HomeMy WebLinkAboutPlanning Comm min 1972/01/24 MINUTES OF A REGULAR ADJOURNED MEETING OF THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA January 24, 1972 The regular adjourned meeting of the City Planning Commission of Chula Vista, California was held on the above date beginning at 7:00 p.m. with the follow- ing members present: Stewart, Adams, Macevicz, Chandler, Rice and Rudolph. Also present: Associate Planner Lee, Assistant City Attorney Blick and Assistant Director of Public Works Robens. APPROVAL OF MINUTES MSUC (Rudolph-Macevicz) The minutes of the meeting of January 17, 1972 be approved as mailed. PUBLIC HEARING: CONDITIONAL USE PERMIT - 868 & 880 Broadway - Request tn operate 'retail sales store of used clothing and furniture - The Flying Samaritans Associate Planner Lee indicated the location of the property where The Flying Samaritans intend to establish an operation primarily concentrated on the sale of used furniture, which is a permitted use in the C-T zone. However, the operation will also include a limited sale of used clothing and other articles which requires Planning Commission approval for conditional use. Member Macevicz inquired if the area behind the site would be made available for customer parking. It was noted by staff that it would be. This being the time and place as advertised, the public hearing was opened. Dr. Dale E. Hoyt, 2340 E. 8th Street, National City, President of The Flying Samaritans, concurred with Mr. Lee's remarks and commented that his organiza- tion maintains eight clinics here and in Mexico and proposes to raise funds for this use from the profits of the retail operation. Members of the Commission expressed concern regarding the limited parking available and Chairman Stewart inquired about the termination of the arrange- ment whereby the trucks of Imperial Truck Lines are temporarily using that area behind the Flying Samaritans' building for parking. Dr. Hoyt said that as soon as Imperial has completed construction of their building at 621 "L" Street, their trucks would be parked on their own property. As no one else wished to speak, for or against, the public hearing was closed. The Commission agreed that if the conditional use permit were approved, on the date that it became effective it would be necessary for the truck lines to remove their trucks from the parking area on the Samaritans' property. -2- 1/24/72 MSUC (Adams-Macevicz) That the request of a conditional use permit for the RESOLUTION PCC-72-4 sale of used clothing in the C-T zone at 868 & 880 Broadway be approved with the condition tree wells and street trees will be installed as approved by the Landscape Architect. Findings are as follows: a. That the proposed use at the particular location is necessary or desirable to provide a service or facility which will contribute to the general well- being of the neighborhood or the community. The location of the facility is good due to the complimentary relationship with adjacent uses. b. That such use will not, under the circumstances of the particular case, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. Due to the compatibility of uses no detrimental effect will be created. c. That the proposed use will comply with the regulations and conditions speci- fied in the Code for such use. All conditions and regulations will be complied with. d. That the granting of this conditional use permit will not adversely affect the General Plan of the City of Chula Vista or the adopted plan of any govern- mental agency. The use conforms to the General Plan. PUBLIC HEARINGS: a. CONDITIONAL USE PERMIT - 105-115 North Glover Avenue - Request to construct carpet warehouse in Flood Plain District ~. VARIANCE'- 105-115 North Glover Avenue - Request to increase building coverage to 65% of lot area c. Request for waiver of landscape/screening requirements at 105-115 NorthGlover Avenue - Christensen Construction Corp. Associate Planner Lee pointed out the area in the I-L-F zone where the applicant is requesting a variance to allow the expansion of a warehouse to cover 65% of lot area. Although this structure has been classified as a warehousing opera- tion, it appears that a high percentage of retail sales are taking place, noting that retail sales in the I-L zone are limited to the sale of products produced or manufactured on the site. The applicant has enough parking space based on proposed uses involving ware- house structure, which requires one parking space per lO00 sq. ft. of floor area. Retail sales require one space per 200 sq. ft. of floor area. The sub- mitted plot plan provides an adequate number of parking stalls for the ware- house use; however, no screening or landscaping of the area is included, and five roll-up type doors proposed along the western elevation conflict with the parking area, since three parking stalls are adjacent to these doors. -3- 1/24/72 Staff is of the opinion that if expansion is necessary it should come through development of property in the adjacent area. This being the time and place as advertised, the public hearing was opened. Harlan Christensen, President of Christensen Construction Corp., expressed a desire to construct an addition on the property and cited examples of con- struction that has been taking place in other industrial areas adjacent to Chula Vista, and questioned the Commission as to why construction hasn't been proceeding in Chula Vista's industrial park area. Larry Burke, Manager of the store, commented that the obvious reason for want- ing the building expansion is the need for space, as business is good and they are constantly growing. They employ 14 full-time people, most of whom are carpet layers using company trucks. The roll-up type doors are strictly access doors for loading, used mostly at night rather than during business hours, and should not interfere with adjacent parking. They would be willing to change the door design. Mr. Burke agreed that they attract a lot of retail customers, especially on week-ends, who park in the street both on Trousdale and on Glover, as do the customers of adjoining businesses. He