CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA
February 7, 1972
The regular meeting of the City Planning Commission of Chula Vista, California
was held on the above date beginning at 7:00 p.m. with the following members
present: Stewart, Rice, Adams, Macevicz, Chandler, Rudolph and Whitten. Also
present: Director of Planning Warren, Senior Planner Williams, Associate
Planner Lee, Assistant City Attorney Blick and Assistant Director of Public
Works Robens.
Chairman Rice welcomed Member Paul Whitten to the Planning Commission.
APPROVAL OF MINUTES
MSUC (Chandler-Macevicz) The minutes of the meeting of January 24, 1972
be approved as mailed.
PUBLIC HEARING: CONDITIONAL USE PERMIT - 336 Trousdale Drive - Expand building
and operate a punch.~ress in the I-L-F zone - Merit Products,
Inc.
Associate Planner Lee displayed a plat showing the location of the property at
the southeast corner of Trousdale and North Glover and pointed out the adjacent
uses. The entire area is zoned I-L-F and located in the Flood Plain.
The applicant is requesting permission to expand a portion of the existing build-
ing from 12' to 20' height and to operate a 25 horsepower punch press for stamp-
ing knife blades. The property will be required to conform to landscaping and
parking requirements and the operation must meet all performance standards
covered by the Zoning Ordinance. Since there is an existing mobile home park
adjacent to the south of this property, the expansion would require a 6' high
zoning wall along the southern property line. Mr. Lee enumerated the conditions
recommended by the planning staff for approval of the conditional use permit.
This being the time and place as advertised, the public hearing was opened.
Howard Craig, Vice President of Merit Products, expressed his willingness to
abide by the standards of the Zoning Ordinance and to protect the surrounding
area with whatever specifications are necessary within prudent reason within
an industrial area. He reported that the thickness of the metal being stamped
runs from .093 to .225. The metal is heated to 700° prior to being stamped,
which reduces the noise factor. He stated that the material used is a high
carbon, high chrome alloy--a 400 series stainless steel. Mr. Craig reported
that there will not be a secOnd floor constructed but that the added height
is required to accommodate the machine which is 16 to 18 feet in height.
In response to a question concerning the tailings or scrap material, Mr. Craig
advised it is contracted through a local scrap dealer who picks it up and
stores it on his own property until he has a carload. The scrap dealer furnishes
large containers for collecting and hauling the material.

Member Rudolph questioned the hours of operation of the punch press, and Mr.
Craig reported it is their intention to operate the punch press on the day
shift only. The Commission felt the hours of operation should be stated as
a condition of the conditional use permit, and Mr. Craig concurred with a
limitation on hours of 7:00 a.m. to 7:00 p.m. He also indicated the press
would not be used in excess of 40% of the time during the day shift to take
care of their requirements.
As no one else wished to speak, for or against, the public hearing was closed.
Chairman Stewart expressed support for the conditional use permit, subject to
the conditions stipulated, but felt the permit should also limit the operation
to one punch press only.
Members Rudolph and Macevicz expressed concern that the noise from the punch
press would be disruptive to the adjacent residents and that the performance
standards would not be properly enforced.
MSC (Chandler-Adams) Approval of conditional use permit for operation of a
RESOLUTION PCC-72-6 25 horsepower punch press and increase the height of a
portion of existing building from 12' to 20' at 336
Trousdale Drive in the I-L-F zone, subject to the
following conditions:
1. Operation shall be limited to one punch press only and between the hours of
7:00 a.m. to 7:00 p.m.
2. Prior to the issuance of a building permit the applicant shall provide the
Zoning Administrator with any data required to determine that the Performance
Standards can be met. Prior to final inspection the applicant shall supply the
necessary data to show that the standards have been attained.
3. A 6' high zoning wall shall be constructed along the southern property line.
4. The following landscaping and screening shall be accomplished:
a. The parking at the rear of the building shall be screened by a 3'
wide landscaped area and a 3~' masonry wall (facing North Glover).
b. The front yard setback, parallel to Trousdale Drive, shall be land-
scaped to screen the parking area.
5. All signs on the premises shall be brought into conformance with the
Zoning Ordinance.
Findings are as follows:
a. That the proposed use at the particular location is necessary or desirable
to provide a service or facility which will contribute to the general well-
being of the neighborhood or the community.
The area is well suited for this type of light machine shop operation.

