CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA
February 21~ 1973
The regular adjourned meeting of the City Planning Commission of Chula Vista,
California was held on the above date beginning at 7:00 p.m. with the following
members present: Rice, Macevicz, Chandler, Rudolph, Whitten, Wilson, Swanson
and ex-officio member Miller. Also present: Acting Director of Planning Williams,
Environmental Review Coordinator Reid, Associate Planner Lee, Assistant Director
of Public Works Roberts, and Assistant City Attorney Blick.
The pledge of allegiance to the flag was led by Chairman Rice, followed by a
moment of silent prayer.
APPROVAL OF MINUTES
MSUC (Whitten-Wilson) The minutes of the meeting of February 5, 1973 be approved
as mailed. Member Wilson abstained from voting due to his absence from the
meeting on that date.
The Chairman called for oral communications and none were offered.
PUBLIC HEARING (Cont.): a. PLANNED UNIT ~EVELOPMENT - Request for approval of
Fairway Downs.
b. CONDITIONAL USE PERMIT - Request for approval of
residential development in Flood Plain District -
Fairway Downs, Inc.
Acting Director of Planning Williams advised that although this hearing has been
continued for several months, there is still additional information to be furnished
for the Environmental Impact Report with reference to the flood plain and flood
way analysis of the Sweetwater River. This could be done by the developer, or he
could await the completion of a County study which is under way and expected to be
completed early in May. The developer has chosen to rely upon the County study.
Mr. Reid, Environmental Review Coordinator, is recommending a continuance of that
hearing until May 21, 1973. Since action on the Planned Unit Development applica-
tion cannot be taken until the City Council has acted on the rezoning request which
is delayed for the Environmental Impact Report, the staff recommends continuing
this hearing to the meeting of June 18, 1973.
Member Chandler asked if the County is still attempting to buy this property as
part of the proposed Sweetwater Regional Park.
Mr. Williams confirmed that the County Board of Supervisors has taken action to
acquire certain property for that park and this property is included in their
action.
MSUC (Chandler-Whitten) The public hearing for consideration of the Planned Unit
Development and conditional use permit for Fairway Downs, Inc. be continued to
the meeting of June 18, 1973.

- PUBLIC HEARING: Consideration of Environmental Impact Report for Rancho Robinhood
Environmental Review Coordinator Reid advised this report was filed on a ll6 lot
subdivision, of which 114 lots are for single family dwelling units. The two
discretionary acts in the review of this project are the tentative subdivision
map and the consideration of a precise plan reducing minimum lot sizes while
maintaining an overall density in conformance with existing zoning of the property.
The Draft Environmental Impact Report was filed on January 9, 1973 and the posting
period ended on February 5, 1973. Input from the Environmental Control Commission,
Public Workd Department, Planning Department and the school districts was reported
in the written memorandum. This input resulted in several revisions to the draft
report; the two most significant include the geology section, including a discussion
of rock units, landslide, earthquake faults, expanse of soil, erosion, and natural
resources, and the inclusion of mitigating measures included in the project for
noise and traffic circulation.
Mr. Reid also advised that one correction should be made in the report, on page 5a
where reference is made to a channel under Sweetwater Road, it should read Bonita
Road. Subject to that correction and the inclusion of the minutes of this public
hearing as an appendix to the report, the Environmental Review Coordinator
recommends adoption of the report.
This being the time and place as advertised, public hearing was
the
opened.
As
no one wished to speak, the public hearing was declared closed.
Member Chandler commented that this is the most concise and to-the-point environ-
mental report that has been reviewed by the Commission to date and he felt it
answers the necessary questions.
Member Rudolph noted that this report also brought about some changes in the
original development plan in order to alleviate some problems.
MSUC (Whitten-Chandler) The Environmental Impact Report on Rancho Robinhood,
RESOLUTION EIR-73-2 as submitted and with the inclusion of recommended
amendments be adopted.
PUBLIC HEARING (Cont.): REZONING - Otas Lakes Road and Allen School Lane -
R-E-D to R-E-P - Rancho Robinhood Homes~ Inc.
Acting Director of Planning Williams advised that this rezoning request will be
discussed with the following agenda item for consideration of the tentative
subdivision map.
SUBDIVISION (Cont.): Revised Tentative Map of Rancho Robinhood
Associate Planner Lee pointed out the location of the property south of Allen
School Lane, west of Otay Lakes Road, totalling 73 acres. The present zoning is
for half acre lots, which would allow minimum lot sizes down to 15,000 sq. ft.
The rezoning request is for the purpose of developing under a precise plan by
reducing the individual lot sizes but retaining a larger portion of the entire
site in natural open space. The present zoning would permit approximately 125
units on this 73 acre site, whereas the developer is proposing 114 single family
homes.

