[ 5 ] CHULA VISTA CITY COUNCIL MEETING OF: M~~ 5'll~74 ,,' ITEM TITLE: Resolution - Establishing a schedule and fee for consideration of General Plan Amendments INITIATED BY: Director of Planning BACKGROUND Section 64361 of the Government Code which went into effect January 1, 1974 states: "No mandatory elemenfof.a general plan shall be amended more frequently than three times during any calendar year, which amendment or amendments may occur at 'any time as determined by the legislative body. This section shall not apply to adoption of any element of the General Pl an. II '. . .._~ ANALYSIS . 1. It'is clear from the language in the law that a number 6f miscellaneous small changes to the Plan can be considered together as one amendment, but not more than' , three times a year. 2. To maintain flexibility in the General Plan and an ability by the City to reflect changing conditions, one amendment should be reserved speci,fically for City use to amend the plan as necessary upon completion of City-initiated studies. Approve the proposed schedule for considering Genera1Pl an Amendments 2. Amend- ments now being prepared (such as Dr. Bloom's for the regional shopping center) should be exempt from this schedule inasmuch as it is incumbent on the City to give reasonable notice of changes in rules and regulations. 3. The question arises as to the appropriate fee for a General Plan Amendment application. The work required to review such an application is at least as complex as on a rezoning application ($175 filing fee) and in many cases would be much more complex. A fee of $200 plus $2.00 for each acre over 5 acres appears reasonable. ~ 1J/ I """"'~--__.-..._..- v
