HomeMy WebLinkAboutPlanning Comm min 1972/05/15 MINUTES OF A REGULAR ADJOURNED MEETING OF THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA May 15, 1972 The regular meeting of the City Planning Commission of Chula Vista, California, was held on the above date beginning at 7:00 p.m. with the following members present: Stewart, Rice, Adams, Macevicz, Chandler, Rudolph, Whitten and ex- officio member Miller. Also present: Director of Planning Warren, Associate Planner Lee and City Attorney Lindberg. APPROVAL OF MINUTES MSUC (Rudolph-Chandler) The minutes of the meetings of April 24 and May 1, 1972 be approved as mailed. Member Rice explained that his absence at the opening of the meeting of May 1 was due to having car trouble while enroute to the meeting; he had attempted to phone in notice of his delay but it is not possible to reach the Civic Center by phone after office hours. PUBLIC HEARING: PREZONING - Approximately 40 acres at east end of J Street - A-l-8 to R-1 - Shattuck Construction Co. Director of Planning Warren displayed a plat showing the location of the property under consideration for prezoning, noting that it is surrounded on three sides by property which is under reconsideration of development plans for E1 Rancho del Rey. He pointed out a number of problems which should be resolved prior to considering development plans for this property, and even though the request is for standard R-1 zoning, the staff would recommend con- tinuing the public hearing to the meeting of June 5, 1972. Tom Showalter, representing Shattuck Construction Co., advised they have no objection to the proposed continuance. MSUC (Chandler-Macevicz) The public hearing to consider prezoning approxi- mately 40 acres at east end of J Street shall be continued to the meeting of June 5, 1972. PUBLIC HEARING: CONDITIONAL USE PERMIT - 60 Broadway - request to install gasoline pum~s in ~°njunction With food ~arket in C-T zone - Autotronic Systems, Inc. Associate Planner Lee reported the receipt of a letter on this date from a representative of the applicant requesting a continuance of this hearing but not stating the date to which they would like it continued. Larry Wasserman, Attorney, 8647 Navajo Road, San Diego, representing the applicant, confirmed their request for a continuance and advised that one week would be sufficient time for them to supply additional information for pres- entation to the Commission. -2- 5/15/72 MSUC (Rice-Rudolph) The public hearing for consideration of a conditional use permit, request to install gasoline pumps in conjunction with food market at 60 Broadway, be continued to the meeting of May 22, 1972. PUBLIC HEARING: CONDITIONAL USE PERMIT - Otay Valley Road~ Lot #19 - Request to operate auto repair and paint shop - Daniel V. Kelley Associate Planner Lee displayed a plat showing the location of the property which measures 334 feet by 488 feet wi th frontage on Otay Valley Road and is zoned I-L. The adjacent property to the east is also zoned I-L and vacant, property to the north is zoned R-1 and vacant, property to the west is zoned R-1 and developed with single family residences which front on Oleander Avenue. He pointed out that the I-L zoning of the subject property was subject to ded- ication of an additional 30 feet of right-of-way for Otay Valley Road prior to industrial use. This dedication will be a condition of the conditional use permit if approved. On a detailed plat of the lot Mr. Lee indicated the location of two single family dwellings near Otay Valley Road and of unused existing buildings in the center of the lot which it is proposed to utilize for the repair and paint shop and for storage of vehicles to be worked on. He noted that the distance from the work area to the nearest residence is 250 feet and that access to the work area would be from Otay Valley Road. Hours of operation would be limited to 8:00 a.m. to 8:00 p.m. with no more than three employees working. The work would involve restoration of damaged vehicles and would not be open to the public. The only sign would be a 4' X 4' sign on the structure where the work is performed as required by the Department of Motor Vehicles. This is proposed as an interim use only until the property is ready for redevelopment. Mr. Lee enumerated six conditions recommended by the staff if approval of the request is granted. This being the time and place as advertised, the public hearing was opened. The applicant was present and indicated he had nothing to add to Mr. Lee's description of the intended use. Virgil Booth, 1635 Oleander, asked whether all vehicles while being painted woula be kept within a building. It was confirmed this will be done. Mr. Booth also questioned what the area will look like after the operation is started. It was pointed out that limiting the number of vehicles to six, which will be kept inside, will prevent any detriment to the site occasioned by this operation. As no one else wished to speak, for or against, the public hearing was closed. MSUC (Adams-Whitten) Approval of a conditional use permit to operate an auto RESOLUTION PCC-72-20 repair and painting facility on Otay Valley Road, sub- ject to the following conditions: 1. No more than three employees shall be employed. They shall work only from 8:00 a.m. to 8:00 p.m. -3- 5/15/72 2. No more than six vehicles shall be stored or worked on at any time. 3. This use shall not be open to the public since paved off-street parking is not available. 