OF THE CITY PLANNING COMMISSION OF
CHULA VISTA, CALIFORNIA
October 8, 1975
A regular meeting of the City Planning Commission of Chula Vista, California
was held on the above date beginning at 7:00 p.m. with the following members
present: Chandler, Rudolph, Pressutti, Smith and Starr. Absent (with previous
notification): Commissioner Floto. Also present: Director of Planning Peterson,
Current Planning Supervisor Lee, Assistant Director of Public Works Lippitt,
Assistant City Attorney Beam, and Secretary Mapes.
Chairman Chandler led the pledge of allegiance to the flag, followed by a
moment of silent prayer.
APPROVAL OF MINUTES.
MSUC (Pressutti-Rudolph) The minutes of the meeting of September 24, 1975 be
approved as written. Commissioner Chandler abstained because of his absence
from that meeting.
ORAL COMMUNICATIONS.
The Chairman called for oral communications and none were offered.
1. Consideration of request to vacate northerly 4' of Telegraph Canyon Road,
adjacent to lots 93 and 94 of Hilltop Vista Subdivision -
Dale Building Company
Director of Planning Peterson advised that in the course of checking street
improvement plans for the Hill top Vista subdivision, it was determined by the
Engineering Division that the center line of Telegraph Canyon Road should be
4 feet to the south of the existing center line of the right of way. Allowing
for 96 feet of right of way this leaves 4 feet of excess area, for a length of
230 feet at the western end of the subdivision tract. It is recommended that
that portion of the right of way be vacated and the adjacent lots, 93 and 94 of
the subdivision, be deepened by 4 feet.
MSUC (pressutti-Rudolph) Recommend to the City Council the vacation of a
4' x 230' strip on the north side of the right of way of Telegraph Canyon Road
adjacent to lots 93 and 94 of Hilltop Vista Subdivision.

Director of Planning Peterson reported that the subject billboard was approved
in 1970 for a five year period with the possibility of future extension by the
Planning Commission. It is located adjacent to I-5 in the undeveloped portion

of the Moss Street right of way. Although the Chamber of Commerce has requested
an extension of time for an indefinite period, it is recommended that the ex-
tension be approved for a two year period, which will allow time to determine
the outcome of the present litigation proceeding on billboards along the freeway,
as well as providing the Chamber with the opportunity to explore the possibility
of replacing the sign with a more attractive means of introducing motorists to
the City of Chula Vista.
Commissioner Smith asked if there would be a problem in having the sign removed
in the event theMos~ Street right of way is vacated in coordination with develop-
ment of the property as provided in the precise plan guidelines for the area. Mr.
Peterson expressed the opinion this would not present a problem even if the
property is developed within the two years.
MSUC (Rudolph-Pressutti) With the understanding that the Commission feels
billboards are a detriment to the community and this action is not to be con-
sidered an approval of billboards, as such, and with the further understanding
that work is being done toward another solution of the problem of identifying
Chula Vista, the encroachment permit, #70-10, granted to the Chamber of Commerce
is extended for a period of two years, to expire October 9, 1977.
3. Consideration of revocation of home occupation license for storage of
merchandise at 285 Seavale
Commissioner Rudolph reported that inasmuch as her residence is two doors from
the applicant's property, she has been advised by the City Attorney to abstain
from participating in this consideration due to her possible financial interest.
Director of Planning Peterson reported that subsequent to the preparation of the
written report to the Commission, he had talked to the person who filed the com-
plaint against this home occupation on the basis of excessive truck deliveries,
and he indicated that the deliveries to this residence have now been reduced to
less than one per week. Inasmuch as that brings the operation into conformance
with the conditions established by the Commission in 1968, it is recommended
that if the complainant verifies this is the case, the consideration of revoca-
tion of the home occupation license be filed without action.
Newton Chaney, 292 Seavale, reported that he is the complainant in this issue
relating to the revocation of the home occupation permit for Mr. Yufe at 255
Seavale. He advised that he has lived at that address for less than a year and
after moving there he observed that heavy trucks were stopping at that residence
and unloading merchandise several times a week. Mr. Chaney complained to the
Zoning Enforcement Officer, and following investigation of the problem, notice
was given to Mr. Yufe to cease the practice of having truck deliveries made in
excess of once a week. Mr. Chaney advised that during the past three months
this has been accomplished. Based on his personal contact with Mr. and Mrs.
Yufe, he feels that good faith on his part has been demonstrated. He asked
that the Commission permit the home occupation license to remain in effect as
previously granted.
Robert Terry, attorney representing Mr. Yufe, reported that there have been no
deliveries to the Yufe's residence for approximately 3 to 3-1/2 months and that

