HomeMy WebLinkAboutPlanning Comm min 1973/03/19 MINUTES OF A REGULAR ADJOURNED MEETING OF THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA March 19, 1973 The regular adjourned meeting of the City Planning Commission of Chula Vista, California was held on the above date beginning at 7:00 p.m. with the following members present: Rice, Macevicz, Chandler, Rudolph, Whitten, Wilson and Swanson. Also present: Director of Planning Peterson, Assistant Director of Public Works Robens, and Assistant City Attorney Blick. The pledge of allegiance to the flag was led by Chairman Rice, followed by a moment of silent prayer. No oral communications were offered. APPROVAL OF MINUTES MSUC (Whitten-Macevicz) The minutes of the meeting of March 5, 1973 be approved as mailed. PUBLIC HEARING (Cont.): CONDITIONAL USE PERMIT - Request to operate auto bodS repair and paint shop - 24 Broadway - Manuel Machado Director of Planning ?eterson advised that the applicant has obtained a pem~it from the Air Pollution Control District and has filed an environmental assessment which will be reviewed on March 22nd and the posting period will end on March 29th. The earliest Commission meeting to which this item can be continued in April 16. MSUC (Chandler-Whitten) The public hearing for consideration of the conditional use permit to operate auto body repair and paint shop at 24 Broadway be continued to the meeting of April 16, 1973. PUBLIC HEARING (Cont.): CONDITIONAL USE PERHIT - ~equest to construct a helistop on the site of hospital complex, south of Telegraph Canyon Road, east of extension of Brandywine Ave. - Community Hospital of Chula Vista Director of Planning Peterson reported that the staff has not been able to reach an agreement with the applicant as to the proper location for the helistop, and the staff endoreses the previous recommendation that it should be 400 feet from any adjacent property line for safety reasons as well as sound attenuation reasons. He noted that the applicant has agreed to move the helistop about 75 feet westerly of the original proposed location but, in the opinion of the staff, that is not an adequate distance from the property line. Chairman Rice declared the public hearing open. Charles Fish, of architectural firm of Bird, Fujimoto and Fish, noted that their revised plan would locate the helistop 200 feet west of the east property line and 350 feet north of the south property line which, in their opinion, is the greatest extent of move they can make within the framework of the existing site plans. He confirmed that they have not started grading, but the site plans have been completed. He felt that conforming to the 400 ft. distance from any property line would limit the location to about 3 acres in the center of the site. They believe the proposed location is feasible considering the infrequency of its use. -2- 3/19/73 Gayland Goodrich, San Diego Gas & Electric Company, 476 H Street, reported they have overhead electric transmission lines in the vicinity which may present a problem in night operations. Mr. Fish advised that the Federal Avaiation Administration has issued a finding with regard to surrounding hazards and slopes which states there is no hazard. As no one else wished to speak, the public hearing was closed. Member Whitten expressed his concurrence with the requirement for 400 feet distance from the property line. Member Macevicz indicated he would hate to see the helistop eliminated from the plans because the hospital felt they could not meet this requirement. Chairman Rice asked if a continuance to permit further discussion between the staff and applicant might result in agreement. Mr. Peterson indicated he felt an impasse had been reached but if Mr. Fish felt differently the staff would be willing to resume discussion. Mr. Fish advised it is their feeling that they have positioned this at the furthest point from the property line which they feel they can. They did not feel that replanning of the site is feasible. MSC (Whitten-Chandler) Approval of the conditional use permit to construct RESOLUTION NO. PCC-73-1 a helistop on the site of hospital complex, south of Telegraph Canyon Road, east of the extension of Brandywine Ave., subject to the following conditions: 1. The helistop pad shall be located a minimum distance of 400 feet from any adjoining property line to insure adequate safety and acceptable decibel readings on future residential development in the area. 2. The applicant shall submit this site for review by the Fire Department for recommendations and conditions regarding fire safety prior to construction of the pad. 3. This matter shall be brought back to the Planning Commission for review at a minimum of every five years to determine whether any necessary changes of conditions or new conditions are required to insure the compatibility of this facility with nearby land uses. Review may be required at an earlier date should any problems be brought to the attention of the staff. 