Mr. Lee discussed the details of the tentative map, noting that the average lot
size is 10,000 sq. ft. and that a 5 acre park site will be reserved adjacent to
Allen School. lie noted that sidewalks will be provided on all streets except
Otay Lakes Road and the south side of street "B" abutting the open space area.
He noted that an agreement will be required prohibiting the construction of any
structures or fences in the open space area and allowing access for installation
and maintenance of landscaping and irrigation systems as necessary.
Mr. Lee called attention to the recommended conditions concerning utilities, walls,
slopes~ landscaping and irrigation under the staff's recommendation for approval
of the tentative map.
The Commission discussed access to this development and it was noted that Allen
School Lane will be improved to a 28 ft. paving width.
This being the time and place as advertised, the public hearing on the rezoning
request was opened.
James Ashbaugh~ of George Nolte and Associates, representing the applicant,
commented on two questions raised by Commission members. He advised that the
pads for houses adjacent to the school property will be at elevations 10 to 15
feet above the school ground. He also noted that Allen School Lane has an existing
right of way width of 55 feet and no additional right of way is required but the
developer of this project will install improvements on the south side of the center
line of this street.
As no one else wished to speak concerning the rezoning or the tentative subdivision
map, the public hearing was closed.
MSUC (Chandler-Macevicz) Recommend to the City Council the change of zone for
RESOLUTION NO. PCZ-72-S 73.4 acres located south of Allen School Lane, west
of Otay Lakes Road, from R-E-D to R-E-P.
MSUC (Whitten-Rudolph) Recommend to the City Council the approval of the
tentative subdivision map for Rancho Robinhood subject to the conditions enumerated
in the staff report by the Planning Department and by the Director of Public Works.
PUBLIC HEARING (Cont.): CONDITIONAL USE PE~qIT - 89 First Avenue - Request to
construct buildin9 for worship - South Bay Church of Christ
Acting Director of Planning Williams reported this item was continued from a
previous meeting due to various street access and sewer problems and to the need
for an Environmental Impact Report. Since no report has been filed by the appli-
cant it is recommended that the request be denied.
This being the time and place as advertised, the public hearing was opened.
Dave Shipman, 66 Corte Maria, voiced opposition to the granting of a conditional
use permit for a church, lie felt since no representative of the church or of the
owner had appeared at the meetings, the request should not be approved.
As no one else wished to speak, for or against, the public hearing was closed.
MSUC (Macevicz-Wilson) The request for a conditional use permit to construct a
building for worship at 89 First Avenue be denied, based on the following findings:

1. The required Environmental Impact Report was not filed.
2. Approval of the request would place an unnecessary hardship and burden on the
adjacent property to the south by the amount of traffic generated by the use
across the lot.
3. The proposed use cannot comply with the rules and regulations of the City Code
until it has met the necessary street frontage, sewer and drainage requirements.
4. The Zoning Ordinance requirement that churches be located on a collector road
has not been met.
Consideration of Pacific Telephone Petition for Annexation
Acting Director of Planning Williams indicated the location of 5.2 acres on the
south side of Otay Valley Road, east of 1-805, which the Pacific Telephone Company
has petitioned for annexation to the City of Chula Vista in order to receive
City services. He noted that the property could be serviced either by the City
or by the Montgomery Sanitation District but requires annexation to one body or
the other in order to obtain sewer service.
Pacific Telephone Company proposes to improve the property with a telephone office
building, garage and storage building. The City Fire Department, Engineering
Department and Police Department have indicated they anticipate no problem in
providing services to this area. The property is adjacent to present city limits
and the staff recommends that the Planning Commission approve the boundaries of
the annexation proposal and permit the staff to file the annexation with LAFCO.
Charles Horn, Pacific Telephone Company Engineering Department, confirmed the
company's desire to annex the property to the City of Chula Vista.
MSUC (Whitten-Wilson) The boundaries of the 5.2 acres located on the south side
of Otay Valley Road, east of 1-805, proposed for annexation by Pacific Telephone
Company be approved and the staff directed to file the request with LAFCO.
Request for extension of time on Conditional Use Permit for construction of a
church at 623 Telegraph Canyon Road - Chula Vista Alliance
Church
Acting Director of Planning Williams advised that although the conditional use
permit to construct a church and educational units on a 2~ acre site at 623 Telegraph
Canyon Road was approved a year ago, building permits and approval of site plans
have been withheld since that time to permit the City to complete its work on the
alignment of Telegraph Canyon Road. Since the delay in utilizing the permit has
been at the request of the City, the staff recommends that a one year extension
of time be granted.
MSUC (Chandler-Wilson) Approval of a one year extension of time for a conditional
use permit for the construction of a church at 623 Telegraph Canyon Road.