any future deliveries will not occur more often than once a week, and in any
event the delivery trucks will not stop in the street, but will enter the
driveway in order not to interfere with traffic. He requested that considera-
tion of revoking the home occupation license be dropped, and affirmed that Mr.
Yufe would comply with all conditions in Resolution No. 494 which was adopted
in 1968.
MSC (Pressutti-Smith) The item for consideration of revoking the home occupa-
tion license at 285 Seavale be filed.
Commissioner Rudolph abstained from voting on the motion.
4. Consideration of request for home occupation permit for woodworkin~ at
1133 Vista Way - John C. Sea~ren
Current Planning Supervisor Lee reported that the applicant proposed to do very
limited woodworking, on a part time basis, using a 2-1/2 horsepower radial saw
in connection with the work. Under provisions of the Municipal Code, the use
of any equipment over one horsepower in a home occupation requires Commission
review and approval. The staff has taken noise readings during operation of
this saw and at the side property lines the noise level was within the accept-
able level. While the readings were listed as above the acceptable level at
the front property line with the garage door open, it was pointed out that there
is 100 feet between this garage and the residence across the street; no reading
was taken at that distance.
Mr. Lee called attention to the six conditions recommended with approval of the
home occupation permit, including the condition that the saw would not be used
in excess of 8 hours in a week. He felt this time limit would render the use
similar in nature to a person working with a saw as a hobby.
Commissioner Smith pointed out that under the Code cabinet shops are permitted
in the C-B zone and carpentry shops are a conditional use in the C-T zone. He
felt that noise is not the only criteria that should be considered. He noted
that this applicant intends to manufacture and sell these items in a residential
zone, and pointed out that there are numerous uses that are not noisy at all
which are not permitted in the residential zones. He contended that the proposed
use does not beling in a residential zone.
John Seagren, the applicant, advised that he wishes to manufacture the items in
the garage, but does not intend to do any selling at that location. He would
sell at swap meets or through retail outlets, so there would be no increase in
traffic occasioned by this use. He affirmed that he would not use the saw in
excess of 8 hours a week, since this will be only spare time work in addition
to his full time job. He also indicated he would not produce any item in
quantity and would not require extensive storage area. In response to a ques-
tion from Commissioner Starr, he reported that although he has been using the
saw for about a year he has had no complaints from the neighbors.
Commissioner Pressutti expressed the opinion that the stringent restrictions
recommended, including the right for the Commission to review and revoke the
permit, make this home occupation acceptable.