4. This conditional use permit shall be reviewed annually by the Planning Commission to determine if the conditional use permit should be extended, if additional conditions are required or if the conditional use permit should be terminated. 5. This conditional use permit shall become effective only upon the dedica- tion of the required additional 30' of right-of-way for Otay Valley Road. 6. Signing shall be limited to a 4' X 4' wall sign attached to the structure used for restoration. Findings are as follows: a. That the proposed use at the particular location is necessary or desirable to provide a service or facility which will contribute to the general well- being of the neighborhood or community. Because of the nature of the operation the use is acceptable as an interim industrial use for this site. b. That such use will not, under the circumstances of the particular case, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity or injurious to property or improvements in the vicinity. As long as the use is limited in scale by hours of operation, number of employees and number of autos, there will be no detrimental effect. c. That the proposed use will comply with the regulations and conditions speci- fied in the Code for such use. All regulations including those of the Fire Department and the Performance Standards shall be met. d. That the granting of this conditional use permit will not adversely affect the General Plan of the City of Chula Vista or the adopted plan of any govern- mental agency. This use will provide a buffer between the salvage operations to the east and the residential to the west. Request for vacation of portion of public right-of-way - north side of Bonita Road, east of Allen School Road - R. H. Hammond Director of Planning Warren reported that a request from R. H. Hammond for vacation for a portion of the northerly right-of-way of Bonita Road at the curve east of Allen School Road was referred to the Commission by the Director of Public Works with the finding that this right-of-way is not needed for street improvements and the recommendation that the vacation be approved sub- ject to reservation of a 20 foot wide drainage easement across the property vacated. -4- 5/15/72 MSUC (Macevicz-Rudolph) Recommend to the City Council the approval of re- quest for vacation of a portion of northerly right-of-way of Bonita Road, east of Allen School Road. Review of Conditional Use Permit for use of mobile classrooms at 345 F Street - Sweetwater Union High School District Director of Planning Warren reported that the conditional use permit for use of mobile classrooms by the Sweetwater Union High School District at 345 F Street is subject to annual review by the Commission. The site is short on offstreet parking but parking is available across Garrett on the city owned lot. These classrooms are used for Manpower Development Training classes and this is on an interim basis as facilities for vocational training classes are under construction elsewhere. The staff recommends approval for continuing the use for one year subject to annual review to determine the continued need and compatibility with adjacent use. Robert Randall, Principal of Chula Vista Adult School, reported they have Man- power Development Training funding for the classes using the trailers through the fiscal year 1973. He advised that the vocational training facilities are not yet under construction and would not be completed by July, 1973, but he felt the funding for these classes would expire at that time. MSUC (Whitten-Macevicz) Approval of a one-year extension for the conditional use permit for use of mobile classrooms at 345 F Street subject to annual re- view by the Planning Commission. Request for extension of variance for use of mobile offices - Rohr Industries, Inc. Director of Planning Warren commented that the written staff comments had recom- mended an extension of this use for one year only to give Rohr Industries, Inc. an opportunity to construct permanent facilities, and inform the company that further extensions will not be considered under this variance. A telephone call from T. J. Roth, staff attorney for Rohr, on this date conveyed their desire to comment on this recommendation but due to the short time between receipt of the comments and the meeting they would be unable to do so at this meeting. They requested that the matter be held over to the meeting of May 22 or June 5. Mr. Warren noted that the variance had an expiration date of May 12; however, in the past variances have been considered in effect pending Com- mission action if a request for extension was received. City Attorney Lindberg affirmed there would be no problem if consideration of the extension were deferred to June 5th. MSUC (Rudolph-Adams) Defer consideration of the request for extension of the variance for use of mobile offices at Rohr Industries, Inc. to the meeting of June 5. Members Rice and Chandler abstained from discussion or voting on this matter. Director's Report Director of Planning reported that a meeting has been scheduled for 3:00 p.m., -5- 5/15/72 May 22 in the Police Auditorium for a Council conference on land use alterna- tives of the Bayfront Study. Tom Cooke and Dr. Gruen