiting the distribution of single-use plastic
carryout bags is necessary to reduce the environmental, public health, economic and societal
costs resulting from single-use production, use and discard. And,
WHEREAS, despite local and state efforts to minimize land-based sources of pollution, and
increasing efforts worldwide to protect water quality, the quantity of plastic pollution in the
world's aquatic environment is increasing. And,
WHEREAS, plastics made from bio-based sources that are marketed as "compostable" or
"biodegradable" are not environmentally sound alternatives to plastic carryout bags because they
have not been shown to degrade in aquatic environments. And bio-based plastics required
conditions only available in compo sting facilities to rapidly break down into constituents that
assimilate back into the environment. And,
WHEREAS, recycled content paper carryout bags are a high value recyclable that is collected in
curbside and community recycling programs in California. And,
WHEREAS, the environmental and economic costs posed by single-use bags are of statewide
interest and concern and the State should take action to reduce the use of plastic and other single-
use bags;
NOW THEREFORE, BE IT RESOLVED that the City Council of the City ofChula Vista does
hereby authorize a letter of support for Assembly Bill 1998 (Brownley).
