In order to make the transition back to the existing right of way to the west, the neighboring property owners have offered to dedicate a variable width strip along their property. (See Exhibit" A" ) RECOMMENDATION: That Council adopt the subject resolution accepting the right of way and direct the City Clerk to have the documents forwarded to the County Recorder's office. RDB/COMMISSIONS RECOMMENDATION: Not Applicable DISCUSSION: Recently, the owners of the property at the northwest corner of Fourth Avenue and Flower Street submitted plans for the construction of an apartment building. One of the conditions of approval of the project was that they widen the portion of Flower Street adjacent to the parcel. As a result, they are required to dedicate a 20-foot strip of land along, the frontage on Flower. In addition, they were to dedicate a two-foot strip along Fourth Avenue to bring the street width into conformance with the City's standard for a collector street. To facilitate construction of a transition in the curb line westerly to meet the existing improvements, the adjacent property owner has agreed to dedicate the needed right of way. The owners have executed their portions of the deeds along with the necessary Subordination Agreement and the documents are ready for acceptance by the Council.
