MINUTES OF A REGULAR MEETING BOARD OF APPEALS AND ADVISORS CITY OF CHULA VISTA, CALIFORNIA May 13. 1991 Parks & Recreation Conf. Rm. 5:00 p.m. MEMBERS PRESENT: Chairman Contreras, Vice-Chairman Leonard, Board Members Arnold, McArthur, Nash and Reynolds MEMBERS ABSENT: Board Member Gingerich CITY STAFF PRESENT: Director of Building and Housing Larsen, Assistant Director of Building and Housing Remp and Administrative Secretary Uybungco CALL MEETING TO ORDER: Chairman Contreras called the meeting to order at 5:06 p.m. ROLL CALL: Members present constituted a quorum. 1. APPROVAL OF MINUTES: MSUC Arnold/Leonard (6-0) to approve the minutes of April 8, 1991. 2. NEW BUSINESS: A. Adoption of 1990 National Electrical Code Director of Building and Housing Larsen informed the Board that the State will mandate the adoption of this code on July 1, 1991. Upon approval by the Board, staff will bring this Ordinance forth to the City Council for adoption. The following is a summary of the changes proposed: The Official Board to hear Electrical Appeals will be the Board of Appeals and Advisors All statements with the male gender was substituted to unisex gender Reinspection fees have increased from $15.00 to $30.00 as per the Uniform Building Code Electrical fences are prohibited within the City of Chula Vista MSUC Nash/Arnold (6-0) to approve staffs recommendation to bring the Ordinance to the City Council for adoption. * * * * ~ .,., Board of Appeals & Advisors -2- May 13, 1991 B. Postponement of Regular Scheduled Meeting of July 8, 1991 to July 22, 1991 MSUC Arnold/Nash (6-0) to approve the postponement of the July meeting. 3. DIRECTOR'S COMMENTS/REPORT: A. Boards/Commissions/Committees Attendance Policy Director of Building and Housing Larsen informed the Board that the City Clerk's Office is in the process of updating the B/C/C Handbook. According to the Attendance Policy, all members are required to attend at least 75 percent of all meetings. All absences must be noted in the Minutes as being excused or unexcused. This new notation will be incorporated into the Minutes beginning at the July 1991 meeting. Report on Citation Authority Program B. . One method is to cite the violation and seek compliance through due process and then refer to the City Attorney's Office to take the case to court. The following are the advantages of this method: (1) compliance in quicker fashion, (2) stronger enforcement tool and (3) less staff time required for site inspections. Another method is to cite the individual directly into Southbay Municipal Court (similar to a traffic citation). The following are the advantages of this method: (1) severity of violation, (2) criminal record recorded and (3) the authority the court represents would be a threat for compliance. The Department of Building and Housing has been working with the City Attorney's Office on this proposed program. The Attorney's Office has issued a memorandum to our Department suggesting staff to investigate the program of citing individuals into court instead of the Administrative Citation Program. The Department feels that this method is too time consuming because the Officer must appear in court and would require too many staff hours. The Department will bring forth an update on our investigation of this program to the Board for review and approval prior to forwarding to City Council for adoption. 4. COMMUNICATIONS (PUBLIC REMARKS/WRITTEN CORRESPONDENCE): A. Board Member Arnold expressed her appreciation to Assistant Director of Building and Housing Remp and Administrative Secretary Uybungco for their efforts during the past meetings (McMurtry's Appeal). . ........