Request for deferral of public improvements to alley at ll9-1211qadison Avenue
Acting Director of Planning Williams reported that application was made for building
permits with a building valuation in excess of $5,000 on each of the two properties,
which would require the installation of public improvements. The existing alley
pavement does not meet current paving standards but it would not be practical to
install individual segments of the alley because of grade and drainage problems.
The staff therefore concurs with the Division of Engineering reco~nendation for
approval of the deferral subject to the execution of an agreement to guarantee
installation of concrete alley improvements upon written notice by the City, the
posting of a bond in the amount of $32500 to cover the cost of construction on
both properties, and waiving the right of protest in the event a 1911 Act proceeding
is instituted.
MSUC (Macevicz-Whitten) Approval of the request for deferral of public improve-
ments to the alley at 119-121 Madison Avenue subject to the conditions enumerated.
Request for approval of sign program for Whispering Trees Village, 88 E. Bonita
Road - C-N Products
Associate Planner Lee displayed a rendering of the buildings of Whispering Trees
Village and of the signs proposed for attachment to the roof of the building and
of a freestanding sign to be located within a planter in the center of the drive-
way on Bonita Road. Under this sign program all tenants' signs will be uniform
in lettering styles, color and wood. The signs would utilize wood facing and
interior illuminated plastic letters. The staff recommends approval of the sign
program on the basis that the signs are architecturally compatible with the
building and the sizes are related to the store frontage; the freestanding sign
offers identification for the entire center.
MSUC (Whitten-Rudolph) Approval of the sign program for Whispering Trees Village,
88 E. Bonita Road as presented by CN Products.
Request for approval of wall sign at 895 Third Avenue - Frazee Paints
Associate Planner Lee displayed a rendering of the applicant's request to place
wall signs on the north and west elevations of the Frazee Paint store. Such wall
signs are normally permitted in the C-C zone, however, freestanding signs require
Commission approval and a freestanding sign for this facility was approved in
1970 because the applicant stated they did not wish to use any sign on the
building itself as it would detract from the architecture. The approved sign is
39 feet high and contains approximately 170 square feet, which the staff feels is
adequate to identify the business. It is felt the wall signs should not be approved
unless the freestanding sign is to be removed. It is further suggested that the
applicant consider the possibility of redesigning the freestanding sign to accom-
modate a reader board for special sales if this is desired.
Member Wilson suggested the possibility of permitting the name Frazee Paints only
on the building since the freestanding sign is some distance away from the building
and there may be some confusion in locating the store.
Mr. Lee reported the staff's opinion would be that they should use one type of
sign or the other, but the signing should not be duplicated by using both.

Corky Schauer, California Neon, advised they wish to withdraw the request for
wall signs based on the staff's recommendation of modifying the existing pylon
sign as a reader board.
~SUC (Rudolph-Chandler) The request for approval of wall sign at 895 Third Avenue
for Frazee Paints be filed.
Resolution modifying side yard requirement for El Rancho del ReS Unit 1
Associate Planner Lee advised that this resolution was prepared at the
Commission's direction given at the meeting of February 5. He also reported that
further contact with F.H.A. indicates that this modification would be needed on a
very limited number of lots within the development. They would accept the 3' and 7'
yards on the majority of the lots since the level topography will preclude
excessive runoff which might have necessitated a wider side yard.
MSUC (~acevicz-Whitten) Adoption of the resolution modifying the side yard
RESOLUTION NO. PCM-72-23-(A) requirements for E1 Rancho del Rey Unit 1
Director's Report
Acting Director of Planning Williams briefly reviewed the proposed budget request
for Planning Commission activities. Included in the request are funds for atten-
dance at the ASPO conference by the Chairman and Vice Chairman and for all seven
Commissioners to attend the League of California Cities annual conference. League
dinner meetings and six dinner meetings in connection with workshop sessions are
included.
Commission Comments
Commissioner Macevicz reported that a communication from Wayne Smith, Chairman of
the Telegraph Canyon Creek Committee, requests his attendance at an additional
meeting to be held on March 7th at 7 p.m. in the Council Chambers. Mr. Macevicz
invited any other Commissioners who could to also attend that meeting as the Corps
of Engineers has been presenting quite informative sessions with regard to flood
control.
Commissioner Rudolph asked about the formation of a Transportation Committee.
Ex-officio member ~4iller reported that the Environmental Control Commission felt
this should be presented to the City Council and rely on the Council for the
formation of a committee. Three members of the E.C.C. expressed an interest in
serving on a transportation committee.
Member Swanson reported that he had discussed this matter with Mayor Hamilton
who indicated he had been in communication with a representative of Rohr in
charge of research and development. Tilis will be pursued and a presentation
made to the Planning Commission, Environmental Control Commission, and the
City Council after they have developed an agenda for discussion items.
