At the direction of the City Council, City staff has conducted negotiations
with the Sweetwater Union High School District for use of District property to
construct a facil i ty for supervi sed youth acti vi ti es. Negoti ati ons have been
completed for approximately 26,000 sq. ft. of property located at the
northeast corner of L Street and Fifth Avenue on the Chu1a Vista High School
campus.
A ground-lease for this property between the City and the District was
approved by the High School Board on July 14,1988. It is now presented to
the Council for consideration.
.COMMENDATION: That the City Council adopt the attached resolution:
1. Adopting Negative Declaration 1S-88-61; and
2. Entering into a ground-lease with Sweetwater Union High School
District for the Chula Vista Youth Center site.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
Terms
The attached lease will entitle the City to use the subject site to construct
a 14,000 sq. ft. youth activity center. The property and lease will extend
for forty (40) years from date of execution. In turn, the City will
compensate the High School District One Dollar per year, provided the District
is allowed joint use of the building for school related activities during
certain school hours, limited evening hours, and certain times during the
summer. The hours designated for District use will be decided annually by
mutual agreement between the City and District.

Maintenance and Utilities
The School District will provide custodial services for the facility and the
City will reimburse the District their pro rata share. The City will be
responsible for general maintenance and repairs to the building. However, the
District will be responsible for reimbursement to the City for repairs in
excess of normal wear-and-tear caused by the District's use.
Utility services will be provided by the City. The District will pay the City
their proportionate share.
Indemnification
Both the City and District will indemnify each other from claims stemming from
use of the proposed youth center. At 1 east $5 mi 11 i on of general 1 i abi 1 i ty
insurance will be carried by each, both naming the other as additional insured.
The City Attorney and Risk Manager have reviewed the attached ground-lease and
have approved the provisions proposed relative to the City's potential
liabilities.
In summary, the City wi 11 be gi ven use of the property and the Redevelopment
--'ency will construct a youth activity center on the site. In compensation
r the land, the High School District will be allowed to utilize the center
for certain activities as mutually agreed upon by the City and District.
After 40 years have passed, the 1 ease may be extended for an additional 20
years by mutual agreement of the City and District. Upon termination of the
lease, the land and building will be turned over to the District.
FISCAL IMPACT: The ground-l ease will cost the Ci ty only One 0011 ar per year
in funding. The construction of the Center, through the Agency, will be
approximately $1,000,000 which has been set aside in a CIP account. Budgeting
for the maintenance and operations of the Center will be prepared following
design and determination of the City's user.