4. There shall be no on-site repair or storage of helicraft at this site. 5. This helistop is not to be used by any helicopter which will produce a decibel reading in excess of 80 decibels measured at the property line. Findings for approval are as follows: a. That the proposed use at the particular location is necessary or desirable to provide a service or facility which will contribute to the general well-being of the neighborhood or the community. -3- 3/19/73 The provision for a helistop on the site of the Community Hospital of Chula Vista would be desirable for air ambulance and emergency service which would contribute to the well-being of the community and surrounding area. b. That such use will not, under the circumstances of the particular case, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. By specifying conditions of approval, the City will assure that this facility will not be detrimental to persons or property. c. That the proposed use will comply with the regulations and conditions specified in the Code for such use. The applicant has signed letters of approval from the Environmental Review Committee and FAA; further approval by the Fire Department has been stipulated, as well as later review by C.P.O. The motion carried by the following vote: AYES: Members Whitten, Chandler, Rice, Rudolph, Swanson and Macevicz NOES: None ABSTAIN: Member Wilson ABSENT: None PUBLIC HEARING (Cont.): CONDITIONAL USE PERMIT - Request to operate halfway house for recuperative patients from hospitals, 380 Broadway - Harold Drinkwine Director of Planning Peterson noted that this hearing was continued from the meeting of February 26 at the applicant's request, but no new information has been submitted and the staff's position remains unchanged. It is felt that this use, which has the characteristics of residential use, does not belong in a commercial area; also that the existing site plan is not well suited for the proposed use. The staff therefore recommends that the application be denied. Chairman Rice declared the public hearing open. Burton Shamsky, attorney representing the applicant, advised that in his opinion a conditional use permit may not be required as the desired use would be within the present zoning. He pointed out this is a new concept in mental health. The people who will utilize this facility are not committed there, nor are they confined or constrained in any way. He indicated this facility would furnish room and meals and would provide a room where the occupants could obtain medical care from doctors who would be available, however, medical care was not a function of the applicant's operation. Mr. Shamsky reported that the applicant plans to use 14 rooms of the motel for this facility, which will accommodate 36 occupants. Roy ~ ..... llO "L" ....... Street, advised he is one of the owners of the motel site, and that economic conditions have made it necessary for them to seek other than tourist trade to use these accommodations and this need will be increased with the completion of 1-805. -4- 3/19/73 Clarence Ritter, 629 G Street, pointed out that one of the criteria for a half- way house is a homelike atmosphere which he felt the motel would not provide. He also felt a location which has the heavy traffic and noise which exists on Broad- way is not a suitable location. He felt the physical condition of the grounds and property could account for the difficulty in attracting tourist guests. He asked that the application be denied. Kathryn Moore, 1134 Tobias Drive, indicated that with a background as a registered nurse and a public health nurse, she does not feel the motel is a good type of facility for this use nor is Broadway a good location for such a facility. Mr. Shamsky asserted this is a good place for the people they will accommodate; these people have no disability and have been certified to be all right and the State is trying to find a place where these people can be part of the community again. He contended the most desirable place is where they can have public transportation available, can go to restaurants and to recreational facilities. He emphasized they are free to leave the facility and free to return. He affirmed that people with a severe mental problem would not be allowed accommodations in this type of facility. He again reiterated that this operation should not require a conditional use permit to be located in the C-T zone and asked for the City Attorney's opinion in this regard. Assistant City Attorney Blick recommended that the hearing be continued in order that representatives of the applicant and the City Attorney might further confer in order to determine whether or not the proposed use required a conditional use permit in the C-T zone. MSUC (Whitten-Wilson) The public hearing for consideration of a conditional use permit to operate a halfway house for recuperative patients at 380 Broadway be continued to the meeting of April 2, 1973. Request for revision of condition on access road for Horton Hill Planned Unit Development - James E. Miller Director of Planning Peterson advised that upon receipt of this request Planning and Engineering staff members again inspected the site and felt that the limited use the road will get probably does not warrant widening the paving to 20 feet for a 300 ft. length of roadway, as such widening would require either cutting into the toe of the existing slope on the east side of the road or placing a considerable amount of fill on the west side of the road. The staff, therefore, recommends deletion of the condition to require a 20 ft. wide road around the curve in question. James E. Miller, 4819 Whippoorwill Lane, Bonita, reported that an investigation of the soil indicates that cutting into the bank in order to widen the road would endanger the property above the road. He advised that other properties in the area may be developed in the