HomeMy WebLinkAboutAgenda Statement 1988/07/26 Item 4a COUNCIL AGENDA STATEMENT I tern 4 a Meeting Date--ZL26/88 ITEM TITLE: Report on verification of valid signatures on Controlled Growth Management Initiative SUBMITTED BY: City C1er (4/55 Vote: Yes No X ) -- On June 29, 1988, Dr. seph Cummings filed with this office a petition regarding a Gro th Management Measure. He indicated that the number of signatures totalled approximately 10,100. In order to qualify the Measure on the ballot, 5,468 signatures are needed. The signatures have been checked by the Registrar of Voters and have been found to be sufficient to qualify the Measure on the November 8, 1988 General Election. RECOMMENDATION: The Council has the option of (1) either adopting the ordinance without alteration or (2) order the Proposition to be placed on the November 8, 1988 ballot. DISCUSSION: As certified by the Registrar of Voters, the actual count of the signatures was a total of 9,941. The number of signatures needed to qualify for the ballot is 5,468. Because of the number of signatures submitted (4,473 more than needed), I ordered a random sampling of the signatures. As allowed by the Ejections Code, the Registrar of Voters then checks a total of 500 ~natures - 5% of those submitted. As certified by the Registrar of Voters, out of the 500 signatures which were checked, 369 signatures were valid - or a total of 74% - and 131 were not valid. The Elections Code states that the petition ;s sufficient if ttle statistical sampling shows that the number of valid signatures is within 95% to 110% of the number of signatures of qualified voters needed to declare the petition sufficient - in this case, the proponents have filed approximately 134% "qualified" signatures. The Registrar of Voters periodically reports the registration of voters to the Secretary of State. On May 14,1988, the Registrar of Voters certified to the Secretary of State that the number of registered voters in Chu1a Vista was 54,677. Since the proponent's initiative petition was published on March 10, 1988, this is the registration figure we used in arriving at the percentages. by t: e City c',x':l'::i1 ?f Chula Vista, C~hfornla Dated ~ ,./ /370 j Item 4a- page 2 Meeting Date 7/26/88 to the question of qualifying for a special election, the proponents needed 8,202 si gnatures - or 15% of the regi stered voters. If 15% of the signatures were validated, the Council would then have to call a special election not less than 88 days nor more than 103 days after the date of the order - in this case, it wou1 d be between October 15 and October 30. However, wi th the random sampling - 74% of the signatures being valid, this would bring the total Iva1id" signatures at 7,356 or 846 short of the 15% required for a special election. Dr. Cummings has stated, nevertheless, that he is not asking for a special election - his intent is to have the Measure placed on the November 8,1988 ballot. Therefore, since more than 10% of the signatures have been certified as valid, the petition does qualify for the November ballot. As stated in the Recommendation, the Council now has the following options: (a) Introduce the ordinance without alteration at this regular meeting and adopt the ordinance within 10 days: or (b) Submit the ordinance, without alteration, to the voters at the next regular municipal election occurring not less than 88 days after the order of this legislative body - which, in this case, would be the November 8, 1988 General Election ballot. (Sec. 4011) FISCAL IMPACT: Not known at this time. The cost is pro-rated as to the number of items that will appear on the ballot.