will be in attendance and the Port Commission members have been invited. Mr. Warren called attention to the problem with which applicants are confronted when they do not receive staff comments until Monday morning and feel there is not sufficient time to prepare a presentation if the staff recommendation has not been favorable. He pointed out that Chula Vista has a short processing time between receipt of applications and consideration by the Commission. He noted that the County now mails a tentative agenda two weeks in advance of the meeting. He suggested it may be advisable to add a week to the processing time for applications and requiring that staff comments be available by Wednesday evening or Thursday morning. The Commission discussed the advantages to both applicants and Commission members of having additional time to review staff comments. It was recommended that this matter be pursued wi th the City Administrative Office and suggestions brought back at another Commission meeting. Associate Planner Lee commented on the requirement on new construction in com- mercial and multiple family zones for enclosed areas for trash containers. Existing shopping centers constructed before this ordinance was adopted are not required to provide such enclosures. He suggested that consideration be given to requiring that enclosed areas for trash containers be constructed in existing shopping centers which do not already have them. Chairman Stewart asked that this problem be reviewed by the staff and City Attorney and if an amendment to the ordinance is required that a draft be presented at a future meeting. Commission Comments Member Macevicz brought up the matter of moving oral communications to the first part of the agenda as discussed at the workshop meeting. MSUC (Macevicz-Rudolph) The item of oral communications be moved on the agenda to follow approval of the minutes for a trial period of 30 days. Member Rudolph called attention to a debate on Proposition 9, The Clean Environment Act, at Southwestern College at 8:00 p.m. on Thursday, May 18. Also on the same date the CPO Goals Committee will conduct a meeting at Chula Vista High School starting at 7:30 p.m. Member Rudolph asked about fill dirt being placed in the marsh area of the Tidelands, and also stakes have been placed all the way across the marsh lands. Director of Planning Warren advised that the mean high tide line has been staked by the Port District because they are trying to plot it for their own records and in connection with their revision of their Master Plan. Concerning the fill dirt, he reported that this is apparently being done on Sam Vener's property by a permit issued in 1969 for uncompacted fill. This was prior to the moratorium against development and the City Council will be asked to consider rescinding that authority. -6- 5/15/72 Member Rudolph thanked the staff for the articles concerning housing sent out with the staff comments. She stressed the need for further study and con- sideration by the Commission of the goals of the Housing Element. She felt a copy of the statute which requires the Housing Element and of the Housing Element Guidelines should be distributed to the Commission. Member Whitten raised a question about the installation of some type of barrier over underground culverts. He felt these present a real hazard for children playing in the area. Director of Planning Warren advised he would pursue this with the Engineering Division and report to the Commission. Member Adams reported that he has observed a large number of apartment units under construction along Telegraph Canyon Road on land which was zoned R-3 some years ago and wondered why construction at this time had not been called to their attention. Director of Planning Warren advised that while this property has been zoned R-3 for at least 12 years, changes in the zoning ordinance affecting this zone have been applied to the development of the property. They can have fewer apartments now, are required to have more parking and more open space. The property is being developed under present regulations and approval was required by the Planning Department staff. Oral Communications Kathryn Moore, 1134 Tobias Drive, speaking for South Bay Citizens Planning Com- mittee, raised questions concerning the parking at the new post office facility which opened today. She was under the impression that parking of this nature requires double striped stalls. Mr. Warren advised this is required of 90° parking stalls. Chairman Stewart questioned the status and membership of the South Bay Citizens Planning Committee, and whether items which Mrs. Moore brings up at Commission meetings are the result of action taken by the Board of the Citizens Planning Committee. Mrs. Moore advised it is their agreement that any member of the Board may make an initiative of any item of interest to the group. City Attorney Lindberg affirmed that an officer of any group may speak for the group and is then held accountable by their organization. He felt that if specific action has been taken by the membership of the group that should be made known to the Commission receiving the report. Mr. Warren discussed with Mrs. Moore the problems of circulation and parking at an activity of this nature and the aims of the co~issions and staff who worked on the parking layout.