b. That such use will not, under the circumstances of the particular case, be
detrimental to the health, safety, or general welfare of persons residing or
working in the vicinity, or injurious to property or improvements in the vicinity.
As long as the performance standards are met there will be no detrimental
effect.
c. That the proposed use will comply with the regulations and conditions speci-
fied in the Code for such use.
All conditions and regulations shall be met.
d. That the granting of this conditional use permit will not adversely affect
the General Plan of the City of Chula Vista or the adopted plan of any govern-
mental agency.
The proposed use conforms to the General Plan.
The motion carried by the following vote:
AYES: Members Chandler, Adams, Rice, Stewart and Whitten
NOES: Members Rudolph and Macevicz
ABSENT: None
PUBLIC HEARING: CONDITIONAL USE PERMIT - 400 block "C" Street - Distribution
and retail sales of bakerS products in I-L-F zone -
Oroweat Bakin9 Company
Associate Planner Lee displayed a plat showing the location of the property on
the north side of "C" Street in the Flood Plain District and indicated the ad-
jacent industrial and commercial uses with General Roca Park across the street.
He also displayed a plat showing the details submitted by the applicant for
improvement of the property. The proposed construction would consist of a retail
sales area and office at the front of the building with garage facilities at the
rear.
This being the time and place as advertised, the public hearing was opened.
Jack Gillespie of the Oroweat Baking Company, reported there will be 6 route
trucks headquartered at this location for distribution to the surrounding area.
One transport truck will come in each morning around 6:30 or 7:00 with bakery
products for distribution by the smaller trucks. The retail facility in the
front is for sale of products not sold from the trucks--day old products.
As no one else wished to speak, the public hearing was closed.
MSUC (Macevicz-Rice) Approval of a conditional use permit for construction
RESOLUTION PCC-72-7 of facilities for the distribution and retail sales of
bakery products on property in the Flood Plain District,
west of 459 "C" Street, subject to the filing of a par-
cel map creating a separate lot of this area prior to
the issuance of a building permit.

Findings are as follows:
a. That the proposed use at the particular location is necessary or desirable
to provide a service or facility which will contribute to the general well-
being of the neighborhood or the community.
The site is centrally located within the south bay area and is well suited
for distributional facilities.
b. That such use will not, under the circumstances of the particular case, be
detrimental to the health, safety or general welfare of persons residing or
working in the vicinity, or injurious to property or improvements in the vicinity.
The proposed use is compatible with the adjacent uses and will not be
detrimental.
c. That the proposed use will comply with the regulations and conditions speci-
fied in the Code for such use.
All conditions and regulations shall be met.
d. That the granting of this conditional use permit will not adversely affect
the General Plan of the City of Chula Vista or the adopted plan of any govern-
mental agency.
The use is in conformance with the General Plan.
SUBDIVISION - Tentative map of Kennedy Plaza~ Third Avenue & Kennedy Street
Associate Planner Lee indicated the location of the property and advised that
when it was prezoned C-C-P in May of last year one of the conditions of the
zoning was the recordation of a subdivision map to insure the consolidation of
lots and the undergroundin9 of utility lines. The applicant must also file a
precise plan for development of the property by May 5, 1972. Public improve-
ments will be placed on Third Avenue as a requirement of the zoning and the
development is to be oriented toward Third Avenue.
MSUC (Adams-Chandler) Recommend to the City Council the approval of the
tentative subdivision map for Kennedy Plaza, subject
to the following conditions stipulated by the Director
of Public Works:
1. All driveways shall be alley type driveways.
2. An Additional manhole shall be constructed on the property and a surfaced
road constructed to provide access to the manhole. The necessary ease-
ments shall be provided to accomplish this.