expressed willingness to discuss with staff whatever type of landscaping may be necessary. Member Macevicz inquired if they had explored the possibility of expansion activity to the east of their establishment. Mr. Burke replied that they had made inquiry some time ago, but the owner was not interested in selling the property. Manuel Adler, Principal of the company, mentioned there would be approximately 15 parking spaces, including three which were not indicated on the plat. He also referred to a similar parking problem for a facility on Broadway which the Commission considered favorably three or four years ago. As no one else wished to speak, for or against, the public hearing was closed. After further discussion by the Commission, in which it was mentioned that any construction allowed in this area would be permanent and must be given careful consideration, it was agreed that there is sufficient vacant land adjacent to the business available for proper expansion and no hardship is involved or public interest, but only the applicant's economic interest, and that the variance should be denied. MSUC (Chandler-Adams) That the request for a variance to increase building coverage to 65% of lot area, 105-115 North Glover Avenue, be denied, and that the request for a conditional use permit to construct carpet warehouse in flood plain district and request for waiver of landscape/screening requirements at 105-115 North Glover Avenue be filed. Chairman Stewart advised the applicant of his right of appeal to the City Council within ten days. -4- 1/24/72 Request for deferral of public improvements at "D" Street and Minot Av.enue Associate Planner Lee indicated the Division of Engineering has received a request for deferral of public improvements at the northwest corner of Minot Avenue and "D" Street. There have been three similar deferrals in this area within the past year. Because of the terrain it is impractical to install a small portion of the "D" Street improvements, and the staff concurs with the Division of Engineering's recommendation of approval of the request. Upon the Commission's query as to the number of deferrals that might be granted before the public improvements would be required by the City, Assistant Direc- tor of Public Works Robens stated that it is necessary to have 50% of the frontage between any two intersecting streets before the 1911 "Block Act" can be implemented. MSUC (Rice-Rudolph) That the request for deferral of public improvements at the northwest corner of "D" Street and Minot Avenue be approved. Request for approval of expansion of nonconforming use at 595 Vance Street - Mrs. Vera Learned Associate Planner Lee pointed out the location of the building which the owner, Lloyd's Lock & Key Service, is requesting permission to enlarge to provide additional work and storage space. This property was rezoned from C-T to R-2 in April, 1971 as part of Phase III of the City-wide rezoning, and the use is nonconforming, although the applicant has been in business at this location since 1955. The adjacent ceramic shop to the east began in 1970 and is also nonconforming. Mr. Lee detailed the zoning and land use patterns in the area noting that the proposed addition will contain approximately 120 sq. ft. and be located at the northeast corner of the property on the property lines. Street parking is limited, and there are presently three offstreet parking spaces located in front of the business. There are three employees and no increase in number is expected. Staff believes the proposed addition necessary for the effective operation of the business, and since the adjacent use to the east is also commercial it will have no detrimental affect. The staff suggested that the Commission may also wish to discuss whether or not a hearing should be called to consider placing these parcels again in a commercial zone. Vera Learned Haynes, 245 Woodlawn Avenue, Apt. 5-F, owner, remarked that she had been surprised to learn that her property had been rezoned and did not remember receiving a notice of the proposed zone change. Member Macevicz asked if she had taken out a building permit. Mrs. Haynes said they had attempted to take out a permit and the contractor had begun construction of the building, anticipating no problem in obtaining the permit. That was when she learned the property had been rezoned to R-2. -5- 1/24/72 With one end of the building open overnight some things were stolen so the outside wall was rebuilt the following day. Dwight Gove, owner of The Mud Puddle, ceramics shop, 589 Vance Street, stated he had not received a notice of the zone change, since it was sent to the former owner, and was unaware of it until informed by Mrs. Learned. The property was zoned C-T when he purchased it in May, 1970. He followed the recommendation of the Planning Department and put pavement in the rear for parking. He would like to have a new hearing to consider rezoning the property to commercial. After discussion the Commission agreed this expansion deserved approval on its own merits but were concerned about the frequent incidence of construction being started before building permit is obtained. MSC (Chandler-Rudolph) Request for expansion of nonconforming use at 595 Vance Street be approved. The motion carried by the following vote: AYES: Members Stewart, Rudolph, Adams, Chandler, Rice. NOES: None ABSTAIN: Member Macevicz* ABSENT: None *Member Macevicz abstained on principle, since construction took place prior to the issuance of a building permit. Chairman Stewart directed the staff to place on a future agenda a hearing to consider rezoning these two parcels. Oral Communications Kathryn Moore, 1134 Tobias Drive, South Bay Citizens Planning Committee, reported that she had attended a C-3 Land Use Committee meeting today and wished to call to the Commission's attention that the County of San Diego had drawn up an ordinance for mini-parks which would affect all areas of the County including Chula Vista. Chairman Stewart requested that staff forward to the Commission all information on this item when it is received from the County.
