[ 6 ] CHULA VISTA CITY COUNCIL MEETING OF: September 3, 1974 ITEM TITLE: Resolution - Approving Agreement for Deferral of Public Improvements Adjacent to 212 Church Avenue INITIATED BY: Director of Public Works/City Engineer ;lI~ BACKGROUND On May 22, 1974, the Planning Commission granted a deferral of public improvements for the public alley at the rear of 212 Church Avenue in conjunction with an application for a building permit. The surface of subject 20 foot wide alley is presently composed of sub- standard asphalt and/or oil paving. The City ordinance requires cement concrete paving for public alleys; therefore new alley construction is required. It is impractical, however, to construct this alley at the present time due to its mid-block location and because of grade and drainage problems. Based upon these facts, the Planning Commission gave their approval for deferral of alley improvement construction. The Planning Commission action was conditioned upon posting of a performance guarantee in the amount of $3,500. The property owners have chosen to execute a lien agreement to serve as a performance guarantee. It is necessary that the City Council approve such agreement. Council approval of the agreement will be followed by recordation of the lien in the office of the County Recorder. A transparency is available for Council viewing.
