ITEM TITLE: Resolution - Approving First Amendment to the Agreement
Between Tucker & Kater, Landscape Architects and the City
of Chula Vista for Library Landscape Development

BACKGROUND .
The City Council by Resolution No. 7371 on July 9, 1974 approved an
agreement between the City of Chula Vista and Tucker & Kater, Landscape
Architects for landscape architect services for the new library.
On August 21, 1974 the City Council determined that the northerly 40%
of the total library site as defined in the agreement approved by
Resolution No. 7371 be included in the landscape development of the
library proper and that such expanded improvements should consist of:
1. Site grading to finish contours
2. Soil preparation
3. Automatic irrigation systems
4. Planting of lawn
Inclusion of this additional landscape architect's services requires
an amendment to the agreement. The agreement should be amended as
follows:
1. Modify Part II, Intent of Parties to include limited
development of the northerly 40 percent (approximately)
of the total library site as depicted upon Exhibit "A".

1. Council approve first amendment to the agreement approved by
Council Resolution No. 7371 on July 9, 1974.
2. City Council appropriate an additional $1,900 from the Unappropriated
Surplus of the Federal Revenue Sharing Funds and authorize the
expenditure of $9,600 for library landscape architect's fees.

Increase the total estimated cost of construction from
$70,000 to $108,000.
2. Modify Part III, Item A.2, Scope of Consultants Services
with reference to "Project Architect", in that the land-
scape plans will not be integrated into the original
library construction contract. The grading will be
designed by Tucker & Kater, with the final plans to be
a part of the Project Architects construction contract.
3. Modify Part VI, Time of Completion to indicate that only
those items to be incorporated into the Project Architect's
plans be completed by october 28, 1974. The remaining
services should then have a completion date established.
4. Modify Part VII, Item B, Compensation to increase the "basic
fee" from $6,300 to $8,200.
5. Modify Part VIII, Method of Payment to increase the payment
for Item A.2, Part III from $3,465.00 to $5,365.00.
The agreement approved by Council Resolution No. 7371 provides for
compensation in the amount of 9% (approximately) of budgeted
construction funds. The architect felt that to apply this percentage
to the estimated $42,600 cost for additional construction as provided
for in this first amendment to the agreement, the fee computes to
$3,834, an excessive amount. The architect therefore proposes a
fee of ~% (approximately) which computes to $1,900 of new compensa-
tion. This fee would be payable upon completion of the construction
document phase as defined in the original agreement.