Request for revision of street access to E1 Rancho del Res, Units #1 and #2
Director of Planning Warren advised that a letter was received from E1 Rancho
del Rey on February 4, requesting that this item be withdrawn from the agenda.
Request for approval of Home Occupation License - Growin~ trees at 128 "K"
Street - Alvin H. Stahlhebef
Director of Planning Warren reported that following a complaint from an adjacent
owner the Zoning Enforcement Officer had checked the operation of tree growing
at this address and advised the applicant to seek a home occupation license.
This operation is conducted on the rear portion of a large residential lot. Mr.
Warren reported that a letter supporting the home occupation license was received
from James Wilson, ll2 Country Club Drive.
Chairman Stewart announced that although this is not a public hearing the Com-
mission would be pleased to hear from anyone interested in this matter.
John R. Schell, attorney representing Mr. Stahlheber, commented that the one
objection to this operation concerned the use of insecticides. The complainant
has a son with asthma and fears that insecticide sprays might have a harmful
effect. He reported the applicant is willing to agree that only systemic fer-
tilizers and insecticides will be used and the type to be used will be those
which Mr. Tremble's physician says will not harm the boy.
Member Adams raised a question concerning the hauling in of soil and planter
mix material to fill the containers in which the trees are planted.
Mr. Schell presented letters of support from ll nearby residents.
Mr. Alvin H. Stahlheber, 128 K Street, in answer to Member Adams question
reported that the planter mix material had been brought in about three months
ago. This was placed in the containers and the trees planted. They do not
expect to move any trees until between one and two years from now and then
maybe 10 or 15 trees at a time will be moved out, and a similar number of
trees planted. He reported the planting is done in clean containers, painted
green before he receives them.
Member Whitten questioned Mr. Stahlheber concerning plans for expansion since
he is now using the rear portion of the lot adjacent to his own.
Mr. Stahlheber advised he had no plans for further expansion. In answer to
a question from Chairman Stewart, Mr. Stahlheber reported that the lot area
occupied by their house and personal yard is 10,800 square feet and the tree
growing operation is aside from this area.
Harold Tremble reported that he had submitted the complaint and that his main
concern is his son's health and if there is an agreement that the trees would
not be sprayed with insecticide he felt the problem would be eliminated. He
concurred that this operation has improved the appearance of the vacant portion
of the property.

MSUC (Chandler-Macevicz) The request by Mr. Stahlheber for a home occupation
license to permit the growing of trees in containers at 128 "K" Street be
approved subject to annual review by the Planning Department and to the con-
ditions as agreed upon by the applicant concerning the use of systemic fer-
tilizers and insecticides.
.Request for extension of time on Conditional Use Permit for day care center,
562 "K" Street - W.D.C. Services, Inc.
Associate Planner Lee reported that the applicant has removed the building
which formerly occupied the lot but has not begun construction on the new
facility and since the conditional use permit is due to expire this month the
applicant has requested an extension. The Planning staff recommends granting
a one-year extension of time.
MSUC (Adams-Macevicz) A one-year extension of time be granted on the con-
ditional use permit for the construction and operation of a child care center
at 562 "K" Street.
Recommendation on Rienstra's Orange Avenue Annexation
Director of Planning Warren indicated the boundaries of a proposed annexation
consisting of 81 acres and bounded on three sides by Chula Vista city limits.
MSUC (Rice-Rudolph) Recommend to the City Council approval of Rienstra's
Orange Avenue Annexation and direct the staff to forward the request to LAFCO.
COMMISSION COMMENTS
Member Chandler reported that a meeting of the City Beautification Awards Com-
mittee has been scheduled for Wednesday evening, February 9th, and asked if
Member Rudolph, his alternate on the committee, could attend this meeting.
Member Rudolph agreed to accept this responsibility.
Chairman Stewart read a letter of appreciation from Bonita Vista High School
praising the presentation given at that school by Norman Williams and Lu
Quinney. Chairman Stewart complimented the members of the staff for making
this fine presentation.
Chairman Stewart announced that a League of California Cities dinner meeting
will be held at the Hotel Del Coronado on Thursday, February 17. Reservations
should be made by Monday, February 14.
Member Rudolph reported that she had attended a two-day Urban Growth Confer-
ence and asked if the Commission wanted an oral or written report of this
meeting. Chairman Stewart suggested that a written report be submitted.
Member Rice again brought up the deteriorating condition of the paving on the
parking lot at the Hilltop and Naples shopping center and asked when the City
Attorney is going to bring suit against the owners of the center to get them
to upgrade the parking lot and paving.

Assistant City Attorney Blick advised it has always been his policy to enforce
the Zoning Ordinance, but he waits for a report of a violation from the Zoning
Enforcement Officer.
Director of Planning Warren assured that a report on the condition of this lot
will be brought to the City Attorney's office.
