This project consists of thc removal and replacement of failed asphalt concrete pavement (dig-outs), application of Rubberized Emulsion Aggregate Slurry (REAS) seal coat, and Chip Seal with Modified Polymer Asphalt Surface Sealer (PASS) for various streets in the city. Work on this project also lI1cludes replacement of traffic signal loop detectors, traffic control, striping and marking, and other miscellaneous items of work necessary for the project. The proposed action would award the contract to Frank and Son Paving, Inc. El'NIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class I(c) categorical exemption pursuant to Section 15301, Existing Facilities, of the State CEQA Guidelines. DISCUSSION The Public Works Department has developed a program to rehabilitate and preserve deteriorating pavement throughout the city through the implementation of the Pavement Management System (PMS). This program is designed to extend the roadway life and serviceability through the removal and replacement of deteriorated sections of pavement (dig-outs) and the application of various types of surface treatments, including asphalt concrete overlays, chip seals, and rubberized slurry seals. The surface treatment application of Rubberized Emulsion Aggregate Slurry (REAS) seal coat and Chip Seal with Modified Polymer Asphalt Surface Sealer (PASS) are mostly the continuation of previous projects where dig-outs have been completed. This project will complete the overall maintenance strategies on the street segments shown in Attachment 1. On June 23, 2010, the Director of Public Works received nine (9) bids for the "Pavement Rehabilitation Program (Prop 1 B), Phase I (STL357)" project. The contractor has perfol1ned satisfactorily on previous City contracts and is currently under contract to perfoml another pavement rehabilitation project to start in August 2010. The Contractor's License No. 612545 is current and active. If approved, the proposed resolution would increase the Director of Public Works' cumulative change order authority specified in City Council Policy No. 574-01 and authorize the DIrector of Public Works to expend all available funds, as necessary and without further City Council action, in order to complete all work required in accordance with City standards and to account for increases or decreases in unit quantities. Disclosure Statement Attachment 2 is a copy of the Contractor's Disclosure Statement. Wal(e Statement The source of funding for this project is Prop 1 B fund. Contractors bidding this project are not required to pay prevailing wages to persons employed by them for the work under this project. Disadvantaged businesses were encouraged to bid in the Notice to Contractors for various trade publications. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that the decision concerns for repaIrs, replacement, or maintenance of existing streets or similar facilities and, therefore, there is not a material financial effect of the decision on the property holdings of the City Council Members pursuant to California Code of Regulations sections 18704.2(b)(2) and 18705.2(b)(l). CURRENT YEAR FISCAL IMPACT The following is a summary of anticipated project costs: FUNDS REQUIRED FOR CONSTRUCTION A. Contract Amount $1,387,350.20 B. Contingencies (Approx. 10%) $138,64'1.80 C.
