In order to obtai n Federal authori zati on for constructi on funds in projects
involving participation of Federal Aid highway funds, a Right-of-Way/Utility
Certification is required in nearly every project. The certifications must be
signed by the duly authorized representative of the local agency. A
resolution designating the local official authorized to sign certifications
must be on file at the California Department of Transportation District Office.
RECOMMENDATION: That Council adopt a resolution designating the Director of
Public Works and City Engineer as the local agency officials authorized to
execute on behalf of the City Right-of-Way/Utility Certifications for
federally funded projects.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The City is allocated annually a share of available Federal Aid Urban highway
funds. Additionally, occasional grants of federal monies are received for
highway projects. Authorization to advertise for bids for construction of
highway projects is not granted until a Right-of-Way/Utilities Certificate has
been reviewed and si gned by the Cal iforni a Department of Transportati on and
approved by the Federal Highway Administration.
The certifi cate must be si gned by the authori zed local agency offici al and
state that legal and physical possession of the necessary right-of-way for the
project has been obtained and the property vacated.
Pursuant to City Code Section 2.06.010, the City Engineer is appointed to
perform the duties imposed upon the street superintendent by the Improvement
Act of 1911. These duties are, in general, the care or charge of the City
streets and their improvement. Therefore, it would be appropriate to
designate the City Engineer as the local agency official authorized to execute
said certifications. It is recommended that the Director of Public Works also
be authorized to sign as an alternate.
