ITEM TITLE:
Resolution - Approving Vacation of Lot "A" (Date Road)
In Deerpark Chula Vista Subdivision

BACKGROUND
American Housing Guild-San Diego, developers of Deerpark Chula
Vista, have requested the vacation of Lot "A" (Date Road) of
Woodlawn Park Subdivision, according to Map No. 1271. The City
of Chula Vista holds rights of the public for public way over
Lot "A", which is within the boundaries of said subdivision.
These rights of the public were established by a resolution of
the Board of Supervisors of San Diego County, recorded August 27,
1970 as File/Page No. 155201.
The owners of Woodlawn Park at the time the map was recorded did
not offer, nor did they intend to offer, Date Road for dedication
to the public. Thus, this road has never been graded, improved,
or used as a road. It has however appeared as a "cloud" on the
title report for Deerpark Chula Vista, which the present owners
wish to eliminate as mentioned above.
The Engineering Division recommended that Lot "A" be vacated using
the summary vacation procedure as set forth by the City Attorney
on February 4, 1974. In accordance with this procedure, the
Planning Commission on February 27, 1974 considered the vacation
of said road. They recommend that the request for vacation be
approved, per letter dated February 28, 1974, a copy of which is
attached.

Supplemental Sheet No. 1
Per the summary vacation procedure, Council may adopt a resolution
vacating the road. Upon adoption, the resolution shall be recorded
in the office of the County Recorder.
It is requested that Council adopt said resolution and direct the
City Clerk to record it at the office of the County Recorder.
A transparency is available for Council viewing.

Subject: Request for vacation of Lot IIAII (Date Road) in
Deerpark Chula Vista
On February 27, 1974 the City Planning Commission considered
a request initiated by American Housing Guild for the vacation
of Lot IIAII (Date Road) in the Deerpark Chula Vista subdivision
as shown on the attached plat.
As this right of way has never been graded, improved or used
as a road, the City Planning Commission recommends that the
request for vacation be approved.