near future and he felt the road improvement should be a coordinated effort by all property owners that it would serve. Mr. Miller also pointed out the possibility of obtaining access to his property from a road to be constructed in connection with the development of Rancho Robinhood, which road will be contiguous to his property. -5- 3/19/73 Assistant Director of Public Works Robens advised that the tentative map of Rancho Robinhood did not show access to that residential collector street from this property. Attorney William Bauer, 3835 The Hill Road, Bonita, representing three property owners of the area, reminded the Commission that those owners had supported the plan for development of Mr. Miller's property on the basis that the 15' wide road would be widened by 5 feet for 300 feet in length. He pointed out there has been no physical change in the area nor substantial economic change since the condition was applied and based on the incidence of accidents on the narrow road which presently serves only four residents, he felt the requirement to widen the road should be maintained. Ed Kober, Horton Road, spoke against cutting this private road through to connect with another project which might result in increased traffic. MSUC (Whitten-Wilson) The request for a revision of the condition relative to widening the access road to Horton Hill development be denied. Consideration of precise plan for bank building, southwest corner Fourth Avenue and H Street, Balboa Bank Director of Planning Peterson noted that a precise plan for construction of a - bank at this location had previously been approved, but the bank has subsequently purchased additional property to the west and have revised the plans to include that property. This results in improved access and circulation and an increase in the storage area for the drive-through facility. The staff recommends approval of the revised precise plan. MSC (Chandler-Macevicz) The revised precise plan for the Balboa Bank at the southwest corner of Fourth Avenue and H Street be approved. The motion carried by the following vote: AYES: Members Chandler, Macevicz, Rice, Rudolph, Swanson, and Whitten NOES: None ABSTAIN: Member Wilson ABSENT: None Request for vacation of a portion of Quintard Street, east of Third Avenue - Francesco Mannino Director of Planning Peterson pointed out that the street where the vacation is requested is in the City while the adjacent property remains in the County. The staff feels there may be some jurisdictional problems unless the property is annexed to the City. For this reason denial of the request is recommended. MSUC (Whitten-Rudolph) The request for vacation of a portion of Quintard Street east of Third Avenue be denied. -6- 3/19/73 Request for deferral of public improvements in alley from Smith Avenue to Broadwas, between Otis and Roosevelt - Rafael GaribaS The staff report recommends approval of this request since it is impractical to construct individual segments of alley paving because of grade and drainage problems involved. MSUC (Macevicz-Whitten) The request for deferral of public improvements in the alley from Smith Avenue to Broadway, between Otis Street and Roosevelt Street, be approved subject to the conditions recommended by the Assistant Director of Public Works. Request for deferral of street improvements~ 435 James Court - Mrs. Berdine McCrors As noted in the report by the Assistant Director of Public Works, three properties on the north side of James Court presently have deferrals. With this property there will be a total frontage of 258 feet of deferred public improvements out of the total length of James Court of 538 lineal feet. Approval of this request is recommended. MSUC (Chandler-Macevicz) The request for deferral of street improvements at 435 James Court be approved subject to the conditions recommended by the ~ssis- tant Director of Public Works. Request for deferral of public improvements in alles between Garret and Glover Avenue, and between E Street and Davidson Street - David Bounds The assistant Director of Public Works has again pointed out it is impractical to construct individual segments of alley paving because of grade and drainage problems involved, and the request for deferral should be approved. MSUC (Rudolph-Whitten) The request for deferral of public improvments in the alley between Garret ~nd Glover Avenue, and between E Street and Davidson, be approved subject to the conditions stipulated by the Assistant Director of Public Works. Director's Report Director of Planning Peterson advised that in regard to changing the meeting night of the Planning Commission to Wednesday some concern has been expressed by citizens who have taken an active interest in the hearings for Sports World who would not presently be able to attend Wednesday night meetings due to teaching schedules. He felt the Commission should not move too fast in making the change. The Commission felt the change should not take place until June. Mr. Peterson also reported that under the conditions of a resolution adopted in April, 1971 for conversion of a residential structure to an office use, annual review of the premises and the operation is required. Recent inspection of the premises by the staff determined that the builder-contractor office use of the structure at 703 Third Avenue by Monte Russell is presently functioning as approved. MSUC (Rudolph-Whitten) The foregoing report be accepted.