MSC (Pressutti-Starr) Approval of the request for a home occupation license
for woodworking at 1133 Vista Way, including the use of a 2-1/2 horsepower
radial saw, subject to the six conditions stated in the staff report.
The motion carried by the following vote:
AYES: Commissioners Pressutti, Starr, Chandler and Rudolph
NOES: Commissioner Smith
ABSENT: Commissioner Floto
5. .Consideration of request for extension of time on conditional use permi(.
PCC-73-20 for Kaiser Medical B~ildin~
Director of Planning Peterson noted that this conditional use permit was approved
two years ago, due to its location in the Sweetwater Flood Plain. Although sub-
sequent grading has raised the building site above the flood level, the zoning
of the area has not been changed, so the conditional use permit is still required.
Mr. Peterson pointed out that the staff is studying the question of a joint
access drive from Bonita Road to serve this facility and the proposed adjacent
development. However, since that access is not relevant to the extension of
time on the conditional use permit, it is recommended that the two-year extension
be approved.
MSUC (Starr-Smith) Approval of a two-year extension of time on conditional use
permit PCC-73-20.
6. PUBLIC HEARING: Rezonin~ PCZ-75-H~ 2.15± acres from R-3 to R-3-H-P~
300 block of Center Street~ Richard ZogOb and C.P~ Kiffe
Current Planning Supervisor Lee advised that the present R-3 zoning on this
property allows a maximum of 69 units; the R-3-H zone would allow ll7 units;
however, the applicant has requested the application of the "P" District, with
a plan for 92 units. Mr. Lee called attention to the objectives, as cited in
the report, which the City is trying to achieve in encouraging development in
the core area of the City, one being the efficient mixture of land uses,
locating residential development close to public services, thus relieving
pressure for residential expansion into the outlying areas where public ser-
vices must be installed to meet the need. Another objective is the rejuvenation
of the downtown area. The staff recommends approval of the rezoning as requested,
based on the findings contained in the report, and with the rezoning subject to
the approval of a precise plan.
Mr. Lee pointed out that the EIR adopted in August on the proposed development
of the property remains valid and no further action is required in that regard.
This being the time and place as advertised, the public hearing was opened.
Bernard Bernes, owner of property on Center Street near the subject property,
expressed support of the requested rezoning, which he felt could be a boost
to the downtown area by generating business. He noted that the subject property
has been idle for a number of years and its development would improve the area.

As no one else wished to speak, the public hearing was closed.
MSUC (Rudolph-Pressutti) Recommend to the City Council the rezoning of 2.15
acres located in the 300 block of Center Street from R-3 to R-3-H-P based on
the findings stated in the staff report, with development subject to approval
of a precise plan.
7. PUBLIC HEARING: Consideration of Precise Plan for Park West Apartments -
Richard Zo~ob and C.P. Kiffe
Current Planning Supervisor Lee called attention to the site plan on display
noting the location of parking on three sides of the three story building,
which would contain 12 two-bedroom units and 80 one-bedroom units with a
private balcony provided for each unit. He pointed out the only variance from
City standards is the increase in compact parking spaces, tt is felt this is
justified due to the trend toward greater use of compact cars.
Mr. Lee pointed out that architectural treatment of the structure would be
presented for Commission consideration at a subsequent meeting.
Commissioner Rudolph pointed out that the EIR on proposed development of this
property had indicated that due to the unique location of the property imagina-
tive plans should be used. She asked if that criteria is fulfilled by the pro-
posed plan. She asked if such ideas as a mixture of uses and underground
parking had been considered.
The public hearing was opened and the applicant was asked to comment on that
aspect.
C.P. Kiffe, part owner of the project, reported that considerable study had
gone into planning for the best development of this property. Underground
parking is not feasible due to the proximity of the Memorial Park catch basin
for flood water in a 100 year flood. Construction cost for high rise structures
runs a great deal higher than for structures limited to three stories. He
felt that the plan proposed is the only economically feasible development for
the area.
As no one else wished to speak, the public hearing was closed.
MSUC (Rudolph-Pressutti) Recommend to the City Council the approval of the
Precise Plan as shown on Exhibit A, subject to the conditions enumerated in
the staff report, such approval being based on the findings contained in the
report.
DIRECTOR'S REPORT
Director of Planning Peterson noted that normally the next meeting of the Com-
mission would be a study session on Monday, October 20; however, some of the
staff will be attending the League of California Cities conference on that
date. He suggested that if the Commission so desired, they could declare
their intent not to hold a meeting on October 20 and schedule a review of the
General Plan for the study session in November.
MSUC (Rudolph-Pressutti) The study session normally scheduled for October 20
be cancelled and the next study session be held on the third Monday in November.

Mr. Peterson presented for signature by the Commission members a resolution
_ commending former Planning Commissioner Leslie Rice, whose resignation was
announced last month.
No Commission comments were offered.
ADJOURNMENT
Chairman Chandler declared the meeting adjourned at 8:05 p.m.
